Workers comp is a "no fault" insurance program. It is the responsibility of any company to provide wage loss for any injury on the job no matter who was at fault. In cases like this where a third party was responsible for causing the injury the employee must get his compensation and the insurance company must sue the third party to reclaim costs.

What I'd like to see is criminals be held financially responsible for their crimes. If a criminal commits a crime, seize their assets to pay for the trial, to pay for their incarceration, and to pay for their victims (or to pay McDonalds back for the worker's comp they shell out). Not every criminal will have the money to pay for it, but it has to help somewhat. What's more, the crooked investors shouldn't be able to get out of jail in a few years and enjoy that money they scammed.

Legally, the facts are these: The employee was injured while on the job. Period. He was injured while coming to the aid of a customer. Period. What I'd like to see is criminals be held financially responsible for their crimes. If a criminal commits a crime, seize their assets to pay for the trial, to pay for their incarceration, and to pay for their victims (or to pay McDonalds back for the worker's comp they shell out). Not every criminal will have the money to pay for it, but it has to help somewhat. What's more, the crooked investors shouldn't be able to get out of jail in a few years and enjoy that money they scammed.

The right thing to do in this case would have been to call the police! Had the man pulled his gun in the store, that would have been different. What was the imminent threat? The woman's life was not in danger.

And people wonder why I don't advocate men "protecting" women they don't know & in some cases, many they do know. THIS is what will happen, especially when you have these women running around with THUGS & getting their asses beat in public. DO NOT LIFT A FINGER 2 HELP HER, unless it's 2 dial 911. In cases such as this one, if you're an employee tell the parties involved that you have called the police and they are enroute. Then, watch as the THUG and the assaulted THUGETTE run out of the place.

I have 4 children, 2 men and 2 women, my boys will protect women and I am proud of them. And if one of my girls are in trouble I would hope someone would come to there defense. What kind of human are you?

We as humans must stand up for ourselves and not count on our government employees This young man need to be commended for his actions and I wish there were more MEN like him, I would consider dating again. So because (you think) police can't enforce the law, it's somehow now McDonald's responsibilty? Bullshit. What you're arguing has nothing to do with workman's comp! This is not about violence against women being right or wrong, so stop trying to force the issue!
FYI, I never eat at McDonald's for other moral reasons, and have never, nor will ever hit a woman. Fact is, this is about whether or not McDonald's is responsible for what happened. You are wrong, period.

Police themselves say that they are not obligated to come to your aid. Their main function is to provide a deterring presence and investigate after the fact, ultimately it's up to us to protect ourselves.
This just shows how mcdonalds is a horrible corperation that should be boycotted, sure they don't "have" to tecnically but considering the negative PR his medical bills are less then pennies to an international corperation.

As sableghost said, this is really about the criminal who shot Nigel being held liable, not McDonald's. And correct me if I'm wrong, but Nigel could sue this guy for damages, no?
There are enough reasons to boycott McDonald's, we don't need to buy into this story.

He can, but there's no telling if he'll get the money. In the meanwhile, he's on the hook for $300,000 bill. Even if McDonalds is not legally responsible for this worker's comp bill, they could at least have organized a fundraiser or something to help out this brave kid. I've heard of other companies, smaller mom and pop stores, doing things like this for employees affected by a crime. Instead, McDonalds hid like cowards behind their lawyers. I intend to boycott McDonalds myself over this.

Five: Police dont STOP crimes they only enforce the law, citizens STOP crime by being on the seen when a crime is being commented. This citizen was protecting his employers interest, I would hire this kind of person sooner then one who would do nothing. He did the right thing for the company, and the victim. He was on the job when he was presented with the situation. YOU ARE WRONG

Mag, I'm sorry, I missed the part where he stopped a crime. Perhaps that is because it had already happened? Nigel acted within seconds of the first assault. There was nothing to substantiate any immediate threat to the woman or the anyone else from that point on. Had he pulled his gun prior to, that would have been very different.
Just because you are on the job when an incident occurs does not mean you are automatically entitled to WC.

Five: do you think then that there would have been second?? Gun fights are not in the job description of a teacher however I am sure you would want one to stop a gunman the best way they could if your child was in that school being shot up. Morally you can not win this
