well I have no idea what these congressional hearings are about. But what I do know is that the 5th is there to protect first and foremost innocent people. If the government has enough evidence to prove guilt of an individual then it should be brought forth to the grand jury.
Citizens have no obligation to prove their innocence. Have you ever seen any of those cop dramas where they talk to people who are somehow associated to an investigation. You have no way of knowing how the police will interprate what you say in evaluating your guilt or innocence. So I would never talk to the police/government even though I know that I won't be involved in some type of capital crime.
But even if I was, the government has the burden of proof in proving the guilt of an individual. Check out the videos on youtube by searching, "don't talk to the police." explicitly the lecture by the lawyer/professor who explains fully the history of the 5th and the reasons why talking to the police/government cannot ever be helpful. However, the point is that this was an example of the 5th being used to cover up multiple crimes for over a decade. In that issue it indicated guilt.
