  • If there is room for a car to pass on the left while the vehicle in front is turning right that's perfectly okay for the car to make the pass. Same applies to a bike. The van turned into the path of the motorcycle so in my view was 'at fault'. Assuming you both had insurance, what was the outcome of your claim?

  • I'm a biker and it was purely an accident in my eyes. Driver couldn't see you behind that car and you obviously didnt see him as you carried on going. Unfortunate accident I say.

  • maybe could have moved to the left to give a better view of the road ahead but the truck did come out to quickly.

  • If you look at the video closely. The guy with the van was supposed to yield behind the dotted lines for traffic coming in the opposite direction. The video footage clearly shows that the drive went straight across.

  • Some comments are confusing me, it wasnt the guys right of way who swerved out in front. In the UK an insurer would split liability but ultimately the van would take the majority for not seeing the bike coming up the road earlier. Its just one of those lapses of concentration causes accident moment. Be happy they had insurance and he shared the experience. Most arses just drive off or sue for huge amounts.

    I'm from the UK. This would be the guy on the bikes fault. You can't overtake a vehicle on the left. What happened here is one of the reasons why. There's no way the guy in tha van can see a bike coming out from the left as the vehicle in front is hiding him.

  • @778Ash Sorry I should have explained, i work in insurance and the highway code says you can overtake on the left in a situation where a car is signalling to turn right. I can link etc if you need me too. But it specifies only if its clear and thats it. So it was clear and his right of way but he hid himself, hence why fault would be split but still sit with the van driver. Does that make sense?

    No, but you can't hide behind the car in front and then jump out and expect everyone to know that you're coming. I guess fault would "technically" be split but as a motorcyclist you're likely to come off the worse in a collision so you'd think he'd take a bit more care.

    Please do yourself and everyone else a favor by reading the other comments before you start insulting people for no reason. It states in the road traffic act of South Africa that if the car infront of you indicates he intends to turn right, it is legal for you to pass on the left side provided there is enough space to do so. If you don't believe me, look it up on transport.gov.za - it is Chapter X - Rule 298

    Yes I am an inexperienced rider, only have about 2 years behind me, but we all have to start sometime, that does not make me an idiot. And that does not change the FACT that the truck should have given way to oncomming traffic and only have turned when he knew it was safe. He also ignored the yield sign, and broke a number of other traffic laws. Which makes him the guilty party. So please, think before you post.

    The rule quoted here is basically the same as the UK rules, you should be embarrased for even suggesting it.

    I have showed it to the cops already, they have said what I did is legal. I have stated numerous times already that I have checked the rules and that you are allowed to overtake on the left if the car infront has indicated he intends to turn right.

  • In most European countries the vehicles must:

    -van: if there is an 'stop' signal, stop imperatively until get visibility.

    -4x4: stay on the right side of the lane if want to turn right.

    -motorcycle: if there is not loss preference signals on his way, can carefully use the remaining part of lane to pass the 4x4 to promote the traffic flow.

    but my country does not encourage people to remember these traffic rules. watching these videos I think it's the same all over the world

  • All I can say is that would not have happened to me because anticipation is key when riding and you always have to expect the unexpected in order to have a chance at avoiding this type of shit. My time on the pavement has taught me that. Along with the fact that drivers are assholes when it comes to sharing the road with bikes. So just like boxing protect yourself at all times even if it means breaking the rules because your safety is first. Glad to see you're ok and stay on 2 unless you are DS.

    The only thing I did "wrong" is to not anticipate that there might be a car turning across my lane. That is not breaking any road rules.

    The truck however, did not cross the mddle line of the road he was turning into before beginning the turn.

    He did not make sure it was safe to turn or give way to oncoming traffic, who, in every country, have right of way.

  • At first I thought it was your fault but then I looked at it some more and realized it may not be. The large truck should've waited until it had a clear view in order to make the turn. You did approach the intersection a bit fast though considering you couldn't see ahead of you. I'm glad you seem to be ok though.

    -On a one or two way urban road where the road is wide enough to do so"

    I know the laws in America/Europe etc. are different, but here in South Africa it is perfectly legal.

    "Turning right into a two way road:

    - Cross the centre line of the road you are turning into, BEFORE you begin the turn."

    This guy was already drifting into my lane before the street he was turning into even started.

    And in any case, the cops have already seen this video, and they agree with me. So no use arguing about it.
