  • @Lonsoleil I'd agree with you regarding crack or other very hard drugs, but what about people who have criminal records for smoking marijuana? If your employee is a gambler (which is legal in some states as far as I know), he's probably much more likely to steal from you etc. than if he is a pot smoker! You'd be right if you had to commit some serious crimes to get incarcerated in the US, but 25% of the population having criminal records shows that that's not the case, so this is wrong.

  • Quick semi-related question: If the majority of people with criminal records are black, how does not hiring someone with a criminal record make business owners rascist or descriminatory? They don't say 'I will only hire white people with criminal records' they just don't hire people with criminal records. I understand that many black people live in the bad side of neighborhoods, but that's a problem for the government offices, not for business owners who look for someone with a clean record.

  • In every job application I've done, with the prior criminal background section, next to the box where to check yes or no, theres always read in paranthesis: Checking Yes will not automatically disqualify for position. Bullshit.

  • I graduated from 4 schools. I got my masters 8 years ago, and I still do not have a job that pays at least 25K per year. I only clean bathroooms, sell shoes and things like that. I have a good credit history, never been in jail, and never been involved in drugs.

  • One problem with the system is we now have "crimes" that are misdemeanors which in past times were nothing more than summary offences like DUI with no accident or injury.Now they are making so many laws criminal offences unless you're a saint it will be impossible not to have a criminal record.However I don't think a store should be forced to hire someone with a record for retail theft. Soon a want ad will state the following" anyone who is not a minority with a criminal record need not apply".

  • I know waay too many cases of people who go to jail for doing drugs and get super LONG sentences and then can't get a job when they get out, I know one dude who went to jail for life with NO parole  just for a tiny pint of marijuana. My cousin got a job at Sea World and was immediately fired because of his record (doing marijuana) so he went back on the streets cause he couldn't get any job,had no money..etc..it's sad a plant can get you life in prison.

    Here in TN, if you are caught with any amount of cocaine and you have a firearm on you (even if its legal), its a level 1 class A felony w/ a mandatory sentence of 8-12 years. So really this is a why to put blacks they suspect are in gangs away.

  • Cenk is missing half of the problem. I agree we have to end the war on drugs, but there is a feature in the American penal system that is not found anywhere else in the developed world. Every other country automatically expunges your conviction (with the exception of murder) after a certain amount of time has passed. So a violent criminal would have to wait 20 years (for example) while the drug dealer might get a fresh start after 1 or 2. Either way, you get a fresh start.

The Cops set up a sting operation selling $10 bags of weed and when the people bought the $10 BAG of WEED they were arrested and their vehicles seized under their asset forfeiture law.     The judicial system in regards to drug offenses is inherently flawed and outdated. If you are caught possessing marijuana in any context, then you will be convicted and have a criminal record. Thats how easy it is. You can't just say "well they committed a crime, they're criminals" when those crimes are actually of such a small calibre that anybody, ANYBODY could commit them. It has everything to do with the poverty that a system like this causes.

Which means we have to deal with them. Jail time won't deterr them if they can't find a job that pays the bills. So we need to find a way for someone to be ABLE to pull themselves up by their bootstraps. We don't have that in the US, but everywhere else they do.

    I can say though from expierence that I do have a criminal record as well and it does make finding work difficult...however I CAN pay a hefty fee to have it removed from my record. There's a legal term for it but I can't remember what it's called....so there ARE ways to rid serious misdemeanors and less serious felonies from your record.

    But if you're like a murderer or rapist...that stuff has to stay IMO.

It's bad enough that they don't regulate the credit score system so anyone and everyone can make a claim on you no matter what, and that anyone who loses their jobs also loses points in their credit system almost instantly after losing their job. it's a seriously poor system.

I personally know a lot of white people with criminal records and they seem to be just as successful as anyone else. I'm always surprised to learn about their past because their present lives seem so perfect.

Here, the only time rape victims are excused testifying in open court is when they are minors - and even then its done via video link. The crime of rape has never been taken lightly here; investigations are thorough and juries often take days to reach a verdict.     The bottom line is felon disenfranchisement and the War on Drugs is the preferred mechanism. Felons may legally discriminated against for housing, employment, and educational opportunities both government and private. They can be prohibited from voting, serving on a jury, serving in the military, etc.

  • It probably should be 1 in 3. Some people are just good at avoiding the law.

    Myself, the biggest law I've broken is jaywalking. In my short eighteen years, I consider that an accomplishment, because it means I didn't click "Yes, I'm 18" at a certain cite when I wasn't, I didn't download music, I didn't shoplift pokemon cards when it was a cool thing to do.

    In today's society, its a shame that could be considered an accomplishment.
