Wonderful theory, and I must concede you are correct in that day to day encounters it is difficult to apply, here especially as UCC filings could wind you up in prison. It's sad that we have to use defacto courts to attempt to free ourselves from our parents unknowing transgressions of the "number"

  • I personally do not know but, I would think that they should have to take a rather difficult test to become a police officer. This test should include all possible laws that they would need to know in their line of work. This test should have to be taken at least yearly.

    Just so you know, your license plate number is PUBLIC INFORMATION which means anyone can look at it, write it down, record it, take a picture of it for any purse they feel like. That's why it's placed where it is on the car, so anyone can see it and copy it for any reason. There's nothing thuggish or Nazi about recording license plates passing through federal control points...

There are videos where people know their rights and it seems the cops are taking illegal steps, and the civilian just freaks out, at the top of their lungs, screaming their rights and getting in the officer's face. By the end of those videos, I'm somewhat hoping for them to get tasered. I like the fact that you were calm, in control and not aggressive, but still firm on your rights.

In the US the biggest government job growth sector is the military, police courts, jails, homeland security,CIA FBI NSA and their bloated pensions etc. In most state and local Governments the "Public Safety" sector is app. 70--85% of their government budget. Walking away while being investigated is impeding an investigation, which can get you detained and/or arrested. While detained they'll get a search warrant, thus not violating the 4th. Go into criminal justice and then feel free to make comments about how the law works. Tip: Being questioned by a cop = being investigated.

I don't have time, nore the will, to hold your hand through every detail of the law. Please go and learn about it in a book, online, or in a classroom.   • @WoWDart: You are mistaken. Suspicious behavior is NOT enough to begin an investigation. Officers need behavior suspicious of CRIMINAL INVOLVEMENT before detaining a person for investigation. It is not enough for mere suspicion of unusual behavior.

    Here, photographing government property or government agents is not at all criminal, even though it may be unusual.

    Calling people 'sheep' based on their observed behavior (writing) seems reasoanble to me.

The Officer was investigating whether the individual was involved in any criminal behavior. The man walked off, impeding the investigation, and was detained. That is all there is to it. A single observation of a person is not enough to justify a response such as "sheep," especially when the observer is less knowledgeable than the "sheep" on the subject matter at hand. Good day.

  • @WoWDart: If you have read up on some of my views, then you know that I am pro-law, and often cite the sources for my positions. That, obviously, is not YOUR approach.

    If an officer does not have at least reasonable and articulable suspicion of criminal involvement, the officer may NOT detain a person just because the officer is "investigating". Such detentions violate the 4th Amendment. Read the U.S.Supreme Court case Terry v. Ohio.

  • @DavidForthoffer A case does not make or limit the powers of any office or official. Laws do that. You need to cite laws not cases. Cases interoperate the laws that are in affect at the time of the arrest. The same interpretation by not be true with the laws we have today. Each state also has its own laws which could come into play here.

    You don't need to use post script. Italics would still make you seem childish.

    I have to disagree. Supreme court ruling set the precedent for laws and if a law is written/passed that opposes a Supreme court ruling and if especially if it opposes the constitution, the law is null and void. The law will typically be repealed if the right people make a fuss out of it and bring it to the right courts. Example: Brown vs. Texas overrules the Texas statute that allows police to stop and ID you without reasonable suspicion or probable cause.

  • @truthfrequency If a law is passed that is unconstitutional then yea it will get repealed or amended, but if a law is passed that opposes a pervious supreme court ruling, then nothing. Each ruling of the Supreme Court is separate from the rest.

  • @WoWDart: Laws that are passed that are unconstitutional are not necessarily repealed or amended. They are generally interpreted in the light of the constitution, though sometimees that takes years to happen.

    The U.S. Supreme Court says that its rulings ARE related to its previous rulings.

  • @truthfrequency for example: If a law gets passed in Texas that allows for search without a warrant, then a case must make it to the Supreme Court for them to deem it unconstitutional. If a similar law is passed in Ohio a year later, it too must have a case make it to the Supreme Court for a separate ruling.

  • @WoWDart: Note that lower federal or even state courts sometimes rule that certain state laws violate the U.S. Constitution. Read the Wikipedia article on the USA PATRIOT Act for examples.

That is suspicious behavior sir. There are more civil ways of conducting an interview to ascertain information. Try calling ahead and setting something up next time.

