The UCC does exist, but the courts are actually trained to "play dumb" and act like they don't know what you're talking about and they want to try the 'facts" of the case. I recently brought up nearly ALL of this and more in a BS "red light traffic cam" case and no matter what I said, the judge and DA looked at each other like I was speaking an alien language, though I could tell they were also shocked that a "slave" knew so much about the UCC and the law. The judge wasn't denying the persuasive authority of common law or the UCC. The lawyer likely posited an argument that was a drastic departure from current understandings of common law and the Uniform Commercial Code relating to facts of the particular case.
The lower courts judges are subject to some form of appellate review by the higher courts in their decision-making. Judges are expected to reach their decisions in accordance with precedent. Both are bound by previous decisions of the higher courts, and required to justify any departure from precedents of their own court. Judges are also bound to follow legislation as only the Supreme court can deem legislation unconstitutional.
This video is utter crap. The US is a common law country. Therefore judges create and apply precedent when hearing cases. Precedent are the decisions made by judges based on the facts of the case. If another case comes before a judge that has the same, or very similar, facts then that court is bound by precedent to follow the previous decision. The hierarchical structure of courts means that higher courts decide on points of law that lower courts must follow.

@Frowardkiller Common law is judge made law, also known more commonly as case law because you tend to find it in the court opinions of cases. One of the best places to get an overview of the different types of common law is from the Restatement. The Restatement is a document compiled by lawyers and judges that lays out a recommended common law, kind of like a model code for common law. Most states follow it fairly closely. If two common laws conflicted, a Judge would decide which becomes the law
@Frowardkiller Judges are required to follow prior rulings by other judges under a doctrine known as Stare Decisis, which you can look up on wikipedia for more information. If there is a common law and the Judge refuses to follow it, you can actually have the case overturned on appeal by claiming the judge made an error by applying the incorrect law.

@Frowardkiller Generally a Judge will not overlook a law because the lawyers are going to bring all the relevant law to their attention. At least, they should if they want to win the case. If a situation ever arose where a Judge was unaware of a law and applied the wrong one, and for some reason no one appealed the decision, it is likely the later courts would overlook the slight transgression from the typical law. This kind of situation would be a rarity though.
@inspirediam It's not really a corporation. This video misunderstands the nature of common law. You don't have to ask the court to apply it, they will automatically apply it if the state has not passed a statute in its place. The person making the video misunderstood what the judge was saying. He didn't call common law frivolous, he was speaking about the lawyer's argument.

I think the common law marriage thing ought to be change. No two people should be married by law just because they live with each other for awhile. That is just silly. People should not be legally regarded as married without their own consent.

I have the UCC 2008 Edition (bigger than the Bible). There is no 1-103:6, it ends on 1-103:3b and as for 1-207, there is nothing between 1-206 and 1-301. Maybe there used to be in an older version, or in a newer one, but definitely not in 2008...like when this video was posted......so.....what now?

If you were to read that text, you would find that it is part of a list of definitions, designed only to interpret title 27 of that code. common law is in constant evolution. Contemporary judges make new judgments that take over the old ones. You can't quote old common law from the middle ages if it's outdated. It's not applicable anymore.

The purpose of UCC is strictly for sales contracts concerning goods, Whereas common law for contract sales covers contracts for services such asbuilding a house verse buying widgets under UCC law.
If you only have Real Estate then you are only a tenant, and this is likely under your 'person' name which you don't even have a Claim of Right on.
To own land outright, put a Claim of Right on your 'person' name including a copy-right and copy-claim, state your Notice of Understanding and Intent, and then claim outright title to the land with a Claim of Right in the Common Law. In this way you may gain Allodial title. This is just an overview......

SB967 was passed by a vote of 44 to 4 and would set up a trust intended to take over a hydroelectric dam operated by Alcoa, Inc. Here's the rub: Alcoa built the dam and has maintained it for decades and they do not want to sell it. What private property will government take next?

All those maritime judges take their oath on the constitution. If you operate as a sovereign in commerce and present the judges' oath and other paperwork before the court date, he/she can't charge you with contempt. Of course there are other adminstrative procedures one must do also. I've seen courts cleared out for sovereigns.

I am one of the people and I live under the Common Law. I have my UCC-1 filed on my transmitting utility and it states anyone who wants to screw with the tu must do so in a Court of Record. They can take their phony maritime commercial courts and their british boys club and stuff it.

Deep! The UCC does exist, but the courts are actually trained to "play dumb" and act like they don't know what you're talking about and they want to try the 'facts" of the case. I recently brought up nearly ALL of this and more in a BS "red light traffic cam" case and no matter what I said, the judge and DA looked at each other like I was speaking an alien language, though I could tell they were also shocked that a "slave" knew so much about the UCC and the law. The judge wasn't denying the persuasive authority of common law or the UCC. The lawyer likely posited an argument that was a drastic departure from current understandings of common law and the Uniform Commercial Code relating to facts of the particular case.

