@sniping12 You can do it too sir. Learn your rights and in this case, your state laws for identifying yourself to officers. States vary in this respect. If you truly know your rights and use them(not just to be difficult) officers will be less apt to try and take advantage of you. Remember, they love ignorant citizens.
Wow this is Really Sad ... nobody has done anything wrong. yet you cant work with the officer. simply by giving your name and stating that your gathering evidence of.. whatever for whatever cause? its no wonder things have gone so wrong on such a large scale when the world has people like you who have the need to fight against the masses rather than lead by example. everyone EVERYONE has an obligation to be transparent and honest in their actions.
@MortifiedPenguin0319 - everyone also has the right not to be harrassed. It's none of his business what he's doing, unless the PEACEofficer sees that he is breaching the peace. Nobody has any obligation to be transparent if they choose not to be. Some people are very private and choose to remain so.
your wasting the officers time by not confirming for him what he wants to know. do not like the way he does his job.become an officer and do it better yourself.but until then you should still answer his questions honestly.he's the officer and your the civilian. like i say its no wonder peopleof power abuse their power when the people they protect, treat them like crap.the line between honest and dishonest becomes blurred when you have people like this who are innocentbut still refuseto co-operate
@MortifiedPenguin0319 It's called America. We can do things like that. In New York State a cop cannot request any information unless he has a specific and articulate reason for the request. Our Constitution keeps us safe (or it's supposed too) as does the Federal Constitution. I do agree a line would become blurred, but it would be the line between privacy and invasion of privacy by the government if citizens do not stand up for their rights.
@MortifiedPenguin0319 Under your argument where would the line be drawn?? What if they just want to know whats in your pockets?? What about in your car?? What about in your house?? Oh Mr. officer ya know I guess since I am doing nothing wrong, I don't have anything to hide, why don't you come check me out in the shower while your at it.... I mean you just want to inquire, that's all right??? Give it a little more thought next time... Where is your line??
@MortifiedPenguin0319 So, you are saying if you are 'innocent,' you must co-operate. I like that word-'co-operate.' Their authority lies in enforcing the laws, period. If you are NOT violating or suspected of violating a law; then it is very clear, they have NO AUTHORITY OVER YOU. What part of that do u NOT understand? The cameraman was not being rude until the LEO continued asking for ID. How does that song go,, hmmmm "land of the free." Is it really, think about it
@MortifiedPenguin0319 The reason police abuse their powers is BECAUSE so many are ignorant of their rights and DO NOT USE THEM. They expect everybody to just comply with all their requests and when they meet an informed citizen they can get a bit testy. SOME, are adults and will respect your rights. I have had encounters with both.
saw this thing on a joke site it said: a cop just pulled me over and said papers and I said scissors I win and drove off! thought it was funny enough to share!
@RP4409 Cameras and open carry (where legal) are annoying to LEO(s). Some cops see these things as a challenge to their "authority." They don't want to face up to the fact that we the people are actually in charge. They are paid (by us) public servants. Society has allowed them to forget that their job is to protect the rights of the individual. Blind obedience, and gestapo tactics for failure to immediately "comply" are not part of that protection. Great video. Thanks!!!
@RP4409 It would vary by state. I don't have to in MT unless operating a motor vehicle, probably the same where you are. Why don't you stick with logic instead of asking the same question over and over? You say no. Tell the cop to leave. End of story. Tell him it's none of his business why you are taping. It's legal and that's all he needs to know. Get his name and badge number, his supervisor and threaten to sue his ass if he doesn't leave. The same question over and over is annoying.
@mitchboo1984 The cameraman wasn't bothering anyone. He was filming in public as was his right and the cop began bothering him - not the other way around.
No crime, no police interaction. Plain and simple.
This would have all been fine with me if the cop hadn't detained him (he told him he wasn't free to go which is the embodiment of a detainment).
@Rayven10 look at this from a different angle. What if a member of the public or a resident nearby was made feel uneasy or uncomfortable by someone video taping them? Do they not a right to report it to the police that they think there is some freak or some nutcase video-taping people? Now if that person does genuinly feel the person is a f*cking nutjob video taping people then they should report it and it should be investigated, and not be abused by some jumped up conspiracist
So are you telling us that your "feelings" override the rights of the public?
