the entire "loan" is fraud. The bank NEVER lent you anything. A modification will only get your autograph on a piece of paper which the banks will even make more. Use contract law only when you take them to court and 99% of the time (without an attorney) you will win. Google "where does the fraud begin"
I have a cousin who found out about this after being about 4 months behind in his mortgage payments. Over a period of nearly ten months, he sent 4 green receipt notorized and certified letters, asking his alleged lender to show proof of a binding original note. When they finally wrote back addressing his request, they sent some letter saying that he has to not only make a fee to see it but he will have to be taken to another location, once he makes a trip out of town to see the documents-a mess!

Stop paying your credit card bills also. Take into consideration what your minimum payment is and calculate how long it will take to pay off your balance and you will realize that you will be paying many times over what the initial amount is.
......
Stop paying and you can always save that money or get yourself a credit card from
Walmart or other companies that allows you to use your own money as your credit line.
.....
The banksters are not your friend, STOP ALL PAYMENTS TO THESE CROOKS!
The "Borrower" never got a loan...they got a house. At the closing table thare was a currency exchange...a signed promissory note for a house. Deal is done and paid for. If they try to foreclose, take them to Court then tell them that they can have the House including everything the house produced (appreciation, Improvements etc...) in exchange for the Note and everything it produced. Watch what then happens...1000's of people have been keeping their homes this way.

I stayed in my home, An agency in DC helped me use this to get the bank to finally work with us. I reduced my payment 46% for 5 years and the get started info was free and the paperwork was less than $200 I went to delay or stop foreclosure online, it was easy to find, also goes by homeowners assistance info, use discount code 7129098 as there is a grant available to keep costs under 200. I am so relieved and every American deserves to stay in their home good luck and God bless
As a 20 year licensed loan agent in California who has helped many people save their properties, at least for a year or two, or more if they actually followed my advice. First off, his ideas are not that bad, as somebody who is an expert at this sort of thing. To ethjohns - Why do lenders do loan modifications KNOWING that 90% of the borrowers are in default again within six months??? To bleed every last dime that they can before taking the property back. I agree, if a borrower KNOWS they will be in hardship soon, PLAN AHEAD!

