  • Part 2 of 2.. So before you go on and on about people just not paying there bills. I wouldn't wish this apon you for anything in the world. But my bills weren't paid because I was busy learning how to walk again, having to catheterize myself 4 times a day, and giving myself injections of antibiotics 3 times a day because I developed an infection, probably from the nature of my job which causes me to take care of other people and exposes me to more bacteria. I'm not even at the tip of the iceberg

  • @mastershredder2009. art 1 of 2. Havn't you taken into account that some that stop paying there bills is somehow due to a nature that is beyond their control. I'm a registered nurse that has dedicated my life to helping other people. Almost one year ago I suffered from a spinal cord injury and had to take some time off of work. I did have insurance including disability insurance, but while I was off and recieving 50% of my normal wages I was racking up on medical thousands of dollars of bills

  • @mastershredder2009, Dave's not disputing that the money's owed or that collectors should collect. The problem is the rampant abuse & law-breaking in the industry. Our family went thru a terrible period of deep underemployment and we found the bill collectors to be appalling MORE OFTEN THAN NOT. In fact only 1 person talked to me reasonably. The rest would use all of the tactics, and more, that Dave describes here. We WANTED to pay. Were we stupid to borrow? Absolutely- but it didn't help then!

  • Hey, its really simple. Stop blaming your faults on everybody else but yourself and pay your bills. The only scumbags are the one's that keep collectors employed by not paying their bills in the first place. Seems to me an

When I had to collect on bad debt I would be honest, this company and it's owners will sue you, they will garnish your wages and it will take years for the judgement to fall off. Show up to court, but the judge will say.. Did u sign this? You'll say yes and then we garnish your wages... Honesty not bullying works!

  • I had one call me about a truck I hadn't had for 2 1/2 years. Had to do a shortsale because I lost my job and couldnt afford it. They wanted 5600 for a shortsale I owed 3071 for. They wanted 5600, I said I could give them 3250 cash money right now. It took them a few hours, but they accepted and Im glad its off my back and I have a job now.

I'm constantly being harrassed by agencies to collect debts I never answer my cell phone unless it's a number I recognize and ignore all their mailings.However, I don't get mad at them.If you don't pay your bills, then accept the harrassment & stop whining.

  • @yahoopl3 are you kidding me? are you aware that sometimes debt collectors call people who do not even owe a debt and harrass them because a family member who died was in debt? They try to trick people into paying debts they don't owe, or abuse them hoping they will cave. Also at times someone might not have the money but the collecter won't care and will try to get the person fired. It is illegal. Just because you do not agree with a law does not mean its OK for someone to break it.

  • I created a parody video skit in response. Many of the debt collectors believe the propaganda a company president states to them, as in the letter read, thus do feel in the right when making such calls. Now I will not disagree about the higher ups, but is it fair to blame the lower level employees?

Here's a real world example for ya ! I pay for my insurance every month, I pay my copay every time I go in to see the Doc., out of the blue, I get sent bills from greedy laboratory's and x-ray tech, docs, etc.. who want another couple hundred bucks more than what insurance pays them, that's greed my friend !

First off I am no longer in the industry and second as I said I have seen both sides of the story. I had managers who would get away with murder and others who never raised their voice once to someone on the phone. Nobody wants to get in debt but America as a whole is addicted to debt. If a person is in debt they should brush up on the FDCPA ASAP to learn their rights

  • (((---CONT She had just gotten the #, and on the other hand people thanked me for listening to their tale of hardship. The FDCPA is highly outdated it strictly states that verification of a person's info must be provided by the debtor. A collector cannot go talking about the account to anybody they get on the phone. Unfortunately due to ID theft many people will not provide verification because they think someone is trying to screw them over. And their fears are validated constantly.

