how about the french-speaking population that lives under a british head of state. No other country in the british commonwealth is structured like Canada is. No other country in the world. Becoming a republic would allow us to restructure our government and acheive absolute freedom from our decendents. You STILL haven't proven that there's any foreign influence because you haven't proven the Queen is foreign. The constitutional provisions you just mentioned - correct as they are - are stipulated by Canadian laws and conventions, as are those that bind the Crown, set out the line of succession, guide the viceroys, & etc. So, no foreign influence! I don`t know if you watched the CBC`s coverage of the Canada ceromonies, but Peter Manbridge commented during the governor generals entrance about support for the monarchy. It is the lowest in our nations history, single digits low. he then went on to say that our ties will cease at the death of Queen Elizabeth II and not continue into Prince Charles. So....love it or hate it, its going to be gone .
Unlike the US Constitution, our Constitution does not say that our head of state has to be a citizen or born here. In fact, neither the queen nor her parents were born in Canada, she is not married to a Canadian and, having spent roughly 300 days here, doesn't even meet the residency standards for landed immigrant. Therefore, according to the Immigration Act, the Queen is neither a Canadian citizen, nor can she in any accuracy or honesty call herself Canadian. Therefore, she is foreign.
Unless it says otherwise, an Act doesn't bind the Crown; so, if legislation makes the Queen foreign to Canada, then she's equally a foreigner to the UK. Also, being in a country of immigrants, you must know already that birthplace doesn't solely decide nationality either. As I said, the gov't recognizes the Queen as Canadian, she called Canada a home, Canadians fellow countrymen, her family Canadian, and her mother called herself the same. Do you know better than all of them?
The whole point of being a "Constitutional monarchy" is to have a monarch limited by the constitution. In our case, it says "Every individual is equal before and under the law" and "Nothing in this Charter extends the legislative powers of any body or authority." Therefore, just like the rest of us, all aspects of the Citizenship Act apply to her. Since she doesn't fulfill any of the Act's requirements, then she's not a citizen. If the Queen is above our laws, then we're an absolute monarchy.
Besides, as a lawyer, I can assure you that your reasoning is seriously flawed. The Crown and the Queen are 2 separate entities. The Queen represents the Crown (The Canadian State) but she is most certainly not The Crown and enjoys no special status as a result.

You must not be a terribly good lawyer, then, if you don't know that an act only binds the Crown if it says it does; last I checked the Citizenship Act doesn't say it binds the Crown, and neither was it a part of the constitution, Charter or otherwise. Further, the Crown is frequently defined in laws as being the Queen. And, I didn't say the government called the Queen a citizen, I said she's been put forward as Canadian.

Read the Interpretation Act, lest you lose your licence as a lawyer! Not only does it spell out that an act doesn't apply to "Her Majesty" unless the act says so (s.17), but it also states that "Her Majesty", "the Queen", or "the Crown" means the "Sovereign of Canada" (s.35). Perhaps you'd like to establish how Elizabeth isn't the sovereign, then? Also, have a gander at s.V.41 of the Constitution Act 1982 to see just how soon the monarchy will be gone. A president that does not represent the British...I live in Quebec. We are becoming more federal everyday. This will be the first step towards becoming a nation united as a whole. There have been various surveys on the subject over the years, and they all contradict one another: one says a majority are ok with the status quo, another says they want change. Still more show that most Canadians have no idea what they're talking about, and others show there's no desire to open the constitution. The have, however, been none about British shadows. I don't see how it's relevant. Even if you could find the source the CBC used (which you can't), there's no poll that shows majority support for a republic. Why? Only one survey, done in 2002, ever asked specifically about a republican system to replace the present monarchy; 48% favoured. And that STILL doesn't mean there's any movement afoot. Polls suggest that an all time low for supporting the Monarchy was at 67% after the death of Diana, it rose again in the early 2000s and has decreased again since 2005 and is currently at about 65%, but that is mostly the French Speaking population. Becoming a republic would allow us to restructure our government and acheive absolute freedom from our decendents. You STILL haven't proven that there's any foreign influence because you haven't proven the Queen is foreign. The constitutional provisions you just mentioned - correct as they are - are stipulated by Canadian laws and conventions, as are those that bind the Crown, set out the line of succession, guide the viceroys, & etc. So, no foreign influence! We do, her name is Michaëlle Jean and she is the Governor General of Canada. She is the Queens representative. The Governor General is appointed by the Queen on the recommendation of the Prime Minister. Michaëlle Jean is a Canadian citizen though she was born in Haiti.

I agree, Unfortunately I think Canada has outgrown that tradition phsychologicaly. I don`t know if you watched the CBC`s coverage of the Canada ceromonies, but Peter Manbridge commented during the governor generals entrance about support for the monarchy. It is the lowest in our nations history, single digits low. he then went on to say that our ties will cease at the death of Queen Elizabeth II and not continue into Prince Charles. So....love it or hate it, its going to be gone .

Unlike the US Constitution, our Constitution does not say that our head of state has to be a citizen or born here. In fact, neither the queen nor her parents were born in Canada, she is not married to a Canadian and, having spent roughly 300 days here, doesn't even meet the residency standards for landed immigrant. Therefore, according to the Immigration Act, the Queen is neither a Canadian citizen, nor can she in any accuracy or honesty call herself Canadian. Therefore, she is foreign.

