All critical judgments aside, someone who doesn't even the knowledge of law you can get from watching a single episode of Boston Legal should get that the double jeopardy rule would not protect Ashley Judd's character from a murder charge if she killed her husband. That element was so irritatingly stupid I couldn't concentrate enough on the movie to decide if it was any good or not.
I am watching this today on fx 6/12/11 and it's creeping me out the part that was creepy was when she was in the grave and couldn't get out but found a way out my mom put this on tv thats why I'm watching this and I don't want to and I'm 11 years old!
Movie criticus that says this movie is not good enough, better look themself in the mirror and say : I'm a clumsy judge and have no taste for high quality movie, and should put my face on the toilet with a toilet paper in my mouth
the person that plays the ex-lawyer in prison (the one that said they tend to disbar murderers and the one that tells her about double jeopardy) also played stanley yelnat's lawyer on holes. i guess she got her license back :P
I love this sence of the movie where ashley is told: The state says you already killed your husband. They can't convict you of it a second time. That means that when you leave here, you track him down, and when you find him, you can kill him. That's right, you can walk right up to him in Times Square and put a gun to his head, and pull the fucking trigger, and there's nothing anybody can do about it. Kind of makes you feel warm and tingly all over don't it?
I just finished watching this movie for the first time in years. What a great movie!! I love movies that involve the law, being that I'm in the legal field myself. Loved it!
we are watching this movie in law class.... its a really good movie! i just have one question how did the husband manage to get so much blood..... like it was all over the boat and the hall way and the bed!
speccwolf is right. She was convicted of one degree of murder with very specific parameters and was tried by the state that the murder took place in. If she murdered him in another state, that state could prosecute her and write up a different degree, different charges, etc.
the meaning of double jeopardy is that you cant be tried for the same crime twice whatever state ur in. what ur describing is penalty for the same crime in different states not double jeopardy.
Is this th movie, wen a woman n her husband r on a boat n he "dies" but it turns out hr ran offwiv her best friend or sumthin like ht. sori if i ruined it, but itprobs aint even tht film lol x
Is this the movie, when a woman and her husband are on a boat and he "dies" but it turns out she ran off with her best friend or something like that? Sorry if I ruined it, but it is probably it isnt that film. LOL x
Why is this listed as a Trailer? This is full clips from the film and would be more considered SPOILERS. (Trailers don't reveal story-lines, they only hint at plot-outlines)
I just rented, was a very good movie. The only problem was that she killed her husband in New Orleans. She will be charged AGAIN for murder in New Orleans, because the FACTS have changed in the murder case. She is not being charged for murdering her husband with a knife on the boat. She is now being charged for murdering her husband in New Orleans with a handgun.
She didn't murder her husband, she killed him in self defense, so she most likely would get a manslaughter charge and probably wouldn't serve any time b/c of the time she already spent in jail, if she even got any sentence for that. But you're right, the "double jeopardy" is misleading b/c you can't be convicted of the same crime done at the same time twice.
yeah, it is misleading about the definition of double jeopardy. basically, double jeapordy means you cannot be convicted for the EXACT same crime twice. for example, she cannot go to court for murdering her husband on the boat AGAIN, because she already got convicted for that particular crime. BUT the killing in the HOTEL was a totaly different crime, commited at a different time...BUT in the movie, they got away because the fact it was self defense, making the title kinda misleading. good movie
yes you can, because Mr. Smith didn't die the first time. The law is not about the PERSON you are killing, its about the ACT of killing. In this particular case, she was wrongfully accused of murder, but that does not mean she can go out and kill again.
it doesnt matter she was connvicted by a jury of murdering mr smith and her conviction was not overturned as a mistake. double jeopardy stated that you cant be tried and convicted for the same crime twice. go look on wiki
you're missing the point. it is not the same crime. it may be the same people involved, but it is a completely different crime in itself. what double jeopardy means is that she cannot be tried twice for killing him ON THE BOAT.
FOR EXAMPLE: the murder on the boat is case number 22547.
The 2nd murder in New Orleans is case number 22548.
Double Jeopardy means she cannot be tried again for case number 22547.
when u r convicted for murder its not where u commited this crime its whom you killed and she was convicted for killing him so it doesnt matter where u kill him kill him on mars for as long u comited a murder against this particular person
uhhh...no. you got the wrong idea of Double Jeopardy. If someone beats his wife, you are saying he can never be convicted of beating his wife again. I give up. You're hopeless. Everyone else understands the definition, but you don't. Good luck buddy.
The fifth amendment refers to being put in "jeopardy of life or limb." The clause, however, has been interpreted as providing protection regarding "every indictment or information charging a party with a known and defined crime or misdemeanor." The clause, it has been held, does not prevent separate trials by different governments, and the state and federal governments are considered "separate sovereigns".
Therefore, one may be prosecuted for a crime in a state court, and also prosecuted for the same crime in another state, a foreign country, or (most commonly) in a federal court.
Gaarafan911, I think you need to go to wiki because that's where I found this.
This is a great movie and of course, Ashley Judd, is yummy!