So in your world anytime someone feels "unconformable" pirates can be called out to remedy the uncomfortableness?
So, since you feel uncomfortable with a person holding camera and obviously unaware you can just WALK AWAY your willing to send thugs out with guns to accost an individual who did nothing to harm you?
I think the nut-case conspiracy theorist is yourself.
@RP4409 no you absolute twat, what i am saying is that any officer of the law should be able to respond to calls where someone feels threatened by some randomly video taping in public without being spoken to in the manner in which he was spoken to, which was disgracefull. Secondly they are not pirates they are police officers, have some respect.
@mitchboo1984 In AZ one doesnt have to identify themselves to law enforcement unless an officer has reason to believe a crime has been, is being, or will be committed. You can look up the ARS statute if you like. This means the guy doesnt have to identify himself period, nor should he. Officers can ask you any question and make any REQUEST they want but YOU as an American citizen do not have to comply. As you see the guy did not turn off his camera....excellent call.
@mitchboo1984 (second part) Furthermore, I have had my rights violated by an illegal search of my vehicle after telling the officer I did not consent to a search. I am a law abiding citizen with NO criminal past. I was even placed in the back of his car for standing up and telling his partner to tell him to get out of my car I didnt consent! NOW I know ALL my rights and use them everytime. I thank that asshat for showing me their true colors and making me learn my rights. Cheers.
fucking faggot, you have nothing else better to do than videotape people driving bye? of course the cops are going to come dumb ass, your looking for attention and then you get it but then you bitch about people bothering you, GET A LIFE.
As SOON as he said you werent being detained you should have peaced and watched his dumbass then call you back saying your now detained ( for no reason).
@curtisw2007 He doesn't provoke anyone. They try to mess with him, he knows his rights and is not afraid to express it. If you think he is provoking people you clearly have never had any of your rights violated by these goons.
You need to work on your answers. I mean, you stuttered and often times sounded like you were drunk. That'd raise anyones suspicions. I bet if you had said "I'm just videotaping for a youtube video" he'd have probably left you alone. And if he didn't, you'd have a real case of police harrassment. The way you acted helped push the situation further then it needed to go, so perhaps you should take a look at your own actions as well.
@RP4409 Wait, at one point he siad you are not detained but you are not free to go. Doesnt that mean you are detained? WTF. I would have just said"Am I being detained""No"drove off. If I would have later gotten convicted for evading police,I would have used the tape in my defense."When your not arrested but cant go, it means your detained. You werent arrested but you couldnt go,therefore, you are detained but the officer lied to you.Lawyer files motion to suppress.Judge sees tape charges dismissed
............your papers please. Under Obama's NDAA, you might be arrested and flown to a detention center for this. amerika is going byebye.. we need Ron Paul 2012
I am a former military police officer and civilian law enforcement for a combined total of 20yrs and I am slowly starting to realize how people's rights are being (or better yet have been) taken away. And very true, if you are NOT being detained then you ARE free to go! When I first began watching 4409's video's I believed this man was an idiot, but after seeing most of them, I can say from a Police Officers view point that he is well within his rights to act the way he does without consequence.
why do they need to know who you are ?? he should assume just by the way you were speaking to him that you werent a criminal ! come on police stop the power trip please for americans ,,for your country
The officer was right to let you go, even though I would have suspected you for casing a house to rob. You were right to stand your ground. Micro policing is horrible. I believe in what your doing, some of the better educated in law enforcement ALSO believe in what you doing. Its movements like 4409 that bring awareness to the public AND the officers alike, Remember-neither you nor the officer is the enemy-it is the INSTITUTION that under educated officers in the law that is at fault,
>> some of the better educated in law enforcement ALSO believe in what you doing
>> Remember-neither you nor the officer is the enemy-it is the INSTITUTION that under educated officers in the law that is at fault,
-- Your entire comment is probably among the top 5 I have ever read in a comment blog on YouTube "patriot-geared videos." I read comments often & often 5 pages deep. Way to say it profoundly without injuring the pride of police officers in whole.
I agree know your rights and stand your ground but don't be belligerent. He did detain him though. Most cops are not educated on these rights or the law sorounding them. I think every cop should have to go to classes on a periodic basis , so that they may be educated on the subject.