Unless it says otherwise, an Act doesn't bind the Crown; so, if legislation makes the Queen foreign to Canada, then she's equally a foreigner to the UK. Also, being in a country of immigrants, you must know already that birthplace doesn't solely decide nationality either. As I said, the gov't recognizes the Queen as Canadian, she called Canada a home, Canadians fellow countrymen, her family Canadian, and her mother called herself the same. Do you know better than all of them?

The whole point of being a "Constitutional monarchy" is to have a monarch limited by the constitution. In our case, it says "Every individual is equal before and under the law" and "Nothing in this Charter extends the legislative powers of any body or authority." Therefore, just like the rest of us, all aspects of the Citizenship Act apply to her. Since she doesn't fulfill any of the Act's requirements, then she's not a citizen. If the Queen is above our laws, then we're an absolute monarchy.

Besides, as a lawyer, I can assure you that your reasoning is seriously flawed. The Crown and the Queen are 2 separate entities. The Queen represents the Crown (The Canadian State) but she is most certainly not The Crown and enjoys no special status as a result.
Another correction: The Queen is entitled to say whatever she likes about her perceived nationality but that doesn't make it real. Care to back up your claim that the gov't recognizes her as a citizen? Or is that more of your bullshit?

You must not be a terribly good lawyer, then, if you don't know that an act only binds the Crown if it says it does; last I checked the Citizenship Act doesn't say it binds the Crown, and neither was it a part of the constitution, Charter or otherwise. Further, the Crown is frequently defined in laws as being the Queen. And, I didn't say the government called the Queen a citizen, I said she's been put forward as Canadian.

Read the Interpretation Act, lest you lose your licence as a lawyer! Not only does it spell out that an act doesn't apply to "Her Majesty" unless the act says so (s.17), but it also states that "Her Majesty", "the Queen", or "the Crown" means the "Sovereign of Canada" (s.35). Perhaps you'd like to establish how Elizabeth isn't the sovereign, then? Also, have a gander at s.V.41 of the Constitution Act 1982 to see just how soon the monarchy will be gone. Huh? Quebec would have to "sign" before Canada could become a republic; or, did you not read what I told you about the legal requirements for the Crown to be ousted? Most in Quebec who are antt-monarchist are so because they're anti-federalist and see the Crown as a symbol of Ottawa's intrusion. So, I don't see how they'd view a federal president chosen by a majority Anglophone population any more favourably.

A president that does not represent the British...I live in Quebec. We are becoming more federal everyday. This will be the first step towards becoming a nation united as a whole. It will send a clear message that we are not a British in fluence on Quebec, rather a foundation for the greatest Nation through all of history. This would signify that this Quebec`s country too, not the other way around.

Perhaps (and I hope this is the case) Quebecers are dropping the anti-British propaganda of the laine pure dogmatists and learning that the monarchy is not a symbol of Britain. The civic and provincial governments did want the Queen at Quebec City's 400th, after all. Quebec becomes more federal in hopes that Canada will one day be a republic. Becoming a republic demonstrates to Quebecers that we wish to live free and independent as one without any ties to the old world. Stats Canada did a poll prior to Canada day and 92% of Canadians are in favour of becoming a republic......just face it....

Made up poll with a made up result. It was the Globe and Mail and CTV that commissioned a survey for Canada Day, and none of the questions referred to a republic.
Frankly, though I see nothing wrong with the current situation - in fact, sharing our head of state with a globally diverse set of nations is actually quite Canadian - I could live with a uniquely Canadian constitutional monarch. I don't kid myself that it's going to happen any time soon, though.

It was made up; there's no such poll. There have been various surveys on the subject over the years, and they all contradict one another: one says a majority are ok with the status quo, another says they want change. Still more show that most Canadians have no idea what they're talking about, and others show there's no desire to open the constitution. The have, however, been none about British shadows. So, your bombastic predictions are actually paper thin; nothing's gonna change anytime soon.

He either made it up or you did. The printed facts are there for you to look at; published in the Globe & Mail July 1. But, so what? It's hardly "fuckin over" because you say so. 1st, you have to educate the populace on the present system. 2nd, you have to come up with a new system. 3rd, you have to get all 10 provinces + Ottawa to approve. 4th, you have to have a successful referendum. The Aussies have been at it for 15 years now; their constitution is easier to amend, and no Quebec! Good luck!

There was 1 vote in Australia, in 1999 (2, if you want to count the 1 before Federation in 1901). But, so what? The point is that the republican boobs there are still at it, 15 years later, and their constitution is easier to amend and they don't have a Quebec to appease. general assembly on how we wish to conduct ourselves after the switch has been made. Then detailed information will be made available to the public on the governments intentions and what it has planned for the future. Then the plans will be finalized and put to a vote. When the vote passes through the citizens and parlament we will offcially become a republic!

I don't see how it's relevant. Even if you could find the source the CBC used (which you can't), there's no poll that shows majority support for a republic. Why? Only one survey, done in 2002, ever asked specifically about a republican system to replace the present monarchy; 48% favoured. And that STILL doesn't mean there's any movement afoot. Look at the video here; a grand total of 30 people. 30! Out of 35 million! Yea, what a revolution!