    This is the pecking order, according to the constitution. The state laws are on top however the Federal laws which PROTECT individual/constitutional rights supersede state laws. Supreme court rulings supersede everything so long as they are in compliance with the constitution. The Fed government has 3 roles: coin money, protect our borders and ensure state laws do not violate the constitution. That's it. But they're not doing any of the three,

They do coin money, there is an attempt at securing our boarders (both foreign and domestic), and the supreme court overrules state's rulings all the time. The fed has more than 3 responsibilities. Why did they drop the charges against you? Was it because they came to find that you posed no threat, and didn't want to bother with a silly case like this?

The 10th amendment states that powers not specifically delegated by the constitution are reserved for the state so I don't know where you are getting more than 3 responsibilities. The government is building empires and invading foreign countries, they are NOT protecting our borders because they've never been threatened. Case dismissed because there was no crime.

  • @DavidForthoffer I am very confident the officer had reasonable suspicion (which he could articulate) of possible criminal happenings. Again they do not need to articulate that to you. They only have to articulate when and why you are under arrest and your rights there forth. Terry vs. Ohio is old news my friend. There are plenty of new loop holes officers can legally use to avoid cases like Terry vs. Ohio.

    Even though Terry v. Ohio is "old news", it still defines THE standard for detention, and is cited as such by thousands of more recent appellate opinions. It is old news but still good news.

  • @DavidForthoffer Due to FEMA's involvement in this case I believe this would suffice: 41 CFR 102-74.385. I can see them applying either of these as well: 36 CFR 327.24 - Interference with Government employees or 36 CFR. 261.9, Property article (e), but I wouldn’t put much faith in them sticking. Loopholes are funny that way.

  • @WoWDart: Since the U.S. Constitution as interpreted by the U.S. Supreme Court in e.g. Terry v. Ohio overrules the Code of Federal regulations, a "loop hole" in Terry would be a more recent case by the U.S. Supreme Court changing some part of the standard.

    There IS NO such loop hole, unless you want to consider ongoing "clarifications" on what is "reasonable". But that's just nudging the line here or there, not sneaking through it.

    All officers OUGHT to know that it is not a crime to annoy police officers, or to disobey orders unrelated to the performance of their DUTY. This officer did not have the authority or duty to punish George for failing to produce his ID.

  • @truthfrequency try doing more research, all media falls under commercial speech, check Ohralik v. Ohio State Bar Association, 436 U.S. 447 (1978). Also, no mater what state you are in, when you are issued a state I.D., and you sign your name to the dotted line, you agree to surrender or produce it to any local, state, or federal entity, the fourth amendment does not protect you from that due to the tenth amendement.

  • Also, you can be detatined LEGALY by any law enforcement agency if you refuse to produce proof of identification when requested until I.D. can be proven. Also, once you are detained, by supreme court ruleing, the person being detained and the immedeate area is allowed to be searched, that is something else the $th amendment does not protect you from.

  • When you want to make these claims and use court ruleings to try and make you like like a know it all, make sure you investugate the ones that will hurt you as well as the ones that will help you.

Anything that opposes the constitution is null and voice. The supreme courts have ruled as such. However, this case was dismissed with simple motion so the Federal judge agreed with my position 100%.

    I'm not going to turn this into a debate on whether the earth is flat or not but I watched some of your videos with an open mind and I found no evidence to prove it and completely baseless claims. Furthermore, they fail to point to any other body in space that is flat. Everything is a sphere so why is the earth the exception? There is more evidence to support a hollow earth than a flat earth.

    I take it they aren't teaching you the constitution in school or anything about the Patriot Act or the NDAA.Besides, I don't recognize the idea that some piece of paper with ink gives them a right impede on my unalienable rights (as endowed by my creator). If I don't have a right to do it to them, they don't have a right to do it to me. Simple, end of story. There is nothing to rebel against because their authority is an illusion. The law says that this young man broke no law, and was never even under suspicion of doing so. When these things get let go, they are like cancer. They spread, and they get bigger. Right now they are already being taken away because police do not understand the law and act outside of their legal powers. There are examples all over the internet. I myself had a gun pulled on me at a simple traffic stop as soon as the officer exited the car. I did absolutely nothing to deserve having a gun pulled on me, and after I became upset at the event the cop didn't know why I was upset... Think or don't. IDC.

  • @thekidchris19 I disagree. There are people who go and harass these officers, get in their faces, scream at them, and that can impede their job. This guy is just asking polite questions and answering no to questions. They are questions because the officers know damn well that they can't FORCE you to do any of the things they asked, otherwise they wouldn't even ask the question. They are just sooo used to people handing their rights away and saying "Yes Sir!"

  • @truthfrequency All I want to say is GOOD JOB! Police need to be held accountable for their actions. I can not believe there are states out there which made it illegal to video and audio record police officers, that is UNACCEPTABLE. I wish someone would take these states to court and get these laws stricken, they are unconstitutional.
