Hey if you have a little headache Robert, head up to 7 eleven and get yourself a case ok, of your favorite beverage and sing your song, allnight long ! I want you to sing about your headache please, 99
It's not just music. I have another site with over 300 old, public domain movies. All of the films have been available since the days of videotape without any claims of copyright and anyway all you have to do is check the U.S. Copyrights Office online. Yet I've received dozens of claims by "companies" like Orchard Music, GoDigital, MVD, eOne, AdRev. I'm beginning to suspect some of this may be an inside job, i.e., Youtube employees making money from the efforts of others on the ad revenue.
On my video I just uploaded --- August 14, 1888 Arthur Sullivan's "The Lost Chord" [Restored] --- is now a claim by these bullies. This recording is obviously over 100 years old and in public domain by all international law. There is now a link to Thomas Edison LOL the maker of the recording device, if you can believe this.
Sorry to hear about your situation. This sounds like yet another sad saga on YT's part of not attempting to resolve a situation. I agree with your frustration as your work is very important to you on here. My channel is basically just a non-profit tribute channel, whereas your work is serious. There's a long list of wrong aspects on YT as a whole, notably the highly dubious MPRCS which issues very doubtful claims on other people's self-made videos. I hope you can get your situation resolved.
In my experience these sorts of sites have no real interests in upholding the rights of individuals. It's big lawsuits they're scared of. Has Kevin contacted them about the issue? Presumably I.B.Shite is in contravention of his terms of use.
@RobertJFreemantle Well, with any luck when lawyers letters start to fly things will begin to happen for him, at least, but it's insane that a single entity (person or business) can file numerous identical claims on your videos, especially when they then fail for whatever reason.
It's the wonderful world of dealing with faceless corporations who share responsibility amongst so many people that ultimately nobody takes any responsibility for anything until they are forced to.
Sound like to me a lawsuit is in the works. I am having the same problem with my MW3 video. IW & Trearch has no issue with people putting videos on YouTube. Hell you have movie slots with in the game that you can link to your YouTube account. I wonder why it is always somebody that doesn't have a damn thing to do with the games. I have 14 Call of Duty videos marked. IGN being one of the markers. Here is a tip Keep a copy of your raw video on a dvd or a hard drive as proof it si your work.
@Gimmeaflakeman Hey thanks. Video came out Nov 1st. It is now 23rd and no change, no response from company and no action from YouTube. I will be following up on this. This will not be allowed to drop.
As others have mentioned companies like Viacom has made YT nervous about having copyrighted material on here. Further more it depends on what law governs this issue. If it's the Digital Millennium Copyright Act YT has no say in this matter since the DMCA is a federal law. The DMCA is an ill designed law meant to fight piracy and copyright infringement. However it cares more about companies than free speech and fair use, hence it has become a tool for censorship and the scam you're experiencing.
@yingvyang Sorry to hear that. The status after all this time is still "waiting". Nothing has changed since I made this video. I will be following up in a new video about this. I might also feature anyone else similarly affected by this problem.
I wish I had some positive advice for you, but I had the exact same issue with Toei on an Asian movie review where I used trailer footage which is meant to be free to use. No personnel at YouTube respond and you're right; they take the side of the bigger party.
It's not just this company but a number of others as well. They allow these companies to make content filters for things they hold no copyright on. Especially video game videos. They make a copyright claim, the person they're hitting assumes they've done something wrong, so now they're allowed to monetize other people's videos and make money off of it.
Youtube in america are constantly under lawsuits from various companies such as viacom to be pulled off the internet. Youtube, I believe, doesn't want to get involved in their best interest. Which can be frustrating. I think it's just that the copyright laws of united states are not helping the youtube community and companies suing youtube and google are making it even harder. The only thing you could do is take full action yourself and skip youtube. They are under too much scrutiny themselves.
Same bullshit happens to me. I use Kevin MacLeod's music on my videos and about a quarter of them have been flagged. it seems there are companies out there who troll through youtube and automatically flag any vid using music.