  • At the end of the day if collections is even car repos, home foreclosures are just as evil. Mr. Ramseys use cases of rogue non-compliant collections that should land anyone in prison. In summary his speil is a load of crap from 09. Collection agencies were the wild west back in the day but have cleaned up or at least sued into oblivion. These days most agencies are super compliant. And all the rogue collectors left, because they just don't make as much money anymore.

  • I work for a extremely large agency and have collected on student loans, credit card debts, homes cars etc. You name it I have probably worked on it. The problem with Mr. Ramseys comments are this: most original creditors want nothing to do with the consumer any longer, once you have defaulted and haven't paid for so long.

  • They want their pitbull to handle it, that pitbull is a collection agency. People need to be realistic, yes bad things happen to good people. But good agency don't steal from your bank account, nor do they try to rip you off. Do we try to get you to pay as close to the balance as possible, YES, but you signed the contract and plenty of people pay all their interested and late fees also. Also in the end the lower your settlement the harder your 1099 will be on your taxes.

I have just started following his Total Money Makeover and I have already paid off two credit cards and am continuing to make progress everyday.   • I work for a debt collection agency for commercial debt but here is why the economy needs debt collection agencies....for all you people that think debt collection agencies are scum what are you going to do when your own job has unpaid accounts receivables and they can't collect then your own company has cash flow problems and then in turn can't pay YOU?? and then you can't pay your bills collection agencies are needed for the economy deal with it

  • If sued, Elect Arbitration- JAMS and AAA.

    It allows a Debtor to go on Offense, and charge creditor with $ Violations on FDCPA- FCRA, they break the law every time they collect a debt.

    Debtor Boards advocates this, if you dont know your rights, you have none.

    Get your case Out of Court, elect Arbitration, it costs Creditors $3000-10000 to pursue it, most wont.

    NAF- declared a Fraud and moratorium, Arb is now working!

    Creditors have No note, Affadavit is bogus & $ Securitized

  • If a debt collection agency buys your debt without your consent, then thank the debt company and tell them to piss off. Tell them to show you a contract YOU signed between you and debt agency. If no contract then there's no debt. Simple.

  • A Canadian debt collector called us threatening that they will deport us back to Chile (not we're from) just because my dad had an accent and started to curse at us, calling us leeches and good for nothing. I kept calm and told him not to dare talk to my parents like that, and he threaten to call the police because we did not payed some stupid bill. I recorded the call and have everything he said on tape, was it illegal from my part to record him? I want to take this to court as proof.

  • Call me crazy, but I believe that you should be obligated to pay back what you borrow. I racked up a bunch of debt in college and didn't settle but paid it back in full. I actually went hungry and set the thermostat lower than I would have liked in order to do so. I know some deadbeats that settled for less than what they owed but not me!

    But I'm the kind of guy who paid for my own college, even thought a family member offered to pay it. Sadly, I don't think there are many people like that.

  • I am a debt collector.I am not college educated and after a layoff fell into this industry about 3 years ago.Let me tell you that everything he is saying is true.I've worked for 4 different agencies and they are all the same.I also make more than most people i know with a masters degree.I will continue to use the "tactics" we use because I love the money.I have 3 kids(2 in a private school)own a nice home in the burbs,nice car,nice harley nice boat..u get the idea.he's right tho...we are liars

People without health insurance are forced into using their credit cards to pay for health related emergencies and dig themselves into a deep hole

  • SOMEONE HELP that knows...I AM ON SSI....if i almost max out alll my credit cards and only pay them for 3-6 months and then pay 10 bucks a month then stop after 6 months or so( dont pay anymore to them)...would that be seen as fraud? i know they cant take away my ssi check, i have no money in the bank... could i go to jail?

  • Dave has some good ideas and others that are inaccurate such as his thoughts and perception about all collection agencies. MOST of us operate ethically just like 95% of the people in the nation do the right thing. We all deal with 5% that are trouble. The fact is agencies return money that business would be ripped off or FORGOTTEN to be repaid by a consumer. I find it funny when calling a debtor about paying a bill they get amnesia. I'd like to see not get a paycheck cuz their boss 4got.

