The railroad police have been on giant ego trips around here, too. As you said, as long as you're not on railroad property, it's perfectly legal to tape or take photographs. But some of those bozos seem to think we now live in a police state. We don't - at least not yet. Those crazy liberals didn't TOTALLY destroy the constitution yet.
Exactly. BUT if you are on PUBLIC property that restriction isn't in effect. On private property the owner has the right to tell you not to photograph as long as you are standing on their property. They can't tell you what to do if you are on public land. A sidewalk or city street would be considered public land. Shoot, this place in Amelia can be seen all over the island and on Google Earth you get a great view. There was no reason for them to stop us from taping in the street.
According to FEDERAL STATUES there are restrictions on videotaping and photographing on private property: * If the private property is open to the public, such as retail stores, private stadiums or tourist areas, filming is allowed unless there are signs that expressly forbid videotaping * If the private property belongs to someone other than a commercial business, you must have the property owner's permission in verbal form or in writing (if required by the property owner)
You are a retard. It is up to the owner of their own private property if they allow you to film their property. It has nothing to do with free speech. You do not have the right to take videos of anything you want. I don't care if a cop told you so or not. Are you allowed to film your neighbor from the street while they are in their house? Not without their consent. Are you allowed to record a conversation you have with someone? Not without their consent. Learn your shit, kid.
@theherkman Actually you are the retard. In the United States you can photograph anything you want from a public area. We never left the public street. No cop told me anything. The constitution of the United States did and it has always held up in court. You may want to get your facts straight before spewing off. And yes, you can film your neighbor from the street. If they don't want to be seen they have to stay behind walls. In some states you can even record audio with only one party knowing
I love Fernandina Beach but that older Allied Baiton guy needs to be told a thing or two. Looks like their number is 904-399-1813 just between you and me :-)
hey there; so sorry you had to see the idiot side of our renta cops here. These guys really do not have a clue as to what is allowed. They just think that they have a badge....
The problem is management, and always has been. They don't care much.
Fernandina Beach is a great place (other than the port)
These days, folks in such places are also hyper aware of terrorists. Hard to see yourself as a terrorist, but that's the nature of things now. Too bad you didn't just keep the camera running, even if it wasn't being pointed at anything. Might have been interesting to listen to!
@badger5402 - The problem I have with all of this is that CLEARLY MF is not a terrorist in any way. Had he been of middle Eastern origin they probably would have left him alone. There is no common sense about any of this Homeland Security nonsense. My guess is that we'll let the real terrorists waltz right in here and blow up something else while we're spending our resources hassling our own Citizens!!
