Like explained, have your DS turned off the whole time. First you need to start the copy process in Wii, when your Wii is looking for a DS, it's then when you need to turn on your DS like said on your Wii. It does not say to turn on your DS before starting copy, it says to turn on your DS after you have started the copy. This way your DS will pickup the Wii's signal which is the "Looking for a DS" signal so, do it this way that I explained and you will see that it will work =].