@shirtnought420 I think you need to get your facts straight. Federal wiretapping regualtions state specifically that events and or conversations, held in PUBLIC, are not considered private, therefore, the expectation of privacy for acts or conversations held in PUBLIC garnish no protection under the privacy laws, unless specified by the individual states in which the recording took place. Not to mention, the cop is a PUBLIC servant, so he is fair game. Do a little research.
You are idiot. You are looking for trouble. I hate to piss on the soap box your preaching from, but you can leave the USA and all of its laws at any time. Go to a nice communist country and see how it goes. In Russia the police would have beat the $#!t out of you for talking back like that. You and your parents are failures. Go get a job and contribute to society or get the fuck out of the country.
@shirtnought420 "Dissent is the greatest form of patriotism." You know who said that? This country wasn't founded on the idea that it's citizens should roll over on command. If you don't feel the need to have rights and exercise them. Then you get the fuck out of the country.
The crime is that you are a fanny.....Dobber...Fool.. and you need to stop trying to wind the guy up.... Dont you know what goes on in your own back yard? Checkpoints are their for security reasons... Guess you live in a tree and want to move back their some time soon.
@Ronzomac "Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety." -- Benjamin Franklin. Fuck your Police Checkpoints. I do not wish to be interrogated as I am minding my own business as a productive member of society.
At 1:46 you responded angry and raised your voice. You need to get some respect for people that lay their life on the line, the military, swat, navy. Or are those just more government pigs to you? Fuckin joke.
RP4409, I just started watching your videos, what you do is awesome. I would like to help expose the government to, but what legal ramifications could I get into? I can't get arrested.
Man you are such an idiot. Why didn't you tell your fucking name? Fucking idiot! There are a lot of good cops out there and THAT cop got some serious patience. You suck so hard! I hope you to get your ass beaten by some angry cop. Oh yeah, and FUCK you to the bone. Beeech!
Strange defensive, defiant attitude against a very polite policeman. He was uncooperative and hostile before he even left his house in the morning. He really sees no value in respect towards those who put their lives on the line everyday, respect to those who help bring order in society and who serve and protect the public. Did he purposely set out to provoke the police? It appears that way.
What....writing revenue generating tickets? They shoot you at the drop of a hat THAT is not risking your life...any thug with a 9mm can do what police do now.
@RP4409 Now I have to disagree with you on this one.. yes there are corrupt cops, but most of them are protecting the public and believe they are making a difference. Being an officer is a dangerous job and you do risk your life everyday. What happens when someone dials 911 because of a break in, or a robbery? Who shows up? The cops, and they show up with little info most of the time cause of frantic callers, they don't know if the person breaking in has a gun, they risk their lives.
@RP4409 So what you are saying is that police risk their lives for us, but you also said that any thug with a 9mm can do what police do now? No FUCKING WONDER WHY POLICE TAKE IT SO FUCKING CAUTIOUSLY!!! People like you don't get that they are highly trained and don't go just shooting around at people because they didn't do what they wanted them to do! YOU JACK ASS
@memberm Okay, I agree with you on the "He was uncooperative and hostile before he even left his house in the morning." but not all police officers "serve and protect the public."
@memberm This ain't the Bronx, Harlem or Camden, NJ they do not put their lives on the line every day. This guy is fighting for his rights against cops who try to intimidate you to get your information. He had no right asking for his identification due to the 4th amendment. You can tell me the cop was being nice all you want, but he obviously doesn't know his laws and yet he sworn to uphold the Constitution! This is a fight against civil liberties!
Yeah those law enforcement officials are so brave, especially when a dozen of them armed to the teeth and wearing bullet-proof vests pile on top of unarmed civilians.
The videographer is instigating. He's trying to cause an issue. So yes, he could have been detained for public disturbance. Wouldn't have been charged, but could have easily been detained, possibly booked. Remember the law says you can't break regulations and it's the regulations that are most flexible. In short, Ass with Camera guy is an Ass.
People don't see: They see this video and think it is unusually you are taping people like that, but they don't think it is unusual all of the government cameras..
There is only one reason cops and people "in charge" or people that think they have the power to be in charge being video taped and its a simple reason, The want to be able to get away with the abuse they can try to inflict !!