LOL!!! This is one of the most ridiculous things I've ever watched! People like this douche are the reason for the foreclosure crisis in the first place. You have an ethical obligation to repay money you borrowed. "Stop paying even if you have money"???? WTF??
Try this scenario. You bought a house 3 years ago for $ 500k. You put down $ 200k. Today your same house across your street sold for $ 175k. You still OWE $ 300k on your house. Would you STILL make your payment?..knowing you LOST your entire life savings of the down payment and still underwater $ 125k? Who is to be blamed? The Bank should take at least half the blame...for lending out money to people with zero money down, and no credit..driving up prices in the first place.
everyone and i mean everyone here interested in this topic need to see the you tube video "aly v First National Bank of Montgomery". Notice how the higher courts protect the bankers's scam!
I live in CT, I recently had emergency major surgery with a 10 month receovery process. I immediately contacted my bank in writing requesting a 4 to 5 month loan deferment & papers were sent to me but it took 5 months to get them, my employer of 3 + years filed bankruptcy while in hospital & fail to pay social security & other benefits & taxes, bank changes their mind on deferment places me in loss midigation, informing me I'm now 3 months in rears facing foreclosure any good attorney in CT ?
I am a landlord, have been for over 20 years with lots and lots of people paying me rent like they are sleep walking. I have always wondered what would happen if people en mass just took a "rent holiday"? kind of like these "Bank Holidays" they are talking about. I mean really, if enough people did it, there is nothing us landlords could do. But please don't do that. Just keeping paying and pouring your money down a rat hole so that I can have it.. I mean, haven't I earned it? (suckers...)
Remember, we also gave the banks billions in aid. You the landlord would not be bailed out if folks stopped paying you. Can't really compare the two.....
Keep in mind that loan modifications MAY be available if you are NOT behind on your mortgage. Many people, including the lenders themselves are not aware of this.
if you haven't seen the inequity in banking, ie credit cards, mortgages, etc., then you haven't been awake. i'm taking the fucksticks for every dime i can. i didn't agree to refried pieces of shit coming into my country illegally, taking g'ment grants to open businesses with no citizenship, credit, education, common sense, or identification & can't speak our language after 18 years? tie 3 innertubes together and ship'em back across the rio fuckin' grande, sink'r swim. nobody got MY vote!
I have not met or heard of anyone that has been helped. I have heard stories but it is just like a chain that continues ans never stops, so you never get to see that person that was helped and i need help with my house
I look at this as a gamble and a pretty big one at that. Firstly the homeowner has limited funds, the lender doesn't. How does this work with the Help for Home Owners plan? Isn't that a form of working with the bank to debt restructure? What about forbearance?
You should look at my video about Getting the Hidden Equity Out of Your Home when the property is worth substantially less than the amount you owe. This technique applies in the judicial foreclosure states. Stay as long as you can in the property without paying the mortgage, and use the money to pay off your credit card and for a down payment when buying someone else's problem at auction, to move into more affordable housing in which you would have an equity.
This comment has received too many negative votesshow
It's because of people like you that we're in this foreclosure crisis in the first place. You have an ethical obligation to repay money you borrowed. The only thing you got right is that "it's no longer a financial sin to have a foreclosure". Hmm, why do you think that is Mr. Lawer man? Go get a respectable job!
Man, it's difficult out there. It might not be for you, but it is for millions of Americans. People who want to work but cant find a job. If a persons back is up against the wall, not paying the mortgage makes since...I dont believe in going down with the ship if its not nessesary. What for those crooks? For the guys who made this problem?...no way...
@ethjohns So you bought a home in Las Vegas in August 2006 for $181,500 and your mortgage is $165K. Now the home is worth $39,900. So you'd keep paying it? Screw ethics. Businesses would get rid of this toxic "asset" but regular people shouldn't?
Everyone should stop paying all of their bills except for local merchants. Withdraw all money from the banks and use cash only to make local purchases from local small business'. Don't fly or drive unless absolutely neccessary. If only 25% of the population does this not only won't they get money they'll be inundated with billing and frazzled by loss of revenue. If others see the effect and as word travels the effect on the rich will be catastrophic.