I can't tell you how disgusting it is when I know one of you is not paying until you are caught up to. and then once you are called out for it you want to file bankruptcy even

Bankruptcy is needed for several personal reasons, but to avoid paying ones obligations is appalling, but that is not unscrupulous? it is to me. any agency that breaks the law should be fined, but many of the claims or allegations are he said she said and unwarranted. I know I have been on the receiving end and Dave gives some pretty poor advice at times. I recall him telling someone to settle their debt for 20% and if not accepted plan on going to war.

  • @jimiange is that really sound advice? why not trying to honor your obligation in full? you took out the loan for the bike and it was repossesed and he wants this caller to settle for 20%? pardon me, but how about trying to negotiate based on circumstances instead of outright going to war? Terrible advice offered. most creditors agents will listen to you if you are respectful instead of being indignant which is what I think the aforementioned advice was.Fact is not are jerks, but some can be.

  • Yeah i've seen it happen before, a guy at my work got two-three calls a day at his job from a debt collector. It got to the point i just hung up everytime they called. I've also known quite a few people who get called constantly and end up getting their number changed or removing their phones and only using cellular because the way they call all day. This guy isn't lying.

  • I have been on the receiving end of numerous calls from collectors looking for deadbeat relatives. They commonly say they were given my number as a reference. Don't know if this is true or not, as you can go on websites like Zabasearch and find out who might be related to the person who owes money.

  • Something has to be done to stop the abuse. I volunteer to provided financial help to the elderly and low income people deal with financial issues. I cannot believe the number of people I have helped deal with debt collectors, in all but a few cases they absolutely did not owe ANY MONEY to these loser dirt bags.

    I have seen debt collectors chasing the wrong person, relatives of the debtor, and already settled debts. People need to take these companies to court, there are far too many abuses.

  • @rayme4raw, I actually worked with medical debt primarily, before Ieaving the company I was working with credit card debt. I did speak with a wide variety of people from the very rude to nice but I treat everyone the same with respect, kindness, ethically and most importantly legally. I was only working there because the pay helped me to avoid having any student loans during the time I was finishing my bachelors of psychology and Master degree clinical counseling.

  • @goddessvixen7 unfortunately here in Britain..your UK bailiff bretheren are in for a different set of rules......im a British Royal Marine Commando and when bailiffs tried to use these tactics on my elderly grandmother i turned up with 8 other marines threw him into the back of a van and drove him to the middle of a wood before putting a 12 inch blade underneath his throat and telling him how things were going to happen from "here on in"....we never heard from him again..another bailiff was sent

If she forgets to pay her bills once in a while I would have thought a council tax direct debit might have been a little more constructive than terrifying the hell out of some poor bastard on £7ph who probably went home shat himself in his trousers and suffered post traumatic stress as a result.

  • @goddessvixen7 when this new bailiff turned up i asked him how his colleagues throat was?? was it still sore?? and then promptly told him of my grandmothers mental illnesses and how she forgets to pay her council tax bill on occasions...and that .he could record what i was about to say..if he wanted...but..and my words were "you know how much public support there is for the men and women who serve in the military defending this country .i have the upper hand therefore...dare you..to come again

And your right i am a man of honour i'd never dream of threatening an elderly person who is in the early stages of alzheimers...Plus if you knew anything about ANY military unit out there from a developed nation, say..the USMC for example..they double up...a platoon will be sent

  • @alden2008 will be sent to take on an enemy of section size...if the enemy is expected to be around platoon strength you take a company..etc etc etc....only special forces units (if they are UK spec ops that is) travel in teams of 3-4...and even then special forces units ..contrary to the movies..dont get involved in protracted, long drawn out firefights...they are there to do things covertly..so i suppose in a manner of ways having 8 lads deal with these cowards is the done thing

