Did Keene get the consent of the patient to post this video on YouTube? If not, HIPPA has been violated and lawsuits may be justified. I would have just asked one of the police officers to remove Keene from the scene as he was interfering with patient care. Because the EMT was obviously becoming upset, his heart rate increases, his blood pressure increases, his respirations increase, and judgement is affected. Better scene management and not being a dick probably would have helped.

Should the Capt have taken the camera from the fellow... no. Was it a better thing to do then punch him out (which cameraman deserved)... yes. What should have happened? The Capt should have requested PD remove the cameramen to a safe distance away from the scene for impeding the proper care and transport of his patient, as well as for causing a disturbance. There was no brutality, the videographer is just a whiner...

The first thing we need to do in an emergency situation after ensuring scene safety is clearing the area of all bystanders so we can get to the patient. If we can't focus on what we are doing, we aren't rendering the best treatment for our patients.

@sjao666 Nope! You are not entirely right about this. I worked as a HIPAA compliance manager under a few Safety Officers that were also lawyers for the county. I can tell you that yes the patient has rights but in this situation (watch both videos) it does not stand! Also the EMT has no right prtending to be able to enforce any civil rights here and in fact has to worry about his own actions and not the press. He has no right to pretend he can inforce to anyone else.
The EMT had every reason to act the way he did. The man was violating patient confidentiality. In most instances, EMTs aren't even allowed to tell the police a lot of information without a subpoena.

If you want to express your freedom of the press (by videoing) you should remember that you are not supposed to change the situation, just report it. Don't get in the way (especially of people doing their job...even if you don't like them or their job), don't shout things out, don't shove cameras in people's face. The EMT was wrong. No doubt! In his defense, however, he really thought HIPPA was involved, and he was acting in what he viewed as the patient's interests.
If HIPPA were to apply here than I would think it would also apply to the release of any medical situation or condition in regards to many other incidents that happen in public such as automobile accidents, injuries sustained during an arrest, etc. Also, if the man really feels violated and the police don't wish to pursue it as a criminal matter, he should consider a civil suit against the person who attacked him and snatched his property.

I'm inclinded to defend the EMT *a bit* (for good intent) because I think he was trying to do what the thought was right for his patient. However, nothing on this video indicates freestaters delayed patient transport--if anything, the EMT did.

The wanna be reporter was interfearing with the EMT's duty. If he was in NC he would have been arrested. All of this could have been avoded if the reporter would not have been nosey. The guy with the camera is a major league prick, he was told to stop and didn't. His camera was taken and given to the police, I personally would have rammed the camera so far up his arse he would have been taking pictures through his nose! The first may apply here, since it appeared the the EMT was trying to bum rush the injured party through and not have him say too much to reporters. Many times EMT's are given leeway in having comitted possible crimes during a run stemming from dangerous circumstances, but stealing this way cannot be considered one of them. The videographer posed no threat to HIM, just to cover-ups.
If you listen to the video, a few requests were made to stop taping before the camera was taken. What about the patients rights? Maybe he didn't want to be taped while he was being treated. The individuals that were taping need to remember it's not JUST about them. And the people trying to video inside the court, what are they thinking? Find something better to do with your time or other ways to make a political point besides created hostile invirements like these.

ridley's commentary on this videographer is pretty good. I understand the video guy's motivations but a bit overzealous. Another point that makes me uncomfortable is the fact that a TRUE medical service being accomplished here. If this were more of a life and death medical situation...nevermind the law,,,there could be serious CIVIL problems from the fellow on the stretcher for interference.

Did Keene get the consent of the patient to post this video on YouTube? If not, HIPPA has been violated and lawsuits may be justified. I would have just asked one of the police officers to remove Keene from the scene as he was interfering with patient care. Because the EMT was obviously becoming upset, his heart rate increases, his blood pressure increases, his respirations increase, and judgement is affected. Better scene management and not being a dick probably would have helped.

The Capt should have requested PD remove the cameramen to a safe distance away from the scene for impeding the proper care and transport of his patient, as well as for causing a disturbance. The first thing we need to do in an emergency situation after ensuring scene safety is clearing the area of all bystanders so we can get to the patient. If we can't focus on what we are doing, we aren't rendering the best treatment for our patients.

@sjao666 Nope! You are not entirely right about this. I worked as a HIPAA compliance manager under a few Safety Officers that were also lawyers for the county. I can tell you that yes the patient has rights but in this situation (watch both videos) it does not stand! Also the EMT has no right prtending to be able to enforce any civil rights here and in fact has to worry about his own actions and not the press. He has no right to pretend he can inforce to anyone else.

The fellow in the "care" of the EMTs is a free stater. That crowd is there defending him. In fact, the phone thief himself was the one delaying care; look at how he fails to get the stretcher into the ambulance.
For an EMT, a habit of stealing is disproportionately bad. How many wallets do you figure disappear like that?

@xaajjaax hey why dont you try and put a stretcher in the back sometimes its easy other times it does not want to lock in right, i should know i have been a volunteer firefighter for 6 yrs due to wear on the locks u have to move the stretcher around. Also its a common thing so he didn't delay care alright god some of you people can be ignorant

If HIPPA were to apply here than I would think it would also apply to the release of any medical situation or condition in regards to many other incidents that happen in public such as automobile accidents, injuries sustained during an arrest, etc. Also, if the man really feels violated and the police don't wish to pursue it as a criminal matter, he should consider a civil suit against the person who attacked him and snatched his property.

This job is not about being a hero, it's about patient care. He delayed the EMT from transporting his patient, thus delaying patient care. I wouldn't expect you to know, or understand, or even try to understand. @BostonTransplant1 OMG, do they let you drive? I was an EMT for a brief time, and I know a firefighter and paramedic supervisor. I'm inclinded to defend the EMT *a bit* (for good intent) because I think he was trying to do what the thought was right for his patient. However, nothing on this video indicates freestaters delayed patient transport--if anything, the EMT did.

I talked to officer bowers(the responding officer) supervisor, he stated to me that ian did not follow up and press charges on the emt and that he was satisfied by getting his property back. That if Ian wants the guy arrested he would have to bring the phone into the police department for evidence what an idiot this guy, he clearly stated on video that he wanted the guy arrested

I heard someone say in the video that the patient was not identified. Well , you have had 4,310 views. Out of the 4,310 views I am sure someone knows him. The wanna be reporter was interfearing with the EMT's duty. If he was in NC he would have been arrested. All of this could have been avoded if the reporter would not have been nosey. It may be public property, but it is not "do what you want to do property!!!!!"

The guy with the camera is a major league prick, he was told to stop and didn't. His camera was taken and given to the police, I personally would have rammed the camera so far up his arse he would have been taking pictures through his nose! The first may apply here, since it appeared the the EMT was trying to bum rush the injured party through and not have him say too much to reporters. Many times EMT's are given leeway in having comitted possible crimes during a run stemming from dangerous circumstances, but stealing this way cannot be considered one of them. The videographer posed no threat to HIM, just to cover-ups.

If you listen to the video, a few requests were made to stop taping before the camera was taken. What about the patients rights? Maybe he didn't want to be taped while he was being treated. The individuals that were taping need to remember it's not JUST about them. And the people trying to video inside the court, what are they thinking? Find something better to do with your time or other ways to make a political point besides created hostile invirements like these.