HAHAHHAHHAHA GOOD JOB! +1 FOR THE PEOPLE -1 FOR THE PIGS THEY FUCKING HAAAATE IT WHEN YOU VIDEO TAPE THEM AND THEY HATE EVEN MORE THAT THEY CANT DO SHIT ABOUT IT! HAH!!!!!!!!!!! i love you.
police is the private Army of the rich & ruling class paid for by the American taxpayer. The police will do anything that their Masters ask them to do. Police are armed & retarded they will hurt you & enjoy doing it. They get pleasure of out killing people. The more police we have more crime we have because they create laws to make criminal out of anyone. Because of all the military equipment that the police received from the Army, police R the extension of the US Army to hurt US citizens.
Fantastic job, friend! Outstanding! "I just want to live my life like an America..." I LOVE IT! Put these Nazi fuckers back in their place, baby! Keep it up.
@MrSpedsled And you wonder why people think your a nutjob, because you insult people in what could have been a friendly 'debate', I have my opinions and you have yours, but when I express my opinions you get your panties in a knot and start calling me names. Yeah...everyone should believe you now.
All you had to do is talk to him kindly like a gentleman and be on your way. But no you had to be a tough son of a bitch and fight with a police officer who was just asking questions. You don't see people coming to your job, if you have a job seeing that your video taping people at night, and try to make it harder. Get a life. Let the man do his job, he seemed like a fine officer to me.
@TheDevenrocks You have it a bit backwards, as the cop approached him as opposed to the other way around. But I do agree with you that this wasn't that big a deal. Although, I have seen that when you are polite and compliant with officers, that they tend to take advantage of your kindness. So sometimes it is best to be an ass and show that your not the one to play games with. But I think the cop was just doing his job in this vid.
Yep that is def how scottsdale police act...your lucky u had a camera or he probably would of beat the shit out of u. They are always harassing my husband, my roommate and myself just because we live in a rich neighborhood full of old people that hate us for no reason, we never have parties, make a lot of noise, nothing, we just mind our own business, but I can't even walk to the store with out cops following me,stopping me and asking for my idea, didn't realize it was a crime to grocery shop
I think this cop isn't doing anything wrong you don't really see alot of people video taping in public at least i don't so it was suspicious he could have thought you were about to commit a crime or stalking someone he questioned you and let you go you were just giving him a hard time for doing his job
1. Please show me and example where people were stalked with a video camera in open public besides the paparazzi and/or the government and their 8 million cameras?
2. So, in your world, if you don't see something a lot in public it automatically rises to the level of suspicious behavior and entitles you to accost people?
I believe I've seen your way of thinking in a movie called Minority Report :)
@RP4409 So you are saying if someone is walking around the streets with an ak-47 (thats not something I see in public a lot) we shouldn't raise our suspicion level of that person?
You're trying to make a ridiculous argument. Good try but carrying an AK-47 is not the same as carrying a camera around. When was the last time someone killed someone with a camera?
@RP4409 Im not saying someone has killed someone with a camera lately, but think of some things that have been done that people were waiting to record, such as IED's in iraq, why do you think the military makes them shut off cameras? because in an area where people rarely sit in open public recording stuff it seems odd to do it and when the end result is an explosion meant to kill someone the camera makes sense because they are recording the thing done, and have been waiting for it.
@jessezubke So? You under the Constitution of the United States are allowed to refuse to ID yourself if you are not under REASONABLE suspicion of committing a crime.
@jessezubke You're an idiot. AK-47? Really? Something that is OBVIOUSLY able to hurt and kill people... You're comparing it to a CAMERA?! God damn we have some stupid people in this world.
@RP4409 - Due Diliegence - lets say something did occur, and they hadnt done thier job in checkout this suspect action of a person just standing there taping things, then something had resulted from it....then it would be on the department to explain why they DIDNT ask you questions, why they DIDNT appraoch on your activities.
question:
1) how many people stand around taping everyone? i assume you do not use professional equipment nor are you marked as a reporter of any kind..and at night
uhhhhh I do have professional equipment but that is not relevant and it's easy for the department to explain why they didn't ask me questions or didn't approach me because they had no legal authority to do so.
