  • I am trying to become a police officer, and I just wanted to say that you are doing an amazing job in these videos. If I were to become a cop, I really wouldn't mind being filmed and neither should anyone else. These videos remind me of why I am trying to become a police officer. I want to be one of the few that actually make the profession look good.

  • @sniping12 You can do it too sir. Learn your rights and in this case, your state laws for identifying yourself to officers. States vary in this respect. Some you have to on demand alomst and some like AZ place the burden on the officer to have cause for you to identify yourself. If you truly know your rights and use them(not just to be difficult) officers will be less apt to try and take advantage of you. Remember, they love ignorant citizens.

    He chose to keep his information private and the cop detained him for doing so, which is illegal. (Detained because he was not free to go at one point)

  • @MortifiedPenguin0319 It's called America. We can do things like that. In New York State a cop cannot request any information unless he has a specific and articulate reason for the request. Our Constitution keeps us safe (or it's supposed too) as does the Federal Constitution. I do agree a line would become blurred, but it would be the line between privacy and invasion of privacy by the government if citizens do not stand up for their rights.

They expect everybody to just comply with all their requests and when they meet an informed citizen they can get a bit testy. SOME, are adults and will respect your rights. They don't want to face up to the fact that we the people are actually in charge. They are paid (by us) public servants. Society has allowed them to forget that their job is to protect the rights of the individual. Blind obedience, and gestapo tactics for failure to immediately "comply" are not part of that protection. Why don't you stick with logic instead of asking the same question over and over? You say no. Tell the cop to leave. End of story. Tell him it's none of his business why you are taping. It's legal and that's all he needs to know. Get his name and badge number, his supervisor and threaten to sue his ass if he doesn't leave. The same question over and over is annoying.

    This would have all been fine with me if the cop hadn't detained him (he told him he wasn't free to go which is the embodiment of a detainment).

  • @mitchboo1984 In AZ one doesnt have to identify themselves to law enforcement unless an officer has reason to believe a crime has been, is being, or will be committed. You can look up the ARS statute if you like. This means the guy doesnt have to identify himself period, nor should he. Officers can ask you any question and make any REQUEST they want but YOU as an American citizen do not have to comply. As you see the guy did not turn off his camera....excellent call.

I am a law abiding citizen with NO criminal past. I was even placed in the back of his car for standing up and telling his partner to tell him to get out of my car I didnt consent!   • I am a former military police officer and civilian law enforcement for a combined total of 20yrs and I am slowly starting to realize how people's rights are being (or better yet have been) taken away. And very true, if you are NOT being detained then you ARE free to go! When I first began watching 4409's video's I believed this man was an idiot, but after seeing most of them, I can say from a Police Officers view point that he is well within his rights to act the way he does without consequence.

Federal wiretapping regualtions state specifically that events and or conversations, held in PUBLIC, are not considered private, therefore, the expectation of privacy for acts or conversations held in PUBLIC garnish no protection under the privacy laws, unless specified by the individual states in which the recording took place. Not to mention, the cop is a PUBLIC servant, so he is fair game. Do a little research.

Being an officer is a dangerous job and you do risk your life everyday. What happens when someone dials 911 because of a break in, or a robbery? Who shows up? The cops, and they show up with little info most of the time cause of frantic callers, they don't know if the person breaking in has a gun, they risk their lives.

  • The videographer is instigating. He's trying to cause an issue. So yes, he could have been detained for public disturbance. Wouldn't have been charged, but could have easily been detained, possibly booked. Remember the law says you can't break regulations and it's the regulations that are most flexible. In short, Ass with Camera guy is an Ass.

  • @RP4409 Im not saying someone has killed someone with a camera lately, but think of some things that have been done that people were waiting to record, such as IED's in iraq, why do you think the military makes them shut off cameras? because in an area where people rarely sit in open public recording stuff it seems odd to do it and when the end result is an explosion meant to kill someone the camera makes sense because they are recording the thing done, and have been waiting for it.

  • @RP4409 - Due Diliegence - lets say something did occur, and they hadnt done thier job in checkout this suspect action of a person just standing there taping things, then something had resulted from it....then it would be on the department to explain why they DIDNT ask you questions, why they DIDNT appraoch on your activities.

    question:

    1) how many people stand around taping everyone? i assume you do not use professional equipment nor are you marked as a reporter of any kind..and at night

    uhhhhh I do have professional equipment but that is not relevant and it's easy for the department to explain why they didn't ask me questions or didn't approach me because they had no legal authority to do so.

  • @RP4409 - you make me laugh. you are arguing law based on your interpreation. Being through some legal things myself, i have come to find that even if it doesnt seem like it applies, they can easily twist or manipulate it to work in someones favor.

  • @361assassin BEEEP wrong! This is pure harassment. The cop doesn't like the fact that this man is protesting him and he wants to make it known that he has the authority.  That is harassment. Plain and simple. Was the cop called to the scene? Did the cop witness a crime being committed or in the process of being committed? No, then he has no business harassing a citizen. PERIOD.
