    Having said that, the 'harm' that the government has decided upon are the intoxicating effects- which do not wear off as clearly or as quickly as alcohol, the psychoactive effects and the long range deleterious brain deficits. This is their basis to 'harm to the community'. To state their is no legal harm is incorrect- whether there is actual harm is up for debate.

    Mr. Stevens' of logic is what gets the uninformed and stupid locked up.

  • Some counties don't even require you to sign their tickets. In fact, after receiving a seat belt violation, there was NO WHERE on the ticket to even sign. The cop handed me the ticket, and told me I was free to go. I felt like asking him at the time where's the consideration for the contract..

There are serious and less serious crimes. However common law recognizes only two classes of crimes- serious crimes or felonies and minor crimes or misdemeanors.

I would argue that society in general is victimized by a speeding driver who could at any moment crash his car and ruin a person's life. Regardless, LexisNexis Legal Dictionary: "Crime: a wrong punishable by the state usually involving an actus reus and mens rea." At no point need there be an injury or victim. As a law student I can say these people are wrong and have misled you all.

  • @michaeltbear So what about if I get Summons to appear in "Criminal Court" for an "Open Container"? I've eaten up dozen's of those cases with this guy's information. Hell, I got another Open Container case in January which I only ask 2 questions:

    1) Is the cop who made the complaint claiming personal injury or harm from me drinking a 24 oz of budweiser?

    2) Are the "PEOPLE OF THE STATE OF NEW YORK" claiming personal injury or harm from me drinking a 24 oz of budweiser?

All I'm saying is what this guy saying is right I've used it and haven't paid a fine for speeding in a car or drinking in public aka Open Container in about 8 years.

    DUI's you're right there need not to be a victim or injury. Everything else no injury "Criminal" or damages "civil" NO crime.

  • The courts can only hear cases and controversies. A valid cause of action is mandatory for a court to hear a case. There's two elements to a valid cause of action. 1) the violation of a legal right (life, liberty, property, etc) and 2) injury.

    Also, every time the State is the plaintiff there can be no fair trial because the judge is paid by the plaintiff/State. There's a conflict of interest. Imagine a contested divorce wherein your mother in law was the judge -- a conflict of interest.

  • Nobody is ever tried in court for a "crime," they are tried for "felonies" and "misdemeanors." Some call those "crimes" but the court system does not officially define them that way. That is why this blowhard is wrong, why he never wins any cases, and why this video is just the propagation of a scam.

  • So, the only way, under trust law, for them to be able to charge the trust is to get the authorization from the beneficiary us, and the only way for them to benefit from their charge is to get us to switch roles from beneficiary to trustee and for them to switch their role from trustee to beneficiary because no party can be both, at the same time. They must somehow trick us into accepting the role of trustee. Why would we do so when the trust is for our benefit?

  • If you don't like the law, vote to change it and lobby your legislature. It is a crime because it is what the people have voted it to be.  This "corpus delecti" stuff is fun for academia but is pretty much worthless in real life. Attorneys wouldn't argue this b/c they would be laughed out of court.

  • Is said property registered with the state proporty offical, and if so does that alone give them the right (under their system) to have control of your property and the usage there of? So what of other charges or other violations they will come up with. Let's not forget ordinances, and some of the other 2.5 million laws and regs. Not avocating the gov but we really need an order for sovereignty of representation. An organization for a new society perhaps.

  • He makes a huge mistake. First off, I think he's right, but only because I know that marijuana is harmless. But let's just pretend the DEA is right and weed is harmful. Then there is indeed no victim. Yet. But as soon as that pot is harvested and smoked, there will be one. Something is a crime if there is a victim, or if there WILL be one. Otherwise, you could use his arguments for growing coke too, or even building a nuclear warhead.

How he wins is simple really , a court of inferior jurisdiction, ie not a supreme court, has to have four elements to give it jurisdiction. A plaintiff or complaintant, a defendant, subject matter jurisdiction and a competent fact witness. In almost all instances, it lacks one or more of these elements

  • @gorgeousdzastr I can't say whether or not he is educated, but I know for certain he is not educated in the law based on the fact that he misunderstands what the Corpus Delicti is. He also says it's nonsense that a legal right could belong to an entire community, but it's actually very sensible. A park, for example, is public property. That means it belongs to the community. If someone damages the park, they have violated the rights of the community that holds it, as opposed to one individual.

  • @EntouchNetwork Actually it's just the opposite. When every individual gets to define their own rights, then you have too many interpretations to be upheld. When the community agrees on rights held by that community, then it becomes manageable. Also, the sovereignty of communities has been well established in history, whether it be nations, states, or cities. Communities have a long history of claiming sovereignty. Just look at the U.S.A. when the Colonies declared independence from England.

I went on his message board and pointed out that the only cases people ever post are cases where he lost, and no one had yet posted a single case where he won. I asked him to provide at least one example of him winning and he deleted my posts from the board instead. Marc is just a shyster who feeds people this fantasy that he can win any case so he can get your money.

