you can appeal the audio under fair use most of the time. There's a video showing you how to do it here:

Go to your "My Videos" and on the bottom line for each video, you will see Edit - Public - Live - and some cases you will see "Matched third party content" or "Video blocked in some countries" or "Resolve copyright issues". Just click on those links, and do what you have to do. They don't ban for that anymore. Now days they just want to put an ad for the song on your video.

I don't think they ban for using music anymore. They'll just mute the audio or put up an ad. I think they would actually prefer that you use copyright protected music because it gives them an opportunity to put up the ad.
