I think it is a violation of the Fifth Amendment, which protects you from being forced to incriminate yourself.

Also, "solving" the problem that it is "word against word" is a violation of the Fourth Amendment, the right to refuse search and seizure without probable cause. If proper probable cause is present, then there is no need for a "word against word" scenario.

This guy has no clue what a breathalyzer test looks like.....I've taken one several times....and they don't put your head in a device they ask you to blow into a something that looks like a pager with a straw sticking out of it....the other end has a tube that goes into the larger part of the unit....and it was all done in the back of the cop car....to me that sounds much easier then taking a blood sample......