If you are so aware as to your popularity in this country then you would be aware as to what happens to marines or otherwise who dont think before they act. They sometimes wind up a statistic in Iraq or some other backside of beyond toilet. Thats not a threat you understand, its just what kind of marine doesnt pay his elderly mothers bills for her then gets the lads out when the inevitable happens

  • @porta17 We did pay it..my wife personally gave them over 6 times the amount....they claimed it all in fee's (which is illegal for a start as they can only charge £24 for first visit, £18 for 2nd and not much thereafter)...he took £££s and his reciepts and what we eventually got from her local council shows that roughly £20 came off the bill..this prick had been siphonin it off....as, so im led to believe according to CAG dot com, most do. Sorry but they are scum as far as im concerned

  • @porta17 As it happens , as an update, A Formal Form 4, complaint was put in with the courts...the second person a woman who cam out has lost her Certification and will no longer be able to work in the industry..and the Company itself..now has a CCJ against it meaning they cannot renew their licence in the new year meaning they are FUCKED. and ya know what..im glad....their al out of work i that company now..good. Bastards.

  • Dave wants to harp on the laws that are broken by debt collectors but isn't someone that has not paid a debt breaking a law by not paying a note in accordance to the promisory note.

  • @clayfield1 Simply put, harassment, fraud, etc that the debt collectors do are "crimes" against the person and thats why it is illegal. These crimes are handled by the criminal courts. Not paying your debt is a "crime" against property. These are handled in civil courts. I don't believe it was ever said that people that owe money shouldn't pay their debts because they should.

The funny thing about this whole arguement is that if the person that borrowed the money paid there debt then "illigal crime" would never take place. So it seems like the victim in the criminal crime is the instigator of the crime against them.

  • @clayfield1 You are right. People should pay their debts. Individual responsibility is crucial. All I am saying about the legal system is that there are crimes against property and crimes against the individual and are handled by different courts. You don't need to buy the severity of crimes claim - the law does it for you and classifies it against other crimes. That's why when you murder someone you go to jail for life and when you jaywalk you get a $50 fine.

  • I'm in the UK and cannot believe that this can make the TV!! Yes, there is bad practice in ANY industry, and yes it is unfair if people completely unrelated to the debtor are contacted.....

    ...but what if no-one had to pay their debts, Credit cards etc. It would be like dishing out 5 and 10 Grand gifts.....no-one would EVER pay it back (me included if they never asked for it back!).

    The guy wrote a sensible letter and was interjected with childish remarks.!!

  • These debt collectors drive me nuts. I got calls for YEARS for some woman I didn't know. They would stop after I told them I wasn't hurt and then start up again a few months later. It was so damn annoying. We ended up getting rid of our landline phone all together when we started getting calls for someone else. Now we just use cell phones and I use youmail to ditch companies/people I don't know.

  • @ScaperSteph You are not alone! I volunteer to provide financial/tax/accounting advice to low income and the elderly. If I see 60 people, only 3 people on average are NOT receiving calls for someone they don't know. Freakin unbelievable. These people are out of control.

  • If the activities are illegal then take them to court so there debt license can be postponed. Im a debt collector and i do not for second take my position for granted, i prefer to actually have a conversation with somebody on how they can resolve the issue.

  • Last time i checked taking a good or service without paying is stealing. 90 percent of debtors are thieves the other 10 percent have fallen on hard times but i guarantee they will stay on the phone and figure out a resolution to the debt.

  • @preslaude that number should be reversed. I seriously doubt 90% of people who fall on hard times are thieves who set out to defraud someone. Many people fell on hard times even those who were responsible with their money. Not that matters if you are, because in our banking system, no matter how responsible people are, the way the banking system is set up guarantees that some people will default or be foreclosed on. That's just how it's set up.