@RP4409 - you make me laugh. you are arguing law based on your interpreation. Being through some legal things myself, i have come to find that even if it doesnt seem like it applies, they can easily twist or manipulate it to work in someones favor.
@361assassin BEEEP wrong! This is pure harassment. The cop doesn't like the fact that this man is protesting him and he wants to make it known that he has the authority. That is harassment. Plain and simple. Was the cop called to the scene? Did the cop witness a crime being committed or in the process of being committed? No, then he has no business harassing a citizen. PERIOD.
Reasonable suspicion is a legal standard of proof in US law that is less than probable cause, but more than an "inchoate and unparticularized suspicion or 'hunch' ";it must be based on "specific and articulable facts", "taken together with rational inferences from those facts". Police may briefly detain a person if they have reasonable suspicion that the person has been, is, or is about to be engaged in criminal activity;
It's just YOU that doesn't know what a Terry stop is..

Thanks!!!
ohannahdad 3 weeks ago
@RP4409 It would vary by state. I don't have to in MT unless operating a motor vehicle, probably the same where you are. Why don't you stick with logic instead of asking the same question over and over? You say no. Tell the cop to leave. End of story. Tell him it's none of his business why you are taping. It's legal and that's all he needs to know. Get his name and badge number, his supervisor and threaten to sue his ass if he doesn't leave. The same question over and over is annoying.

mitchboo1984 1 month ago
@mitchboo1984 The cameraman wasn't bothering anyone. He was filming in public as was his right and the cop began bothering him - not the other way around.
No crime, no police interaction. Plain and simple.
This would have all been fine with me if the cop hadn't detained him (he told him he wasn't free to go which is the embodiment of a detainment).
Rayven10 4 weeks ago
@Rayven10 look at this from a different angle. What if a member of the public or a resident nearby was made feel uneasy or uncomfortable by someone video taping them? Do they not a right to report it to the police that they think there is some freak or some nutcase video-taping people? Now if that person does genuinly feel the person is a f*cking nutjob video taping people then they should report it and it should be investigated, and not be abused by some jumped up conspiracist
mitchboo1984 3 weeks ago
@mitchboo1984
RP4409 2 weeks ago
@RP4409 no you absolute twat, what i am saying is that any officer of the law should be able to respond to calls where someone feels threatened by some randomly video taping in public without being spoken to in the manner in which he was spoken to, which was disgracefull. Secondly they are not pirates they are police officers, have some respect.
mitchboo1984 2 weeks ago
@mitchboo1984
AGAIN...so anytime you feel "threatened" or as you said earlier "uncomfortable" by man carrying a video camera goons with guns can accost the man?
You're living in tin foil hat land and I think I've seen your ideology in a movie called minority report.
RP4409 2 weeks ago
@mitchboo1984 In AZ one doesnt have to identify themselves to law enforcement unless an officer has reason to believe a crime has been, is being, or will be committed. You can look up the ARS statute if you like. This means the guy doesnt have to identify himself period, nor should he. Officers can ask you any question and make any REQUEST they want but YOU as an American citizen do not have to comply. As you see the guy did not turn off his camera....excellent call.

Not to mention, the cop is a PUBLIC servant, so he is fair game. Do a little research.

Strange defensive, defiant attitude against a very polite policeman. He was uncooperative and hostile before he even left his house in the morning. You're trying to make a ridiculous argument. Good try but carrying an AK-47 is not the same as carrying a camera around. When was the last time someone killed someone with a camera?
RP4409 4 months ago 2
@RP4409 Im not saying someone has killed someone with a camera lately, but think of some things that have been done that people were waiting to record, such as IED's in iraq, why do you think the military makes them shut off cameras? because in an area where people rarely sit in open public recording stuff it seems odd to do it and when the end result is an explosion meant to kill someone the camera makes sense because they are recording the thing done, and have been waiting for it.

noliesundead 4 months ago
@noliesundead
Reasonable suspicion is a legal standard of proof in US law that is less than probable cause, but more than an "inchoate and unparticularized suspicion or 'hunch' ";it must be based on "specific and articulable facts", "taken together with rational inferences from those facts". Police may briefly detain a person if they have reasonable suspicion that the person has been, is, or is about to be engaged in criminal activity;
It's just YOU that doesn't know what a Terry stop is..
