0:44 is where she fell down. It's a sheer drop onto rocks after the small ledge, unlike the rolling grassy stretch beside the deck. So yes, you could. Especially someone as small as her, with very little body weight, reaction time, balance, and strength.

I agree there should of been an appropriate fence for such a dangerous area. Yet the parents were oblivious to a very obvious danger of a child falling through that gap. And yeah I would still sue for millions. :)
