I was warned ahead of time that 70% or more would be needed, even though 51% is all that the rules would require, and now I see why. When they own the gavel and the amplified microphone, they can call voice votes as they please, refuse calls to count the votes, etc.

After the precinct caucus, Bertuzzi and others illegally added 151 delegates to the county convention. They did so because, without those illegal "delegates," the Ron Paul delegates would have outnumbered them.

Two years ago this same tactic was used in Gillespie County, Texas by the County Chairman, Pauline Cusack. A number of us fought it, challenging what they did at the state convention. But, we did not hold a rump convention. The Credentials Committee ejected the County Chairman and the county Credentials Committee Chairman from the state convention, but refused to throw out the entire, illegal delegation, as required by law.
As a Texas Republican, and delegate, I hope the Republican party respects the rules- if they just shut out those who don't agree with the party rulers, we may as well just eliminate the delegate system and let the elite TELL US what to believe...

A Rep. delegate has filed a petition for a writ of mandamus with the TX Supreme Court asking that the court order County Chairman Mike Bertuzzi to release precinct convention records that disclose the identity of delegates properly elected. She claims that numerous unauthorized participants were seated and their votes included in the process of electing delegates to the state convention.

Pretty Simple really. Nueces county Rep. leadership is used to making up the lists of 'delegates' to the county conv. out of thin air instead of getting people involved and actually electing people. Unfortunately we do not know yet if state is going to be any better!!!

you may not be aware that in Texas, audio tape is legal as long as one party to the conversation consents to the taping. the recorder was in plain sight, there was no covert recording.

You must not be from Texas - we are a one-party system. Meaning, as long as one person (party) in the recording consents to or knows about the recorder and it is in plain sight, it is allowed.
Common sense would exclude this from private meetings at work to be used to sue your employer - this could easily reuslt in you being fired regardless of the legality of the recording.

Taping the meeting is directly permitted by party rules. And, even if the party rules said 'NO,' Texas law provides the means by which it can be done legally.
The tape itself doesn't provide the evidence, but the law merely requires ONE non-recording party member to agree to the recording.
As long as they asked SOMEONE, they are just fine, regardless of what the party would say.
The party rules, however, state that these are public.

The Credentials Committee Chairman clearly added (listen to audio) over 40 names to the delegate list the morning of the convention. He did so because as he said of the ~40 "All have voted in the republican primary on March 4 or early voting in 2008 and that qualifies them for seating at this convention." Never mind that in order to be an authorized delegate these persons must have been duly elected at the precinct level.
I was there calling for 'point of order.' And, you are correct, when the chairman ignored "point of order" requests, he clearly violated the laws of the republican party of human decency.

The person reading the credentials report-the credentials chairman- was not eligable to be a delegate at the convention. The county chairman was not eligable to be a delegate at the convention. Our SREC member, Bob Jones, was not eligable to be a delegate. Candidates for Texas Rep., Todd Hunter, Connie Scott, Raul Torres were not eligable to be delegates. And they all stood by and DID NOTHING while the convention was railroaded. Would you vote for them?

The thing about an "emergency meeting' to choose rules for the convention, is that there are no rules until the people accept them by voting them in, and until that point, Robert's Rules are the rules. In Missouri, there were NO standing rules, so if that is what they told you Chester, it is a lie. They changed the agenda last minute too, to benefit them and do a TON of business before the temporary chair is even elected also not good. (Got to get a taste of this in District 7 in Missouri)

At a MISSOURI Republican District Convention for the St. Charles County area (St. Louis) Satuday, the chairman was so unfair that someone finally motioned to adjourn so they could continue the meeting elsewhere. THE MOTION PASSED OVERWHELMINGLY, and people went out and continued the meeting a short distance away. The remaining minority IGNORED THE VOTE, and continued their own meeting. We have TWO results. We'll see which the Party accepts and just how many voters they're willing to lose.

These are NOT true Republicans. They are rhinos. That is why this country is in such a mess. True Republicans need to wake up and learn the rules to get it right. There were a lot of corrections that had to be made in other states as well.
You do not have to have been at the precinct convention, NOR have been a county/senatorial delegate to be a delegate to the State Convention. The only requirement to be eligible to be a delegate to the State Convention is the same as being a delegate to the County convention. You only have needed to have voted in the primary.
However, this misunderstanding could have been easily placated if the Chairman would have followed the rules and recognized the the point of information/order.

Their convention is void as they did not hold the quorum. The people adjourned the meeting and held a rump convention in the parking lot. Now to convention results will be submitted to the state GOP. They will have to decide which convention is valid.

