    It could be pointed out that all you were doing was listening for radio signals, not actually connecting to anything, but given his obvious lack of cognitive ability, he probably wouldn't get the distinction.

    And just by telling the officer what you are doing in the neighborhood, you just incriminated yourself which gives the officer evidence to use against you in court and gave up your fifth amendment right. In fact anytime an officer wants you to tell him/her what you are doing in this neighborhood then tell the officer "I refuse to answer and am I free to go." Also lock your doors and tell the officer that I refuse to unlock the car for you have no right to search my car.

  • the officer if he/she is a corrupt officer may arrest for refusing a search or refusing to answer questions but the refusal to answer or refusal to a search will not be admissible in court as evidence.

  • Wardriving is not a crime. If an access point is open to where someone can just connect to it and browse the web then that is not a crime. The only thing that is a crime is if the access point is secure and someone hacked the password and broke into it. If the ownwer of the access point does not want other people to connect to it, then all they have to do is secure it with a password or passphrase. They should not call the police if securing it resolves their problem.

    And also if the police officer ask you a question, do not answer it and always tell the officer that you refuse to allow him to search your car. You cannot get arrested lawfully for refusing to talk to te police officer and for refusing a search as it is your fourth and fifth amendment right. In fact you cannot legally be arrested for refusing to respond to a police officer.

  • Plus, it's been argued that not securing a router, and or turning off security enabled by default is "effective consent" that term "effective consent" can be interpreted very broadly indeed. the law in my state is actually stricter, but I think it would be easier to defend against because it's just too broad

  • Your argument could be interpreted as,,,,,if you leave your front door unlocked, you have given me effective consent to enter your home. Texas law is well defined and there is no defense. It is unfortunately, a white collar crime which isn't taken seriously.
