The law is that it is only trespassing if you have been asked to leave first and refuse to do so. He did agree to leave and was in the process of leaving while he was arrested.

Posting a piece of paper in 14 point font near the door of an area usually open to the public certainly creates reasonable doubt weather such a paper was a statement he should have been aware of, that a reasonable person would have seen, read and understood to exclude them.

A precept of common law is that you do not cause harm or loss. If you were to occupy an old decommissioned missile silo, then that would be fine.

However if you were to occupy an NHS operating room you would clearly be causing harm.

The authorities are supposed to work by common law, however they would prefer if you'd just do as they say, which may in turn cause you harm or loss. If for example, there was a nuclear war and the president was taken away to a bunkar, but you werent.
