@mineralt - not in GA. All the builder has to do is pay off the inspectors and the builder knows he can just go bankrupt and change his business name and start new if he gets sued. Or, keep the homeowners in a suit long enough until they run out of money and have to settle.
It's not my neighbor's fault before they close on their house, it's the city inspectors fault. If inspectors have more than a few months experience in their field, they should be aware of drainage issues and make sure the drainage does not fall onto another person's property and cause damage!!!! This builder had 20 years experience and knew exactly what he was doing.
It looks to me like almost every issue you have with this house is it is constantly saturated, Everyday you live there you are putting your family at risk, the water will eventually take out that retaining wall. Arbitration or not you have to keep your family safe..
Just remember its not your neighbors fault.

I did not get pics showing the stream of water coming from the street and hill and going across our front yard to our side yard. You can see the stream of water on the side of the lot towards the beginning of the slideshow.
The builder stated that we changed the grade near on the hill when we added to the back retaining wall and its our maintenance issue, but we have pics showing differently.
For all you builders - this is how NOT to build retaining walls. Another great idea - do NOT build a house on fill, it will sink and move!!! It's just common sense (my builder lied - he said it was built into a hill). Also, add enough drainage pipes to keep the neighbor's water from coming onto the property you are selling.
I asked my next door neighbor in 2004 to extend their roof discharge pipe a few feet so the water won't discharge onto my property - still waiting for them to do it!!!
Wow, in Cali the builder is on the hook for any serious defects for ten years.

this is a perfect example of why a pre purchase home inspection is so important. Saving four hundred bucks or so cost you hundreds of thousands.

No house it perfect but the shoddy construction is terrible. Hope you make it to the end of the arbitration and come out on top.
