Military Commissions vs. Civilian Criminal Trials for Terrorists

So according to the Obama Administration, we need to read the Miranda rights to all of the terrorists? You have got to be kidding me. Closing Gitmo and trying the terrorists in NY has got to be one of the most idiotic decisions of Obama's term. There is no way we can try these people in a criminal court after it has already been established that they were subjected to waterboarding. These terrorist are going to end up walking and I believe Obama knows it.

5) Who are we at war with? Congress declared war on who? Terrorism is a method, and a general term. American Terrorists were tried as criminal even though the motive was political. (Oklahoma)

I just have questions but

1) Martial Vs Criminal - If the members and parties involve aren't affiliated with a particular recognized country's military or armed forces, is it still then a martial matter?

2) Profit Vs Political - depending on what deeper investigations may bring up, these individual's motives may have been political but there may possibly be an underlying motive to profit by other unseen /uninvestigated parties and their involvement.
