@kevn101 No, a "normal guy" would not be sent to jail under these same circumstances... someone would go to jail only if the driver INTENTIONALLY hits (or tries to hit) the pedestrian (assault with a deadly weapon or attempt murder)...if there is no criminal intent then a traffic accident report is taken....after all that's why they are called ACCIDENTS.

@DracoAzule was it a dumb move on her part? yeah.....was she still struck by a moving vehicle? yup ........ unfortunately the vehicle is almost always in the wrong when it hits a pedestrian, even if the pedestrian is playing foolishly on the road...the driver should be in control at all times(even during icy roads and bad weather).

so when i said LAWSUIT i said it not as a matter of opinion i said as a fact of what is going to occur....and oh btw this footage helps her case.....

When I ride in the DAY I have red blinkie to rear of bike handlebar lamp is used day and night. I wear a helmet that I have plastered with reflective material I gleaned off of a commercial truck that was sold for scrap I have a 1 watt headlamp on my helmet and it has a red blinkie on it the back. Then after all that I LOOK both ways. Why all the paranoia with safety BC there are folks that text play the music talk they do everything but DRIVE. I call this here a pure case of Darwinism.

@lowgeemudbone Sure can bet he argues bike walker was walking because of diabetic shock and the person was a walking zombie and the officer clearly was not watching where he was going while driving. Where I am from 70380 the police see a person on a bike they stop them and harass them maybe the person was trying to get where they were going with out having to produce documents as to ownership of the bike. Sure wish the ACLU would go there and get some folks to ride or walk there and get rich?
