  • California does NOT have a stand and identify statue. There is NO LAW in California that requires you to produce an identification card or even verbally ID yourself. There are some exceptions however.

    When a police officer says "I need to know who you are" he is lying.

    Repeat these words "I do no consent to any searches of my person or property and I will not answer any questions without my lawyer present"

  • long beach pd like any other pd can be jerks they love to profile people and here in long beach they gave my friend a ticket for speeding on a bicycle lb is not a good place to ride bikes bike riders get more tickets then drivers on the road

  • @skyfire368 That's what you think. Try passing through Arizona and Cali. You'll have to pass numerous border patrol checkpoints (even though you're on a highway and not at the border). And they often times ask for you ID. Now they have dogs and will lie and say the dog alerted to your vehicle, so they can search it. America is not what it used to be.

  • They came to my house one night looking for my brothers homie and they handcuffed my brother (it wasnt a black and white it was the gang unit) an after they had my brother handcuffed they started jabbing my brother in the chest hard as fuck with their flashlights

  • I am curious, with all the information available here (now), how often this still occurs. A lot of people are now aware that you do not have to show ID, but should provide your name, unless you are: ..operating a vehicle, or ... part of an (I believe, criminal) investigation.

  • People wanna fuck around with the cops...they don't have time for your bullshit so if you want them to fuck with you back...then go ahead. Best thing to do is be respectful, cooperative and if you have issues, the court room is the proper forum.

  • @csbob2010 So just do as they say, when they say right? I believe you can still be respectful and cooperative with lawful requests. But you are not obliged to answer any questions, but still cops like the throw out the "so, you're refusing", which sounds of criminal implications. They use that threatening tactic as a scare tactic. Knowing the law and exercising your rights does not equate disrespect or non-cooperative. Cops aren't your buddy, so there's no reason to kiss ass.

  • I, (the driver) am not/was not at the time/have never been on probation or parole.

    The passenger, Victor, had his brother's ID because he had just picked up brother's wallet from the coroner.

    I was not written a citation during this stop. However, Officer Marshall arrested Victor because "Now you pissed me off, so he's going to jail!"

    Victor was released within an hour of arriving at the jail, as the officer had no reason to hold him.

    It made Officer Marshall feel manly to flex

He looks really familiar to the one that came to my house with his partner and started harrassing my brother because they were looking for my brothers friend and they started hitting my brother in the chest and stomach with the butt of their flashlights...fuckin dicks, I understand that they deal with a bunch of bullshit but they do a lot of unnessecary shit too...

    You only have to show I.D. if the officer has "reasonable suspicion" that a crime has been committed or is about to be committed.

  • @NoNotepad You NEVER have to show I.D. - EVER - unless you're engaging in an activity which requires a license. Then you only have to show your license for that activity (which may be a form of I.D.) That applies everywhere in the U.S. Your only legal obligation is to verbally identify yourself to a Police Officer. There is no law, anywhere in the U.S., that says you must own, carry, or provide upon request, any document of identification.

  • @godblamesme Hi, I did not mean to imply I was taking sides in this, and I am aware cops often lie, just wanted to get the legal point out that how much a cop can do legally depends on how much basis he has to believe a person is doing something criminal.

People such as you show that they do not care much for their Constitutional rights.   • He doesn't have to know who is in the car: You do not have to identify yourself to a police officer. They can hold you for up to 48 hours for identification however.

  • It's too bad the driver and passenger had this experience.  All of my dealings with the Long Beach Police Dept. have been positive.

  • @DartmouthAlum96 There are some VERY righteous LBPD officers out there! Examples would be Chris Rose and D Dominguez (both of whom have received heartfelt letters of commendation from the "driver")

  • If the officer can articulate that he percieved the operator and or passengers actions as suspicious he has every right to the common law right to inquiry and ask to see ID.   • the law also states that you have to have some form of ID on you at all time in california. Also, if a peace officer asks you who you are you are required to produce ID.

  • Where is it said (or published as law) that a passenger of the car has to show their driver's license? They weren't driving. I would think as long as they identify themselves, there is no reason to show a driver's license.

  • Uhh, yes. There is no requirement to show a driver's license if you are stopped while walking on the side of the road. Why would there be if you are the passenger in a car. You are required to give your name and address. That is it.

  • OK one last time....you either have a state issued ID card or a driver's license which is an alternate form of state issued identification. If you are stopped walking down the street you will also be asked for an ID (DL or state ID). In California it is illegal not to have one or the other after the age of 15. You have to show ID whether you get arrested or just get a jaywalking ticket... In conclusion it is Illegal to be without proper identification in the state of California