  • And are you suggesting that people just pay somebody whatever they ask just because they called and demanded payment? You can make an argument that not paying a debt is a dishonorable thing and in many cases I would agree that you are right. However, wouldn't you also consider it dishonorable for some company to buy a bunch of debt for $.02 on the dollar and then start calling people demanding payment when they have no real proof these people actually owe anything?

  • DEBT COLLECTORS ARE SCUM!!! Though I don't owe any debt, Chase credit services would call me several times a day from 8am to 11pm asking for some woman even though I told them they had the wrong number. After several calls telling them they had the wrong number, I, with permission, recorded the conversation quoted the laws they were breaking to the supervisor and threatened a law suit.

    That shut them up.

  • @pavs04 Good for you, my parents and I would have had a great lawsuit against chase, if my parents had recorded one phone call from them. They called my parents when they wanted to reach me and not only did my mother say that they wanted me but they tried to work with my mother to get a payment, telling her that if she made a partial payment that it would wipe out my entire debt responsibility with them. That would have been an awesome lawsuit.

  • The other thing is this: though I'm not, and can not, be for these medieval tactics these debt collectors sometimes use, it must be mentioned that the debt collector is not the cause of the consumers financial woes. We live in a materialistic, more is better society, that is extremely hard to break

    its cycle of gotta have it now. There is no end to the cycle. You have to humble yourself. The debt collector may humble you enough so not to get you into the same trap again looking for a way out.

    True the President is a pro for doing very little and earning very much. The best creditors will, after they've realized they can't squeeze any money out of you will reduce your rates to zero, with some strings, but allowing you to pay it all off while keeping to an agreement.. At this point they rather not stress you and you not stress them. And than return your credit to normal.

    So I don't agree that this is how you should respond to the Presidents letter.

  • I will say that I work for a collection agency for several year and I have never treat a person the way Dave Ramsey claims nor have I release information about someones debt to a minor. I think his thought are a very narrow veiw of a handful of agents. Also to say that a debt colletor is scum is only a way to make yourself feel better about not paying your debt and steal!

  • @goddessvixen7 I wonder if it depends on what he means by collector. I worked in auto finance, our collectors had it easy, we never had to be mean or rude because after 4 to 6 months of non payment, we repo'ed the vehicle. Does he mean credit card collectors after six months when the debt is sold to a collection agency for 5 cents on the dollar. I can see those collectors getting heavy handed.

  • @simontimon2 not when credit card companies jack the interest up when THEY feel its time. You make 7-8 years of payments always ontime and it goes from 7% to 19% because of our idiot liberals in office? nope, they are the scum, not the people who pay ontime and get screwed.

  • @Icetitan777 You're right, I had perfect credit for over a decade, was rolling over several thousand at 0% interest each year. After Sept 2008, no more roll over offers and I saw my interest jump from 0 % to 6% all the way up to 20% in one year. I was still making payments on time and everything. Needless to say, I cancelled all my credit cards.

  • Great info! I have a friend who worked in collections! Probably part of the reason he committed suicide (sadly). He shared A LOT of insider info with me and it was beyond disturbing! My daughter also was "offered a job" in "sales." Turned out to be a collection agency and she only lasted until the lunch break! Her boss threatened to kill staff, clients, and even threatened to rape her!! She got the hell out of there! The whole collection industry needs to be overhauled.

  • I just don't know what you can do when they have bought a debt from years ago - it's on your credit report, - how do you get them to back off? You have NO power it seems.

  • In my defence, prior to that job, I didn't know the collection process from the back end of the moon.

    Now I know how dishonest, immoral and thoroughly unscrupulous the whole process is, and I have nothing but absolute contempt for it - the world would be far better off without it.

    If you work for a collection agency, go somewhere else and in the process, you'll get your heart and soul back.

    But don't expect or demand respect while you're still there - what you do doesn't deserve it.

  • @dcamaggots they can be quite usefull, when somebody you lent money to suddenly wont answer the door and has a private phone number. its great to have these people to throw at them lol
