The point is that Bill O's opinion doesn't really matter and he attempts to justify terrorism as an act of war. In reality it is a tactic used by individuals or groups, whether foreign or domestic, to fight back against goverment oppression. The Executive branch of the US government can now deny due process of law for anyone whom they determine to be a terrorist (aka. Enemy Combatant).. Again, that person being foriegn or domestic.

I live a mile from the dc border. I lived here during 9/11. The 20th highjacker was tried in this area. I would have no problem with anyone being brought this metro area for trial. I understand the emotionally reaction to the situation. But KSM does not deserve a tribunal...IMHO. He's not a solider of kind and doesn't deserve to even be looked at in that manner. A military tribunal would do just that.
