The public loses respect when it sees a judge "beat the system," while the victim loses the chance to be made whole for the injuries flowing from the judicial act. do you see the logic in that?

  • Did you know only 28 states give compensation to the exonerated? No wonder he have the highest incarceration rate. Without consequences for wrongfully convicting and punishing people for no reason prosecutors and everyone else have to worries about putting the right man behind bars. They just was their win.

  • @springthunderboxer I can agree with what you are saying to a point. A wrongful conviction is usually, but not always cause by incompetence on the part of the police or da. But some of them are honest mistakes. I don't think this case is an honest mistake, but some are.

Herman Atkins is my father and i am not only proud of all his accomplishments but i am also proud that he was able to make it through all the hardships he had to face after being exonerated. For all the people on Youtube who are leaving these bizarre and disrespectful comments i am praying for you. Praying that one day you will move past your ignorant ways and stop judging others whom you havent even met.

  • I just heard of a 54-year old man who was released earlier this month after first being arrested at the age of 19. He was accused or raping and murdering a young kid. When he was released, he said : "I'm not angry, because I got god".

  • The judicial systems do as they please. In America or Texas in this case, You are guilty!, guilty!, guilty! unless you have enough money to prove your innocence.

    Just look at the Robert McClendon case on a site called Americas Wrongfully Convicted. The only evidence against that man was perjurd testiony which consisted of over 150 inconsistancies in testimony and nothing else. They could not keep their stories straight and they kept changing the series of events. The judge did nothing about it.

    i am still undergoing something that i did not do, and i am being treated like a criminal. i went to jail, did 2 months, on house arrest and they still have a pending court date..the system is unjust!

  • Innocent Edward P. Contreras similarly has now had 15 years of his life taken away too. Ed cannot take advantage of the new DNA testing because DNA does not directly figure in his case. Ed has a sentence of life without parole for a murder he tried to stop. The confessed killer asked Judge John S. fisher if he could testify to Ed's innocence but Fisher said NO!   • think it has something to do with fact that america has large minorities of asians, hispanics and blacks. maybe american justice is so harsh because it's a racial thing. in the 60's america had almost the same seggregation laws as in south africa. now that's the land of the free

  • I just read the Steven Truscott story (sentenced to hang when he was fourteen, in 1959). Only recently did the government of Canada admit they were wrong. The justice system HATES to admit being wrong. But one injustice that few know about is the injustice of a child being ripped from their parents because CPS says the parents are unfit or abusive. In these cases, the parents have less rights than an accused murderer, and almost never win their child back, no matter how much evidence.

  • This scares me. This could happen to me or you, or anyone else. Makes me wonder how many people wnet to jail, or even their deaths, despite their innocence! I do believe in do the crime, do the time........ but........ I once was arrested for something I didn't do; I was let out the next day , thank goodness. But because of that experience it gave me a taste of what this must be like! This is definitely a cause to believe in!

  • Believe it. It happens all the time. Mr. Atkins was lucky that his case actually had evidence to refute. DNA cases can be reversed. Steve Peace was convicted of a murder 20 years after the fact. Try fighting against witnesses that have been given immunity, and say oh, yea, now I remember, he said he did it. So therefore he must have done it. Take that and a lawyer who takes your money and doesn't bother to prepare for a defense. Bingo ! Off to Prison . Search for the Steve Peace video on Utube.

  • He not the only one - every day, innocent people wind up getting screwed over in the cook-eyed courts for things they never did and either get 30-90 days in jail or fined - and the kicker is that even when there's evidence to PROVE their innocence, the prosecutor generaly gets his/her way and it's barred from consideration!

  • I'm so sorry about what your whole family, especially your dad, had to go through. I can't imagine what it's like to have 12 YEARS taken away from you like that. Your entire family (especially your Dad) is in my prayers. The same goes for all others who are or have been in jail for a crime they did not commit and their families.