Pretty Simple really. Nueces county Rep. leadership is used to making up the lists of 'delegates' to the county conv. out of thin air instead of getting people involved and actually electing people. This time someone objected, they are trying to cover it up and breaking more laws in the process - denied access to open records, falsified records, railroaded the convention, and the list goes on. Unfortunately we do not know yet if state is going to be any better!!!

you may not be aware that in Texas, audio tape is legal as long as one party to the conversation consents to the taping. the recorder was in plain sight, there was no covert recording.

You must not be from Texas - we are a one-party system. Meaning, as long as one person (party) in the recording consents to or knows about the recorder and it is in plain sight, it is allowed.
Common sense would exclude this from private meetings at work to be used to sue your employer - this could easily reuslt in you being fired regardless of the legality of the recording.
In this case though, it is legal!

Taping the meeting is directly permitted by party rules. And, even if the party rules said 'NO,' Texas law provides the means by which it can be done legally.
The tape itself doesn't provide the evidence, but the law merely requires ONE non-recording party member to agree to the recording.
As long as they asked SOMEONE, they are just fine, regardless of what the party would say.
The party rules, however, state that these are public.

Many challenges have been filed (don't know how many yet ... today was the last day to file).
The County Chairman must be removed from his post for the remainder of the year.
The convention must be nullified because of his actions and the actions of the Credentials Committee.
And, the State GOP should rule in favor of the Rump convention.

The Credentials Committee Chairman clearly added (listen to audio) over 40 names to the delegate list the morning of the convention. He did so because as he said of the ~40 "All have voted in the republican primary on March 4 or early voting in 2008 and that qualifies them for seating at this convention." Never mind that in order to be an authorized delegate these persons must have been duly elected at the precinct level.

Yes, there was a rump. Challenges are filed. Hopefully folks will realize that this is a case in which county leadership added ineligible delegates to the precinct lists, knowingly violating not only party rules but also state election code. They also falsified the precinct records, claiming the ineligible delegates were elected at the precinct conventions.

I don't know why anyone would say such a thing. I have been persecuted for supporting him and I feel my persecutors are perhaps not patriotic or certainly not decent freedom loving U.S. citizens. If his name is not on the ballot and there is no write in space, I will probably abstain or maybe vote for Bob Barr, whom I understand Ron Paul is endorsing.

The person reading the credentials report-the credentials chairman- was not eligable to be a delegate at the convention. The county chairman was not eligable to be a delegate at the convention. Our SREC member, Bob Jones, was not eligable to be a delegate. Candidates for Texas Rep., Todd Hunter, Connie Scott, Raul Torres were not eligable to be delegates. And they all stood by and DID NOTHING while the convention was railroaded. Would you vote for them?

The thing about an "emergency meeting' to choose rules for the convention, is that there are no rules until the people accept them by voting them in, and until that point, Robert's Rules are the rules. In Missouri, there were NO standing rules, so if that is what they told you Chester, it is a lie. They changed the agenda last minute too, to benefit them and do a TON of business before the temporary chair is even elected also not good. (Got to get a taste of this in District 7 in Missouri)

At a MISSOURI Republican District Convention for the St. Charles County area (St. Louis) Satuday, the chairman was so unfair that someone finally motioned to adjourn so they could continue the meeting elsewhere. THE MOTION PASSED OVERWHELMINGLY, and people went out and continued the meeting a short distance away. The remaining minority IGNORED THE VOTE, and continued their own meeting. We have TWO results. We'll see which the Party accepts and just how many voters they're willing to lose.

You do not have to have been at the precinct convention, NOR have been a county/senatorial delegate to be a delegate to the State Convention. The only requirement to be eligible to be a delegate to the State Convention is the same as being a delegate to the County convention. You only have needed to have voted in the primary.
However, this misunderstanding could have been easily placated if the Chairman would have followed the rules and recognized the the point of information/order.

He basically told me he was extra special and didn't have to have been present, I asked him what rule it was but he couldn't tell me "off the top of his head" Maybe you can because I am still wondering about that. This is the exact same thing that happened at the St. Charles County (Congressional District 2) Caucus in Missouri Yesterday. I have never experienced more anger in my life. It's a shame that I expected it too.

As a Republican Delegate to our State Convetion,That was the biggest wrongest thing the Chair could ever do!!
All politics aside the rules come first, and when they don't, IE the rules do not apply,
then WE do not need to follow them either!

Was there a vote at the beginning allowing the suspension of the rules? Otherwise, this is a complete sham and the citizens of Neuces should be ashamed of their local GOP.

While the chair was obviously out of order, you guys needed to stick around for the whole thing. Also, I didn't hear anyone calling for division. Walking out is probably exactly what they wanted.

Their convention is void as they did not hold the quorum. The people adjourned the meeting and held a rump convention in the parking lot. Now to convention results will be submitted to the state GOP. They will have to decide which convention is valid.