@PeterJ2ndmiri@PeterJ2ndmiri I agree we need a mass strike. Many in the rest of the world are already doing this because they have no other choice. Lyndon Larouche speaks about the mass strike check it out if you get a chance. Ever wonder why it's ok for Donald Trump to use strategies like this and it's ok but if the poor guy does it he's a bum?
@PeterJ2ndmiri I agree totally. The people of the world have tremendous power and we don't even know it. If everyone stopped paying the banks on these mortgages based on fraud and scamming and stopped paying the bank owned credit cards, we could these banks to their knees. They live off of us. They are parasites and they need to be starved to DEATH.
@StSimonMartyr Did all that. The still sent a 30 man SWAT Team and took it at gunpoint headed up by LA CROSSE COUNTY WISCONSIN SHERIFF STEVE HELGESON.
Oh. THERE IS NO LOAN. The credit comes from your signature on the promissory note. The bank can never show a loss. Remember: Attorneys are agents of the court. They don't give a shit about you. THeir allegiance is to the banc. I mean bench. I mean bank...
An Injunction or Temporary Restraining Order= Motion filed with the court asking for the sale to be stopped. An Injunction should be filed as soon as U discover that you may have a legal case that could justify why the sale should not go forward.
The court may require you to file a Motion for a Permanent Injunction.
Injunctions require a hearing to argue reasons for halting.
Now U must File An Exception To the FC Sale or Sue Judge & Court
@StSimonMartyr OK. But the burden of proof is on the party bringing the claim. Show me MY wet ink signature note. Not a copy. Not SEVEN copies. The actual note with MY DNA on it. That's all that need be done and the onus is on the plaintiff. An honest judge wouldn't require all that hoop jumping. Just ask the bank: "Is there a contract and if so, present it." Simple. And don't talk to me about procedure. Procedure is designed to frustrate those of us who DIDN"T attend liar...
@StSimonMartyr ...(I mean lawyer) school. It's simple. Before a bank is allowed to file a foreclosure, they must physically have and hold the wet ink signature note and make it available for examination, show where a loan was made in the first place, and show a loss. Short of these basic requirements, any judge who allows a foreclosure to proceed that will ultimately result in a family being put out into the elements is clearly a crime against humanity. For those judges who do. The rope!
@StSimonMartyr I no longer have a shred of faith in THEIR system. You can spend all the time and money you want filing a lwasuit but all the recalcitrant judge has to do is rule that your suit is frivolous and there you are with your dick in your hand. Honestly? I don't know what it's going to take. I know one thing for absolutely sure however' the solution is not going to come from within the system. The only thing I can imagine that might get some traction is a class action lawsuit filed...
...by a team of lawyers with a spine on behalf of the people (a class) who have been foreclosed on retroactive to June 5, 1933. I did EVERYTHING right in court that should have gotten my foreclosure dismissed. Namely, invoking Trinsy v Pagliaro. I silenced the plaintiff's attorney. Without representation, the plaintiff cannot proceed. Case dismissed. Not when you have Dale T. Pasell as your judge though. He took over the prosecution and ruled Summary Judgement for the bank. Fuck 'em all.
@StSimonMartyr I'd love to. I was totally railroaded. Even the court reporters are in on it. I have my transcript and it's totally different than what really happened.
You got recourse, bro. And with that attitude, you will get it done.
All that is stopping you, is you. Dont give up, never relent. This is for your freedom and mine. Make them fear you, become their enemy, they are your adversary and always have been.
All of them must be sued, disbarred or put in prison and the train has left the station, the tide is slowly turning.
Your title is clouded, your note securitized, your 'trial hearing' a kangaroo mock court sham.
@AceOfHeart2012 that s why they prohibit a recorder when they do a deposition, but the trick is to bring a larger one to get them to object and confiscate off to the side and have the smaller mp3 recorder as in a shirt pocket running to claim the meeting, then use it against them, then file a complaint with the human rights commission for violation of human rights, just to help shake things up
I assume that you won't be able to pay the mortgage in a few months, and then reason that you are heading for a bad credit rating anyway. I consider what to do about the situation. A business would reduce its expenses, and I suggest that you stop paying your mortgage to reduce your expenses. This will give you enough money to defend the foreclosure which is going to hit you at some point, and your defense may result in a modification agreement, instead of a default judgment of foreclosure.
Great tips from all of you guys! Thanks for sharing!

I look at this as a gamble and a pretty big one at that. Firstly the homeowner has limited funds, the lender doesn't. How does this work with the Help for Home Owners plan? Isn't that a form of working with the bank to debt restructure? What about forbearance?

As frivolous as this sounds it's true. Why pay for a house that isn't worth the market value? Ur just throwing money away...Good video

I'll take a look at your website. We are in that situation in California. Tough times. Thanks for the video.

It's because of people like you that we're in this foreclosure crisis in the first place. You have an ethical obligation to repay money you borrowed. The only thing you got right is that "it's no longer a financial sin to have a foreclosure". Hmm, why do you think that is Mr. Lawer man? Go get a respectable job!
ethjohns 2 years ago

WE need population co-operation.

@PeterJ2ndmiri @PeterJ2ndmiri I agree we need a mass strike. Many in the rest of the world are already doing this because they have no other choice. Lyndon Larouche speaks about the mass strike check it out if you get a chance. Ever wonder why it's ok for Donald Trump to use strategies like this and it's ok but if the poor guy does it he's a bum?
yeshualovesu2 7 months ago
@PeterJ2ndmiri I agree totally. The people of the world have tremendous power and we don't even know it. If everyone stopped paying the banks on these mortgages based on fraud and scamming and stopped paying the bank owned credit cards, we could these banks to their knees. They live off of us. They are parasites and they need to be starved to DEATH.

