I work at a McDonald's that started doing renovations as well, though we didn't have as much of a mess problem as you guys. All the construction was outside, and the problem I had with it was the noise levels. At least they officially closed yesterday to finish construction. They should have closed it earlier, the construction kind of ran off business to say the least.

The dust on the coffee lids should have been cleaned regularly by whoever works the front counter at night and in the morning--that's not Wendy's fault. BUT, the store should definitely been shut down while it had its back room under construction and the store properly cleaned up before re-opening. Poor management by whoever money-grubbing person owns the store.
If I was to open a restaurant I would want an entire crew of folks just like you. What about employs breathing all that Mold Wendy? Where was the Health Department? I worked at a McDonalds that was open during construction. We all came to the same conclusion, it was a huge violation of health codes. Did my owner shut down? Nope! Well, we did shut down for two weeks towards the end of construction...

There was mold in an apartment next to where I used to live in, that building no longer stands because that's how you generally deal with mold. This is disgusting, good thing I stuck to China Garden in Olean.

"Slow" people manage these places since they are complacent. They are generally sloppy, lazy and don't have much in the smarts department. Since fast food often hires elderly and mentally handicap people, alot of sexual abuse and molestation goes on with the management- especially in the back room. The general employees are paid terribly and usually work in unsafe conditions, ie- hot grease traps and slick floor. Certain "special" (Chilli)menu items are made with unsold/old meat.
@reneewill black mold, construction, large holes in the floor are all hazards that go well beyond the "and other duties as assigned" that is standard on all job descriptions when someone gets employed somewhere. It's extremely easy to "Monday morning quarterback" but I'm sure that had you been employed there, you wouldn't have been too eager to do contruction, clean out that hole or scrub black mold either.

Omg! I used to live in Salamanca and Little Valley when I was growing up and now live in Nashville. And I can remember that same Wendy's when I was younger. When my younger brother was born, we ate there while my mom was at the hospital and I got food poising so not kidding.
I wondered wtf was up when I could see bare wall studs through the drive through window. :( This is going to be hard to fight, though. There's a lot of cronieism in local politics or another very popular but "fancy" restaurant a couple blocks down from you would be shut down too. Talk to the Health Inspector, but get the news involved here too. Maybe call the mayor's office directly? Do you have documentation from asking management about the hole, etc.?

As a Health Inspector, I see plenty wrong here. Firstly, if construction is going to take place, especially involving taking up the floor, the store must close, no questions asked. That should be a no-brainer. I don't know the whole story here, hopefully you took your concerns to your manager before taking the video. Regardless, this is a great example of what can go on if nobody is holding the managers accountable. Good work! I wish more people were this interested in health & safety.

I worked for ClearChannel (Radio), we found mold in one of our studios. They closed half the wing and had it covered in plastic while they fixed it. We had two air rooms off the air. And that had nothing to do with food. I cannot believe they allowed food to be prepared in this condition.
I hope this video goes big. It's gross and I probably won't eat at Wendy's anymore because I hate germs. The city where I live does a lot of restaurant inspections and posts the results online. A Wendy's like this wouldn't last long.
I wouldn't go with a lawsuit, because there probably wouldn't be much to get out of it. If you know of any lawyers who will meet with you for simple advice pro-bono they would definitely be worth getting in contact with. Maybe they will see an opportunity.
At the very least, this should be reported to the department of public health. I sure as hell wouldn't want to eat there not knowing that this stuff was happening behind the scenes. Get this place shut down until they clean it up.

We tore down a KFC once and roaches dead and alive were 6 inches deep in the walls. Remodeling Kroger and Walmart stores we found rotten food and dead mice under the coffin coolers. I've seen a lot more too, but realize no place that sells food is going to be laboratory clean. Pull your stove out at home and take a good long look.

Dude, that is some messed up stuff. I used to live in Olean, and went to Wendy's quite a bit. That makes me ill.. As for the lawsuit, call Carr & Saglimben and see if they will take your case on.. They are just up the road there from Wendy's.

I have held every position possible in professional kitchens over a 12 year career and I have never seen anything close to this deplorable bullshit. I know this a Wendy's and not Spago, but c'mon. He was hired to flip burgers NOT to clean out the inside of the walls. Pretty sure he was hired to 'drop fries' and NOT to be subcontracted to perform construction on the damn filthy hole in the floor. There was mold in an apartment next to where I used to live in, that building no longer stands because that's how you generally deal with mold. This is disgusting, good thing I stuck to China Garden in Olean.

"Slow" people manage these places since they are complacent. They are generally sloppy, lazy and don't have much in the smarts department. Since fast food often hires elderly and mentally handicap people, alot of sexual abuse and molestation goes on with the management- especially in the back room. The general employees are paid terribly and usually work in unsafe conditions, ie- hot grease traps and slick floor. Certain "special" (Chilli)menu items are made with unsold/old meat.

@reneewill black mold, construction, large holes in the floor are all hazards that go well beyond the "and other duties as assigned" that is standard on all job descriptions when someone gets employed somewhere. It's extremely easy to "Monday morning quarterback" but I'm sure that had you been employed there, you wouldn't have been too eager to do contruction, clean out that hole or scrub black mold either.

Omg! I used to live in Salamanca and Little Valley when I was growing up and now live in Nashville. And I can remember that same Wendy's when I was younger. When my younger brother was born, we ate there while my mom was at the hospital and I got food poising so not kidding.

I wondered wtf was up when I could see bare wall studs through the drive through window. :( This is going to be hard to fight, though. There's a lot of cronieism in local politics or another very popular but "fancy" restaurant a couple blocks down from you would be shut down too. Talk to the Health Inspector, but get the news involved here too. Maybe call the mayor's office directly? Do you have documentation from asking management about the hole, etc.?

As a Health Inspector, I see plenty wrong here. Firstly, if construction is going to take place, especially involving taking up the floor, the store must close, no questions asked. That should be a no-brainer. I don't know the whole story here, hopefully you took your concerns to your manager before taking the video. Regardless, this is a great example of what can go on if nobody is holding the managers accountable. Good work! I wish more people were this interested in health & safety.

You are awesome for not just turning a blind eye to this problem. I think Wendy's should have promoted you for this rather then firing you. I worked for ClearChannel (Radio), we found mold in one of our studios. They closed half the wing and had it covered in plastic while they fixed it. We had two air rooms off the air. And that had nothing to do with food. I cannot believe they allowed food to be prepared in this condition.

I wouldn't go with a lawsuit, because there probably wouldn't be much to get out of it. If you know of any lawyers who will meet with you for simple advice pro-bono they would definitely be worth getting in contact with. Maybe they will see an opportunity.
At the very least, this should be reported to the department of public health. I sure as hell wouldn't want to eat there not knowing that this stuff was happening behind the scenes. Get this place shut down until they clean it up.

I actually worked at this wendys over a year ago, they werent doing construction then but it was SUCH a mess then too, there were fire hazards everywhere, even broken sockets out in the lounge. there was so much messed up with the store, i hated it soooo much. i was thinking about reporting it but i didnt want my co workers to have to deal with that after i left.....

We tore down a KFC once and roaches dead and alive were 6 inches deep in the walls. Remodeling Kroger and Walmart stores we found rotten food and dead mice under the coffin coolers. I've seen a lot more too, but realize no place that sells food is going to be laboratory clean. Pull your stove out at home and take a good long look.
