  • Thanks for sharing... I can see this was very hard for you. Your baby is BEAUTIFUL... try to remind yourself for what you are lucky for instead of dwelling on that terrible tragedy. God knows good, and he will carry you through these hard times. You will begin to build a nest egg again, and you will be that much more careful with how you invest.   • @maureen1002 yeah thats a sad thing when you lose money with a firm that invested thier money which is your money with madoff.......i invested with madoff 1500000 dollars and withdrew the money inafter one yr....thats in 2001 when i persistently asked them to tell me about where my money was invested and how....ignoring my questions and brushing me off was the decider and i pulled out all....i am willing to give back the 150 grand i made to charity if need be but not to any of the victims

  • I don't like prison-beatings etc, I think it's very negative for the justice-system.

    However, these rules do not apply to the financial crooks. Madoff is sadly nowhere near the worst off them. I think every financial crook, like the Enron-guys, the bastards Goldman-Sachs etc, they all deserve the beating Madoff got.

    Most people in jail had very little. These men had "it all". They had millions of dollars, but that just wasn't enough. That's what makes them the scum of the scum...

  • You are quite thick! Obviously the two are NOT mutually exclusive. Obviously Tila Tequila can draw attention to a serious issue like molestation, and still be an internet attention whore.

    Sure you can do both, but many people find that "me, me me" element off-putting. That is how I felt when I watched "coolmom", just another needy housewife with more time than brains.

  • She learned an invaluable lesson: she learned that she would have been better off if she were happy what she had.... and just kept it. I am so tired of hearing about these "victims". Madoff didn't put a gun to their heads. He simply outsmarted them. They WILLINGLY gave that man their life savings with the hopes of getting something for nothing. Am i wrong for thinking this way? Does social Darwinism not apply?

  • I have been seen a lot of Madoff victims speak out and I feel for all of them. However, for some reason your's hit home the most for me. Maybe because you were not acting like a victim and trying to be so strong and at the end when your voiced cracked, I got choked up. Stay strong, but you seem like a winner.   • I understand the media did not make a big deal of this (actually, they made no mention), but the ultra rich "victims" in the Madoff scandal will be fully bailed out by the US taxpayer.

    They will be able to write off every single tax dollar they have to pay forever by the amount they lost -- dollar for dollar.

    For example, if one lost $1 billion and is uber rich, making $500 million per year with an annual tax bill of $100 million, he will pay zero taxes for $1 bill / $100 mill = 10 yrs

You are correct in the sense that there is a dollar for dollar write off that will result in these people getting tax dollars back based upon the rate they paid. However, not to be forgotten are the tax dollars most of them paid on phantom income. Most people not only lost their investments, but paid income taxes on money never received. Getting their own tax dollars back that should never have been paid.

  • The so called "sweet heart deal" was written broad enough to allow for any Ponzi scheme type victim, not specifically Madoff, though unquestionably it is because of Madoff this happened. In the past, there would be a write-off but it was far more difficult. The question in my mind is, if this unfortunately happened to you, what position would you be taking?

The IRS has always recognized theft losses before; this is nothing new. What is new that the IRS, recogizing the complexities of this case, passed guidelines (not new laws) to simplify the filing of the theft claims in order to streamline the procedure and not have people of any financial level have to wait years (continued)

  • ... to receive tax dollars paid in "error." That "safe harbor" gave Madoff victims an easier way to file, but they also gave up certain taxpayer rights by doing so. I think that this is "hush hush" in the media because it is rather bland and not very well understood. Getting one's tax dollars back when paid in error (by deception) is not something that should cause a taxpayer revolt against Madoff investors. The IRS should have no right to keep tax dollars that should never have been paid.

  • Firstm off, the rules were changed to allow the Madoff investors to get back all of the taxes they paid on the phantom as the timing rules and limit amounts were removed for these guys. This got some publicity -- but was spun in the media as fair as opposed to special. Maybe it is fair; but nobody else ever got this treatment.

    The next step which allows them to recover ALL of their losses via the US taxapayer (via non payment of future federal income taxes for 20 yrs) is quite secret

    However, they will now be getting paid back all of their money that they lost by investing with Madoff. All of it. The hell with pensioner who lost all their retirement income -- but the uber rich will be paid back by dipping into the pocket of the US taxpayer.

  • You are correct in that the 3rd party people who were indirect investors are getting treated like 3rd class citizens are getting a raw deal so far. Hopefully that will change. Nobody though is getting back everything they invested. They can deduct the loss, yes, but the money comes back at the tax rate they paid it at. A person in the 40% bracket will get back 40% of the loss, not 100% (or dollar for dollar). Just not true. Taxes paid in error by anyone, should be returned.

    It is all on the quiet, but the wealthy investors will get back 100% of the money they invested via non payment of future taxes. this has never been done for anyone before and the law was written in such a way that it applies to nobody else.

  • Nobody is getting back 100% of the money invested, only the tax affects of the loss. Please read the safe harbor guidelines and the tax laws having to do with theft losses.

    Regarding SIPC, its a matter of who you speak to. Congress has changed nothing with SIPC rules. Madoff victims maintain that Picard is not following the rules that have been followed since its 1970 formation, while Picard maintains he is just doing what is "fair and equitable." To date, no actual rules have changed.

  • Oldjoe: I will give you the benefit of the doubt here, so let's assume that I am unaware of a law that "quietly passed in Congress" and you are aware of it. So that I don't go around saying things incorrectly as I may have been doing, are you able to tell me what Congressional law that was passed, or a link for it? For my part I can tell you that there are 3 bills that are still in committee with just a few co-sponsors, but none of them have a chance of passing at this time. Please help me.

They can write off dollar for dollar, yes, but then it depends upon the tax rate as to what they can get back in taxes. Thank you.

    UIt had something to do with extending a loss provision that is used strictly by corporations to these individuals and greatly increasing the time limit over which they can apply it (beyond what corps can do).

    The wealthy Madoff investors are the same people who basically own and run this country and they are not be proponents of everyone being treated the same

    The US government can not keep printing money to bail everyone out eventually foreigners will stop accepting the dollar. Once that happens the dollar will end like your Madoff investments.

  • First of all I don't appreciate your comments about husbands. They are cynical & rude. I married the love of my life. I guess you had alot of fun when you were young and then went looking for a sugar daddy that you now denigrate!

    Now he's the one who doesn't have two nickels to rub together. What's wrong with believing a smart young man and getting wealthy together so you can both sit on the cruise ship balcony with him years later and relish the hard work and it's rewards.

  • oh hun I am so sorry that you were a victim of madoffs. I will tell you that 9 years ago we lost our car, house and boat due to a bad loan deal that we got into. I was 2 months along at that time and I lost the baby. I looked around and I seen that I still had my husband, and my 2 year old and I knew we could get through this. We are just now getting back on our feet. We still rent, our credit is still bad from the bankrupy but we are ok we are still a family. this will pass

    the only thing closest to that was when my dad was jobless for 3 years and we had to sell the motocycle. and my mom had one miscarrage also but she was only about a month into, before I came along. godbless your family!

  • We are in pretty much the same position. Having to lose both our business and our home. (and I'm 9 months pregnant with our first child) So It's very hard, and I see and hear your emotion. But I can tell by watching your wonderful videos, that you are the kind of person (like myself) that will turn this into an opportunity of some type. "A setback is only a setup for a COMEBACK!"