DO NOT Walk Away-FIGHT!
File a Quiet Title / Lis PENDENs on your home...they dont own your note, it was securitized & sold. They service the note, that is all!
They are Committing Fraud in Court.
Demand an Evidentiary hearing, do not comment, unless evidence is entered, via reporter
In Discovery Demand TITLE, WET Note-must be a perfection of Chain of title and that blank assignments are Not acceptable."

AceOfHeart2012 4 months ago
Then you must file an Injunction with the court.

AceOfHeart2012 4 months ago
@StSimonMartyr ...(I mean lawyer) school. It's simple. Before a bank is allowed to file a foreclosure, they must physically have and hold the wet ink signature note and make it available for examination, show where a loan was made in the first place, and show a loss. Short of these basic requirements, any judge who allows a foreclosure to proceed that will ultimately result in a family being put out into the elements is clearly a crime against humanity. For those judges who do. The rope!
AceOfHeart2012 4 months ago
Rope is fine with me.
Before that though, take everything he owns.
Sue the judge personally. Report him to the Bar for violations. Sue the attorney prosecuting your case for the Bankster Liars.
Its time to FIGHT and take America back. Suing banks and judges is one such avenue.
StSimonMartyr 4 months ago
@StSimonMartyr I no longer have a shred of faith in THEIR system. You can spend all the time and money you want filing a lwasuit but all the recalcitrant judge has to do is rule that your suit is frivolous and there you are with your dick in your hand. Honestly? I don't know what it's going to take. I know one thing for absolutely sure however' the solution is not going to come from within the system. The only thing I can imagine that might get some traction is a class action lawsuit filed...
AceOfHeart2012 4 months ago
...by a team of lawyers with a spine on behalf of the people (a class) who have been foreclosed on retroactive to June 5, 1933.
AceOfHeart2012 4 months ago
You have defenses.
Listen to tapes of Donna Baran on RBN-free and online. She fought them for Years.
You only comment on questions, once all documentation is entered into evidence ie evidentiary hearing.
If you subpoena title papers it states PAID IN FULL.
Banks have no ownership-they are all securitized and sold off to trusts, banks simply service them.
Proving this in court is an art.
You need to sue your judge and report him to the bar. Go after him, make him pay.
StSimonMartyr 4 months ago
@StSimonMartyr I'd love to. I was totally railroaded. Even the court reporters are in on it. I have my transcript and it's totally different than what really happened.
AceOfHeart2012 4 months ago
You got recourse, bro. And with that attitude, you will get it done.
All that is stopping you, is you. Dont give up, never relent. This is for your freedom and mine. Make them fear you, become their enemy, they are your adversary and always have been.
All of them must be sued, disbarred or put in prison and the train has left the station, the tide is slowly turning.
Your title is clouded, your note securitized, your 'trial hearing' a kangaroo mock court sham.
StSimonMartyr 4 months ago
@AceOfHeart2012 that s why they prohibit a recorder when they do a deposition, but the trick is to bring a larger one to get them to object and confiscate off to the side and have the smaller mp3 recorder as in a shirt pocket running to claim the meeting, then use it against them, then file a complaint with the human rights commission for violation of human rights, just to help shake things up

stop paying mortgage? are you kidding me? they'll kick you out and your credit will be ruined
creditliberation 2 years ago
I assume that you won't be able to pay the mortgage in a few months, and then reason that you are heading for a bad credit rating anyway. I consider what to do about the situation. A business would reduce its expenses, and I suggest that you stop paying your mortgage to reduce your expenses. This will give you enough money to defend the foreclosure which is going to hit you at some point, and your defense may result in a modification agreement, instead of a default judgment of foreclosure.