I'm with ya. I'm in a similar dispute with YouTube on one of my videos. I may be taking legal action against YouTube and eMusic very soon unless this is resolved.
I've been following these disputes on Incompetech's blog for a while now. Its all so maddening! There's got to be someway to get YouTube to notice this huge injustice. Perhaps we should all forward this video to YouTube stars (like Philip DeFranco) and ask them to spread the awareness!
I am having the same problem with a different song and a different company claiming the rights to the song I use. I also have been really careful to fully credit Kevin and do all the right things. I am so frustrated and angry that this is happening. We need to band together to get noticed. Thank you so much for posting this video.
I just watched it on Kevins site and I agree 100% you should not be getting these copyright issues.Im lucky its not happening to my videos because many of my videos have Kevins music.Im glad someone is trying to stop fake ownership of something.I looked at the amazon link and listened to the intro and thats one of Kevins songs.I think one of your problems are on being where you live.I assume that you live in the UK and that person is only copyrighting people who use it in the UK.
Copyrights are a real pain the deal with as is youtube. You may want to contact itunes to inform them that the copyrights are under dispute. I beleave the problem may be there is no one person or a group of people dealing with such an issue. Rather a group in this counrty and another in that counrty and another in another counrty. But as said copyrights are a real pain to deal with.
I just watched this video on Kevin's website. And I agree with you 100%. This rapper guy is a douche nozzle for saying Kevin's work is his own, and even more of a scumbag for claiming copyright on it. He is blatantly plagiarizing Kevin's work and needs to be dealt with.
@eternalninja0 I am unsure if the rapper's music gives credit to Kevin anywhere in its documentation because I haven't looked at it. If he isn't then that's for Kevin of course to kick ass on, but what I do know is that the company involved in claim of this video via YouTube's content owners programme is called INgrooves.
@RobertJFreemantle INgrooves certainly has NO right to claim copyright on YouTube. YouTube needs to look into this further to find out what's really going on. They are usually really strict with copyright matters so I wouldn't be surprised if they did something about this in the near future.
@eternalninja0 That's the thing, but this is an old matter which YT should have already seen weeks/months ago the first time it happened on the one video...Disturbing.
Wow just wow Robert, as someone who has followed and may I add thoroughly enjoyed your videos on this channel and DAK I'm really saddened to hear some ass has decided to steal someone elses "royalty free" music to actually try and make profit for himself while also screwing someone else over who has taken great lengths to play by the rules.
Personally I would counter attack by contacting both Amazon and Itunes informing them this guys album breaches copyright law and is in fact illegal.
When did you put your video up, the one with Clenched Teeth? I used the very same song from Kevin Macleod's site (incompetech) and I haven't had any problems over it. That doesn't make any sence! Here's the link to MY video called Popcorn in Highspeed, /watch?v=a6koFhr2EIQ . Please keep me informed on your situation, I'd like to hear how this ends! I'm behind you, brudda!
@billhaley1868 The thing is, many of my Dark Heresy vids use 'Clenched Teeth' and only a few of them have had this company grab them, so the fact that yours hasn't yet means little, thus far. It may still be. I had my latest and one of my oldest grabbed on the same day for example.
I am working on preemptively registering my music with the YouTube Content ID System. So - that might help. I'm also sending letters to the companies who do this.
Other people have contacted similar companies - most of which just manage a lot of artists, and they seem to be in disbelief that their artists are illegally poaching music and claiming it as their own - rather thinking that _I_ am poaching their music and releasing it for free illegally.
@kmacleodmusic Good idea. I have seen ALOT of my favourite YouTubers using your awesome music, and would hate to see all of them being flagged for false copyright infringements, let alone see people abusing your kindness for giving the music royalty-free. These idiots need to be dealt with, and the law might just make them realise the scale of what they have done. It's just not right.
You spend your time on educating us on your Dark heresy series, try to 'dress' it with some fancy introtext and music, taking good care of copyright and this is what you get? The companies only wanting to get money out of people (especially those covering for bad rappers) sicken me!
