  • the entire "loan" is fraud. The bank NEVER lent you anything. A modification will only get your autograph on a piece of paper which the banks will even make more. Use contract law only when you take them to court and 99% of the time (without an attorney) you will win. Google "where does the fraud begin"

  • I have a cousin who found out about this after being about 4 months behind in his mortgage payments. Over a period of nearly ten months, he sent 4 green receipt notorized and certified letters, asking his alleged lender to show proof of a binding original note. When they finally wrote back addressing his request, they sent some letter saying that he has to not only make a fee to see it but he will have to be taken to another location, once he makes a trip out of town to see the documents-a mess!

  • Stop paying your credit card bills also. Take into consideration what your minimum payment is and calculate how long it will take to pay off your balance and you will realize that you will be paying many times over what the initial amount is.

  • The "Borrower" never got a loan...they got a house. At the closing table thare was a currency exchange...a signed promissory note for a house. Deal is done and paid for. If they try to foreclose, take them to Court then tell them that they can have the House including everything the house produced (appreciation, Improvements etc...) in exchange for the Note and everything it produced. Watch what then happens...1000's of people have been keeping their homes this way.

    If you people ever take a bank into court and demand to see a promissory the attorney with the promissory will walk into court under guard. One or two armed guards. Promissory's are currency, the FED has publicized this forever and you find it in UCC Statute in all fifty states. WAKE UP ALREADY DAMN!

  • Carl ,what about accepting for value the default notice upon proof of claims that the bank has the original contract signed by both parties,not on sold to 3rd party,copy of orininal bank assay showing incurred loss,an invoice,not statement for money owed/owing by full christian named entity, not corporate fiction,proof of claim that there's any lawful money in circulation for public/private use? Is this effective?

I hope everyone realizes the true nature of Banking. Carl is right, failure to dissagree is to agree. when you are told you owe the bank money challenge them to prove it, prove they have the Note, etc. An unrebutted affidavit stands as truth. Your letters have power. Do administrative remedy measures and don't go to court

  • As a 20 year licensed loan agent in California who has helped many people save their properties, at least for a year or two, or more if they actually followed my advice. I feel this attorney is spot on. Stop paying your mortgage now. Hire a good attorney instead and hunker down for a fight. You really want to save your home..fight for it.

  • First off, his ideas are not that bad, as somebody who is an expert at this sort of thing. To ethjohns - Why do lenders do loan modifications KNOWING that 90% of the borrowers are in default again within six months??? To bleed every last dime that they can before taking the property back. I agree, if a borrower KNOWS they will be in hardship soon, PLAN AHEAD!

    Try this scenario. You bought a house 3 years ago for $ 500k. You put down $ 200k. Today your same house across your street sold for $ 175k. You still OWE $ 300k on your house. Would you STILL make your payment?..knowing you LOST your entire life savings of the down payment and still underwater $ 125k? Who is to be blamed? The Bank should take at least half the blame...for lending out money to people with zero money down, and no credit..driving up prices in the first place.

  • I live in CT, I recently had emergency major surgery with a 10 month receovery process. I immediately contacted my bank in writing requesting a 4 to 5 month loan deferment & papers were sent to me but it took 5 months to get them, my employer of 3 + years filed bankruptcy while in hospital & fail to pay social security & other benefits & taxes, bank changes their mind on deferment places me in loss midigation, informing me I'm now 3 months in rears facing foreclosure any good attorney in CT ?

  • Contact an attorney in YOUR STATE regarding foreclosure laws.

    Some banks will not help you until you stop making your payment. Get to the loss mitigation department of your mortgage company.

  • I am a landlord, have been for over 20 years with lots and lots of people paying me rent like they are sleep walking. I have always wondered what would happen if people en mass just took a "rent holiday"? kind of like these "Bank Holidays" they are talking about. I mean really, if enough people did it, there is nothing us landlords could do. But please don't do that. Just keeping paying and pouring your money down a rat hole so that I can have it.. I mean, haven't I earned it? (suckers...)

  • Keep in mind that loan modifications MAY be available if you are NOT behind on your mortgage. Many people, including the lenders themselves are not aware of this.

