U can get the weapon by 3 ways. Someone gives it to u, u buy the DLC or u can get it urself.

No you don't have to download to get it, just the easiest way.

By the way, I think you weren't on insane dude, that's how you get it, he never dies on normal story mode.

No one has confirmed he drops his scepter or anything else when he dies, the only way to get it is by trading with someone on live.
