No, because they were "forced" to pay the taxes and therefore are entitled to the benefits. They could not option out of the program taxes. If they could option out, not pay, but didn't, then you would be correct. However, they could not option out of the program and were FORCED to pay the axes so, they are entitled to the benefits. Medicare Part D is used even by members of congress with private insurance. In fact, many private insurance plans require members to get their Meds through the prescription benefit - unless people want to pay for it unnecessarily. So yes, even former Members of Congress and rich Talking Heads do use Medicare.