The test of corpus delicti is used to determine if the crime being accused has actually been committed. In otherwords, corpus delicti would not be used to determine if growing marijuana is a crime, it would be used to determine if someone has been growing marijuana. The determination of whether growing marijuana can be a crime is done under a due process test, not corpus delicti.

  • Just to let the youtube world know. I went to my court hearing demanded My inalienable rights, common law jurisdiction, and voided a divorce deree all in one notice. The hearing was then backed out of the court docket. Three weeks later a get an "Order" in the mail saying the case is dissmissed. Funny thing is they State refered to me as an attorney of which I never said I was nor claimed to be. what goof balls.

If people failed to convict bar owners and liquor suppliers, it was, in most cases, because they valued their lives and knew that guys like Al Capone would be pissed. Prohibition was repealed because it was a failure. People like to drink. People were sick of the corruption and violence that it created. .

  • I'm not a lawyer, so won't argue his views of crime vs tort. I will argue his opinion that the jury system is flawed because people are forced to serve. A criminal has a right to be judged by his peers. People often do things only if a) the consequence is good or b) the consequence of NOT doing it is bad. No government has the $ to pay people their salaries while they are on jury duty. So the alternative is a threat.

  • A crime is a misdemanor or a felony. Can you explain civil infraction? What is the rule to that? I heard cause of action but I believe that is more of a tort in civil cases where the state isn't the plaintiff.

  • @bigyelowism a tort is a civil wrong , having an accident, unintentionally harming someone, and yes there can be a criminal charge with torts. What Marc is trying to explain is that the state is a fiction and can no more be harmed than Willy Coyote in a cartoon. When the state tries, to call something a crime, it is infact the breaking of a statue or code, there is no real injured party The state simple wants to steal and control someone else, and they do cause harm to real people.

  • @unclefixer There doesn't have to be an injured party for conduct to amount to a crime. Tort requires loss/harm, and I think that's where he gets his wires crossed. Saying that a crime is a wrong against the state is just another way of saying that a crime is conduct that the legislature (who are elected representatives of the people) think is injurious to society in general. We can't just go making up our own definitions of 'crime'. Fiction or not, the state's in a better position to define it

  • @unclefixer Don't jump to those conclusions too quickly. A fiction can still be harmed. The most common example is a corporation. While not a living being or a concrete object, a corporation is still an entity that may be harmed in the form of monetary loss. If you rob a bank, you would not be stealing from any person individually, but you would still be stealing from a corporation, which represents many individual's interests. A state is essentially the same, representing an entire community.

  • @thegreatfish I think the rebuttal to this notion would be the fact that the corporation is a legal fiction in itself. In a stateless society the corporation would not exist. Responsibility would fall on the owner. This means any harm to come to the bank would be harm to the owner or his property not the collective group or corporation. At least this is my understanding of it currently. ;)

  • @neue01 I'm not so sure this would be true. A corporation is really nothing more than a group of people who have decided to invest in a common business. While it's true that a corporation probably wouldn't be afforded the same legal breaks in a stateless society, I can't see why a group of people couldn't pool their money and start their own business. I think identifying the fiction as a party, like a state or corporation, is just easier than trying to individually identify each member.

  • Of course not. and no one is "controlling me" cuz i don't break the law. If you don't like the laws we live by then you are free to leave America (i.e the greatest nation on earth). but as long as you do you must obey the rules that have been established. No society can function with no law, what you get without gov and laws/rules is chaos/anarchy..now if thats what you want then ok, but I will fight against you everytime.

The cops by law are not there to protect you they are simply law enforcement. If you want protection hire someone who depends on you staying alive, private security.

  • @Ctupper1990 well it's what we go by, we have to have law. don't like it move. Spitting on the sidewalk is a public health code violation (class 4 misdemeanor in my state) a bit silly but it's still part of the law.

  • It's not your property, so they can do whatever they want. You're just renting the property, you're just a tenant on the land, look at your colorable deed. They do and will make any law they want and if you break it you can go to jail because you have a contract agreeing to all this and don't even know it.

If the court does the same, I add them as defendants as well. Just cuz no one is doing it, doesnt mean it cant be done. Besides, its more money for you since nobody is doing it. One man can change a states laws if he chooses to.It just takes time. Something that most dont have.

  • I don't see why the idea of a community of people having rights is nonsense, as Marc states at the beginning of his video. If a community of people want to reserve specific rights for themselves, like the right to freedom of speech, or even the right to live, then I believe they should be able to, and I also believe they should be allowed to instate a judicial system to make sure those rights are preserved for the people of the community. Why does Marc hate having rights so much?

  • @ThisIsTheRealSkinny The rights you refer to are individual rights, not community rights. Besides that, governments are instituted to insure protections of the rights of the individual. A group or community should not be afforded rights superior to those of the individual due to the risks of abuse that would guarantee.

  • @OverTaxed42Long A right that belongs to every member of the community would be a community right. A right that belongs to one person is an individual right. The right to step on my property is individual because only I have that right. Right to live is a community right, because everyone in the community has it. Generally, they are in balance with each other. Marc doesn't believe we should afford equal rights to all members of the community. He prefers a voluntary system.