  • I do not understand why banks don't take ownership & lease the propery to the former homeowner for 20-30 years at an agreed upon rent.

  • I look at this as a gamble and a pretty big one at that. Firstly the homeowner has limited funds, the lender doesn't. How does this work with the Help for Home Owners plan? Isn't that a form of working with the bank to debt restructure? What about forbearance?

  • You should look at my video about Getting the Hidden Equity Out of Your Home when the property is worth substantially less than the amount you owe. This technique applies in the judicial foreclosure states. Stay as long as you can in the property without paying the mortgage, and use the money to pay off your credit card and for a down payment when buying someone else's problem at auction, to move into more affordable housing in which you would have an equity.

If a persons back is up against the wall, not paying the mortgage makes since...I dont believe in going down with the ship if its not nessesary. What for those crooks?     Everyone should stop paying all of their bills except for local merchants. Withdraw all money from the banks and use cash only to make local purchases from local small business'. Don't fly or drive unless absolutely neccessary.If only 25% of the population does this not only won't they get money they'll be inundated with billing and frazzled by loss of revenue. If others see the effect and as word travels the effect on the rich will be catastrophic .

If everyone stopped paying the banks on these mortgages based on fraud and scamming and stopped paying the bank owned credit cards, we could these banks to their knees. They live off of us.     Oh. THERE IS NO LOAN. The credit comes from your signature on the promissory note. The bank can never show a loss. Remember: Attorneys are agents of the court. They don't give a shit about you. THeir allegiance is to the banc. I mean bench. I mean bank...

  • Then you must file an Injunction with the court.

    An Injunction or Temporary Restraining Order= Motion filed with the court asking for the sale to be stopped. An Injunction should be filed as soon as U discover that you may have a legal case that could justify why the sale should not go forward.

    The court may require you to file a Motion for a Permanent Injunction.

    Injunctions require a hearing to argue reasons for halting.

    Now U must File An Exception To the FC Sale or Sue Judge & Court

  • @StSimonMartyr OK. But the burden of proof is on the party bringing the claim. Show me MY wet ink signature note. Not a copy. Not SEVEN copies. The actual note with MY DNA on it. That's all that need be done and the onus is on the plaintiff. An honest judge wouldn't require all that hoop jumping. Just ask the bank: "Is there a contract and if so, present it." Simple. And don't talk to me about procedure. Procedure is designed to frustrate those of us who DIDN"T attend liar...

Before a bank is allowed to file a foreclosure, they must physically have and hold the wet ink signature note and make it available for examination, show where a loan was made in the first place, and show a loss. Short of these basic requirements, any judge who allows a foreclosure to proceed that will ultimately result in a family being put out into the elements is clearly a crime against humanity. For those judges who do. The rope!

I did EVERYTHING right in court that should have gotten my foreclosure dismissed. Namely, invoking Trinsy v Pagliaro. I silenced the plaintiff's attorney. Without representation, the plaintiff cannot proceed. Case dismissed. Not when you have Dale T. Pasell as your judge though. He took over the prosecution and ruled Summary Judgement for the bank. Fuck 'em all.

    You only comment on questions, once all documentation is entered into evidence ie evidentiary hearing.

    If you subpoena title papers it states PAID IN FULL.

    Banks have no ownership-they are all securitized and sold off to trusts, banks simply service them.

    Proving this in court is an art.

    You need to sue your judge and report him to the bar. Go after him, make him pay.

  • @AceOfHeart2012 that s why they prohibit a recorder when they do a deposition, but the trick is to bring a larger one to get them to object and confiscate off to the side and have the smaller mp3 recorder as in a shirt pocket running to claim the meeting, then use it against them, then file a complaint with the human rights commission for violation of human rights, just to help shake things up

  • I assume that you won't be able to pay the mortgage in a few months, and then reason that you are heading for a bad credit rating anyway. I consider what to do about the situation. A business would reduce its expenses, and I suggest that you stop paying your mortgage to reduce your expenses. This will give you enough money to defend the foreclosure which is going to hit you at some point, and your defense may result in a modification agreement, instead of a default judgment of foreclosure.
