It seems to me that this bill is really aimed at demolishing the internet as a source of distribution for artist made works. No longer will artists have a free direct link to the public. This will recreate the pre-internet status quo where artists were forced to use a middleman to get their work to the public. It is intended, I believe, to drastically reduce the amount of free artist created content available online. If we have to pay for our own copyright will we offer the content for free?

Even if people pay to copyright protect, this bill is said to also relieve infringers from having to pay actual damages if they can prove they contacted the copyright office and ran a specific number of searches for your work through database systems. To make matters worst, I'm not sure if there is any foresight in this bill as to how many database systems there will be and whether or not they have to actually wait for a copyright check to be performed prior to snatching up someone's work.

This is a bill for US law. So any cases in a court of the US will need to recognize this bill if it passes. This means if an infringer claims he could not find the owner of a video from youtube, then yes, he can.

Laws in other country may take the same situation and act differently. In Canada, they already recognize an orphaned works situatiuon, though I dont know the details.

they can even take your display picture of your facebook (you know the one with YOUR FACE on it) and use it for commercial purposes and because of the many loopholes, they can get away with it even if you come to court with the same face as in the photo

Also, if this bill protects businesses that clear the work as "orphaned" then I'm wondering who'll face "invasion of privacy" charges? The person who actually posted the work (because that could be his best friend or his brother)? LOTS of people may be facing charges with this bill!

This is a US law/bill however an orphans work bill is being constructing in europe and already exsists in Canada.

I agree this bill needs to be watched and complained about until it fixes the obvious problems. However the bill is not a bad one in its core, its just too broadly stated that allows a huge potential for theft and dishonesty.

I would like to see a work be at least 25 years old before it can become orphaned.
