That would be a violation of the Civil Rights Act, and yes his business subject to that law. It's no different than if he put up a "whites only" sign and refused to do business with minorities. The Federal Civil Rights Act guarantees all people the right to "full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, without discrimination or segregation on the ground of race, color, religion, or national origin."
Texas can in fact revoke his license for discriminating in such a manner.