The lower courts judges are subject to some form of appellate review by the higher courts in their decision-making. Judges are expected to reach their decisions in accordance with precedent. Both are bound by previous decisions of the higher courts, and required to justify any departure from precedents of their own court. Judges are also bound to follow legislation as only the Supreme court can deem legislation unconstitutional.

This video is utter crap. The US is a common law country. Therefore judges create and apply precedent when hearing cases. Precedent are the decisions made by judges based on the facts of the case. If another case comes before a judge that has the same, or very similar, facts then that court is bound by precedent to follow the previous decision. The hierarchical structure of courts means that higher courts decide on points of law that lower courts must follow.

One of the best places to get an overview of the different types of common law is from the Restatement. The Restatement is a document compiled by lawyers and judges that lays out a recommended common law, kind of like a model code for common law. Most states follow it fairly closely. If two common laws conflicted, a Judge would decide which becomes the law

@Frowardkiller Judges are required to follow prior rulings by other judges under a doctrine known as Stare Decisis, which you can look up on wikipedia for more information. If there is a common law and the Judge refuses to follow it, you can actually have the case overturned on appeal by claiming the judge made an error by applying the incorrect law.

@Frowardkiller Generally a Judge will not overlook a law because the lawyers are going to bring all the relevant law to their attention. At least, they should if they want to win the case. If a situation ever arose where a Judge was unaware of a law and applied the wrong one, and for some reason no one appealed the decision, it is likely the later courts would overlook the slight transgression from the typical law. This kind of situation would be a rarity though.

You don't have to ask the court to apply it, they will automatically apply it if the state has not passed a statute in its place. The person making the video misunderstood what the judge was saying. He didn't call common law frivolous, he was speaking about the lawyer's argument.

I have the UCC 2008 Edition (bigger than the Bible). There is no 1-103:6, it ends on 1-103:3b and as for 1-207, there is nothing between 1-206 and 1-301. Maybe there used to be in an older version, or in a newer one, but definitely not in 2008...like when this video was posted......so.....what now?

All u have 2 do is provide your STATUS (Nationality) for the record becuz STATUS determines jurisdiction under natural and common law. If you were to read that text, you would find that it is part of a list of definitions, designed only to interpret title 27 of that code. If you only have Real Estate then you are only a tenant, and this is likely under your 'person' name which you don't even have a Claim of Right on.
To own land outright, put a Claim of Right on your 'person' name including a copy-right and copy-claim, state your Notice of Understanding and Intent, and then claim outright title to the land with a Claim of Right in the Common Law. In this way you may gain Allodial title. This is just an overview......

The North Carolina Senate has voted to take a business's private property. SB967 was passed by a vote of 44 to 4 and would set up a trust intended to take over a hydroelectric dam operated by Alcoa, Inc. Here's the rub: Alcoa built the dam and has maintained it for decades and they do not want to sell it. What private property will government take next?

N.C. Legislators has introduced house bill HR 878 On March 15, 2007. Still hasnt passed to my knowlege.a bipartisan bill to protect our private property from unjust seizure by governments, was introduced in the N.C. House. This bill would give North Carolinians the opportunity to vote on an amendment to the state constitution that would prohibit governmental entities from using eminent domain to seize private property for economic development purposes.

This all sounds good in theory; but in the real world; it doesnt work, try not paying your income tax, or your property tax; and then drive around with out a license and registristration plates, when you get into the court and tell them you are a moor and the common laws says you dont have to do these things; they will throw you under the jail.

the common law does not exist, the law of admarality through martime procedures is what governs the world. the soveriengty powers created nation staes which they control; to serivce their soverienty. when you are bought into court you are bought into a court of admarality; thhan the switch it to an equity court with out you knowing, you cant claim you have no contract with them; because they have a international contract with your nation, and your nation owns you thefore they hav jurisdiction.

You enslaved yourself my friend. Nobody forced you to file a birth certificate on your kids, nobody forced you to get a drivers licence, nobody forced you to get a marriage licence. Nobody forced you to get a social security card. You filled out applications to get those and when you "apply" for something you are begging for it (see blacks law dictionary). All those maritime judges take their oath on the constitution. If you operate as a sovereign in commerce and present the judges' oath and other paperwork before the court date, he/she can't charge you with contempt. Of course there are other adminstrative procedures one must do also. I've seen courts cleared out for sovereigns.

Yes, and if you are going to operate as a sovereign in their commercial courts, make sure you are bonded and first establish your status before entering the court. - Maintain separation between yourself (the real man/woman) and the legal-fiction known as the 'person' that you are acting as an agent for.
Also, even though the Administrator (Judge) may have an Oath, make sure to get him to invoke it in the court to put it into operation. Otherwise he can continue operating outside his oath.

It clearly states that if you don't reserve your rights, your fucked.
