  • 7 feet 7 inches away from the road. That sounds like a good distance to keep people from using the streets as their own personal basketball court to me. Be thankful you live in a country were your biggest worry is you basketball hoop.

  • @shammadamma the way I look at it is if he had followed the law & moved the pole to his own property instead of insisting it stay on public right of way, absolutely none of this would have happened. He made the choice to disobey the law. If people don't like the law, then they can try to convince elected officials to change it. But I've seen at least one death from something just like this, and it also was on a low traffic road so it can happen. I also don't believe an edited video.

  • If you actually look at the facts on this you will find the hoop was not on his private property but in the public right of way. And he has only owned the home for 5 years. I researched the facts and posted the actual story behind this on March 31st on my Public Works Group blog

    That's not the point. The point is, the hoop had been there for decades and not hurt anyone. It's on a cul-de-sac with little traffic, but the state treated it as if it was an endangerment on a busy street. Ripping out the hoop was equivalent to the schools who suspend kids under their weapon policies for bringing a knife to school to cut brownies.

    The bigger issue was that the state officials lied to the homeowner and threatened to arrest him for non-arrestable actions.

  • I'm happy to see that justice has prevailed and the hoop was given back. Government has NO business in dictating our everyday private lives. WE pay them and THEY work for us, these few in the government need to learn that. This growing police state/oligarchy will not work, it never has all throughout history, it has ALWAYS failed.These jobs should be an honor to serve back to your community and country, it shouldn't be an ego fueling drug.

  • 1) Unconstitutional taking of private property by government without just compensation;

    2) Governmental action without judicial review;

    3) Basketball goal was grandfathered-in. New legislation not apply to the goal;

    4) Citizens' free speech "chilled" told to enter their home while verbally opposing illegal governmental action--defense against disorderly conduct charges;

    5) Citizens lied to and threatened by the Police in a civil matter; and

    6) Waste of taxpayer dollars.

  • Can someone post information on how to contact the authorities who are involved in this ridiculous use of tax payers money and resources? What has this country come to? The government has to have their filthy fingers in everything, don't they?   • it is appauling.. that female officer was so out of line...she shoud take lessons from the state trooper..he was calm and non confrontational..and at least he was in his uniform. I really respect the owners of the pole....they were upset but kept their composure. the female officer had no right to order the home owner into his house on his property...what is going on america...the government can take kids basketball poles...but the congress cant decide on a budget..insnity at its finedt

  • The sad part is that city county state or federal employees pull this kind of gestapo crap all the time. While law enforcement doesn't stop them, they protect them. IT WAS STEALING!

    Law enforcement management sees it as a "public relations" problem. while the rest of us who have had to endure this type of thing see it as a acute and chronic violation of our human rights, civil rights and dignity.

    I say Kudos to John McCaffery , you are a good man, and I hope you win your suit against the DOT.

    You really miss the point. HE should not have to. They broke the people who put up basketball poles for their children and the children in their neighborhood, should be rewarded not harassed and punished.

    The state troopers and FBI agent, can and should be fired for what they did. The pole was legal and some DOT employee (most likely the State Trooper living nearby) saw them keeping it form being removed as a threat to their authority and decided to pull some strings.

    3 The one with the "FBI"(?)sweatshirt, a LT. in the Delaware St. Troopers. Looked like she just awoke.

    4 A state trooper lives nearby.

    5 Only poles from that neighborhood were taken.

    6 The county maintains Claymont's roads, but everyone trying to take the pole were from state agencies.

  • The point is not about the poll, it is about abusing power and those that wield the power flat out lie on camera. And he wasn't in violation to begin with, or at least that what he says about the distance in the video. A wrong was done and everyone was was wronged has the right to press charges. If the poll was in violation and the authorities didn't flat out lie I wouldn't be debating with you on this right now. 'Fight for your rights man, don't lay down and take it' is what I say.

  • @intercooler2 Well, as a US citizen I care, it affects my rights as it can be cited in a legal battle I might get into if this does go to court.

    Anytime there is an abuse of power anywhere in the government that governs you you should care. I don't know if you're a US citizen or not though, that might be where the confusion is.

Whoever gave this order needs to start emailing his resume ASAP. You can throw your weight around with the poor people down in Dover, but you'd better not mess with the rich folk in Claymont.

  • @greenghost2008 ; I don't think it is that complicated. This is about Communities mobilizing and coming together whenever Bureaucracy imposes itself in a disorderly and inequitable manner. All the time we stand aside ,this will become more common place. Letting the Lawyers get involved just strengthens the System of Bureaucracy. Imaging the Neighbours of that Community standing together, the poles would not have been taken. Unfortunately we have lost OUR balls....
