On top of which all cache and temp files now a days are saved in pieces and coded to only be accessible to your computer so that people can't use it as evidence because of caches and temp folders not being common knowledge.

I don't think the law in this instance was meant to protect a man in a situation like this, but you need sufficient evidence of a crime in order for a conviction or the system starts to break down.
What if, while surfing a less than reputable site, someone spams illegal images as a bad joke to subject random people to them. This information would end up on your computer for faster web browsing. But if you can convict this man with no evidence of intentional viewing, why not you in this case?

Additionally the person seems to be out of view of the video. In these instances it can lead to a lack of responsibility felt by that person by the number of people in the area. If you are knowingly by yourself with someone in trouble, responsibility obviously falls on you to act. In a crowd, most people will assume someone else will.
i understand technicalities, however, if the person in question has a history of criminal charges related to the current charge, i think "technicality" should be loosely translated as technically meaning "alright, it's time for u to do some time and for u to be someone's bitch"
See society continues to change and evolve but it seems that it is changing for the worse. The government slowly encroaches on our rights claiming it's for "protection" and then our society accepts it. We seem to be losing common sense. technically, he did download it, when he went to the site the text, pics, vids were all downloaded to his cache/temporary files and are mostlikely still there unless he is very technologically smart and went into their and delete them. as far as i'm concerned he searched for and downloaded it for sure. he owned it becuase it was ON HIS computer, just as if it was ON HIS piece of paper... see my point anyone? also, dont you get in trouble for ATTEMPTING to possess drugs?

Our high school's last athletic director was downloading and watching child porn on his school computer. His secretary found out and then black mailed him by not doing her job. Showing up ridiculously late/not at all/ or leaving early. Eventually someone else found out and everyone got fired. I don't know what bothered me more though, the fact that the AD was watching that stuff or the fact that that secretary knew what was happening and said NOTHING!

My old Jr. high music teacher was just (just as in 2 days ago) arrested for possession of child porn. It kinda scared me knowing that this guy had taught me for 3 years. He was also band and choir teacher for the high school AND he was the football coach. Now I'm paranoid that ANYONE in my life could be a creep.

I don't think the law in this instance was meant to protect a man in a situation like this, but you need sufficient evidence of a crime in order for a conviction or the system starts to break down.
What if, while surfing a less than reputable site, someone spams illegal images as a bad joke to subject random people to them. This information would end up on your computer for faster web browsing. But if you can convict this man with no evidence of intentional viewing, why not you in this case?

It can be hard to react quickly to such a volatile situation, and putting the fire out on her head in a panic may have done more harm than good. Additionally the person seems to be out of view of the video. In these instances it can lead to a lack of responsibility felt by that person by the number of people in the area. If you are knowingly by yourself with someone in trouble, responsibility obviously falls on you to act. In a crowd, most people will assume someone else will.

See society continues to change and evolve but it seems that it is changing for the worse. The government slowly encroaches on our rights claiming it's for "protection" and then our society accepts it. We seem to be losing common sense. Sometimes the law will work in your favor like in this case with the pedophile but sometimes judges should use common sense. They all knew he was guilty, he had been looking at child porn, and he did indeed work with children yet nothing happened to him.

I actually did a search once for 'zodiac', looking for horoscopes and the like, and was directed to a pron site. It can happen. Depends on what his actual 'search' words were would affect my decision on guilty or not. Those pron sites are very aggressive. I had so many pop-ups I had to shut down the pc to make them stop. Hard reset. Bleh. Pinch of salt here. I would need more details of the events.
