Pros put buildings over turrets all the time when they're being built. It's not illegal at all.

They just don't keep the ebay/rax there because they use it to spot troop movement later

it's not illegal, to have a buildung above your turret, it's only illegal to use the observer-turret-bug: when you put an observer directly over a turret under construction, the turret won't shoot after it is finished.
