It also depends on the circumstances, who are they playing, are they friendly or hostile. would they have walked, how far are they in, is it crucial that he stays in etc.. Cause in these cases its easy to say f¨*ck ethics, and its more about survival.

That was indeed a clear deflection and he was out but at the end of the day, it is the umpire's decision. On many occasions, a batsmen is given out when he is not out and vice versa so it goes both ways.
