Prison is NOT the solution to everything. Whats wrong with taking her license or house arrest. The wreck was an accident. The main thing is to keep her off the road. The next thing would be to enroll in AA and mental health PTSD class while under supervised probation. Restitution should be awarded to the family of the deceased. Im sure she suffered PTSD after the accident and drinking may have been her way of dealing with the pain. Sending someone to jail IS NOT always the right decision.

Umm..... why the hell does drinking change a DUI case? It doesn't. Drinking and driving is the problem, and there is no evidence of that on myspace. Probation does not mean feel bad about what you have done, it means don't repeat the crime. They really have no right to jail her unless part of her probation was stay sober. It disturbs me to see how much drunk driving is being used to erode critical legal concepts, like mens rea, as well as the 4th - 6th amendments. Police have taken blood samples by force, without a warrant, in the back seats of patrol cars, there are places that only do hearings, sans defense lawyers, where some bureaucrat is prosecutor and judge, etc.