Best of luck with all your future work on this issie. I will watch your channel for updates.
Wow! He's selling Kevin's work as his own. Hey rapper dude (Who is not incredible at all) you stole that track and are now trying profit from another artist work. What a swine. I believe the community will support you and come to your aid in any fashion we can. What would you have me do?
@blackbarnz At the moment your comment here will suffice. I can ask no more of you at this stage. Hopefully this will make YouTube take notice. I've also sent this video to Kevin himself.
@RobertJFreemantle OK Well let me know if there's anything thing I can do in the future. I know fellow community member TheNerubin has also had copyright issues with YouTube. I believe it was background music from his headphones in his case though. The whole thing is absurd and ridiculous frankly. We are very small community here on YouTube in comparision to other gaming communities. Being as it is,between your situation and TheNerubin's one could suspect we're being targeted.
Subsequently, the video's are being blocked by an automated system. Which means no one is directly checking the videos. I'm sure the record company and YouTube would remove the claim if the problem was properly understood. However, they don't which is the big problem. I would recommend a petition or contacting some of the bigger You Tubers with more connections to YT in order to get across that this music is used by two different artists. Moreover, YT needs to amend their database.
What I took Winston's comment to mean though was that he might have known of some sort of petition for help to YouTube function that I might have missed somewhere, like one would to a GM in a persistent online world server, such as MMO games.
Send this video to Toby Turner. Toby might be a bit of a goofball but the man gets shit done and REALLY knows how to garner user support, especially concerning Youtube partners getting shafted.
Hey there rob, I wouldn’t blame YouTube for the problem as they are simply taking precautions not to get sued for thousands of pounds. But I do agree they should contact you more and try to implement some more "help lines" (not specificity telephone) for users. The software on YouTube simply detects music by listing to it and checks it against a database. It is all automated. Because Kevin's music is royalty free it does not appear on this database unlike spotlight's track which Is.
@WinstonBiggleswade The element I blame YouTube for is that by countering the claim with a dispute, it should now be looked at by a human, yet I am still in limbo, losing potential revenue while I wait. All YT's system seems to tell me is that we're waiting on hearing back from INgrooves in response. This financially goes against me and in favour of the company. I'd call that favouritism of the big fish over the smaller one, even though I know YT is trying to cover itself. Human response needed.
I just used one of Kevin Macleod's songs the other day in a video. I've been sure to only use Creative Commons / Royalty Free music in my videos because of some of the reasons you have mentioned with copyrights. It sucks you are having troubles. Not sure what you can do other than what you have already done though. Good luck with the issues you are having.
In all seriousness you could contact the guy that created the music in the first place. If the Rapper guy is claiming ownership it's probably because he was borrowing a baseline or something. Either way the rights to the exact piece of music go to whoever do it first... no matter what.
@MrParticulate I did contact the owner and I have the emails to prove it. His hands are tied as well because YouTube won't listen to him either. He's pulling his hair out over this because this keeps on happening with LOTS of his songs, from lord knows what other companies, and he wants to help stop it.
Mr Particulate, please click on link 3 in the description and preview track #1 and you will see that I.B. Kredible is not using a bassline, he's using a rip of the audio on its own...
@RobertJFreemantle I'm not clicking the link, I trust you. I think clicking something associated with someone that uses the name "I B Kredible" would give me herpes or something.
But you're in the right, they're not. This is harassment. If you were in the US I'd already give you the number of my lawyer. I've been sued over bullshit like this before. And it's just that, bullshit.
@MrParticulate Including Parts because he's spot on. Kevin (not sure where he is) needs to file a complaint in court for abuse, misuse of a work that is covered by Creative Commons - Royalty-Free designator, including also violation of 'Fair Use' Law. If he's ever a chance to stop this. YouTube are something like 5 people in a swimming pool in San Bruno, California. There's nothing human going on. They are culpable along with the crapper Kredible.

I believe there's 90-days to respond tho :(
