As far as justification goes, murdering another person under the circumstances that the crime took place under wouldn't be justifiable even if he was completely insane. Being justified implies that he'd have been able to walk about completely unchecked.

That's very possible, and it's what the prosecution PROBABLY would have aimed for. However, there are many mental "defects" that don't impair a person's ability to distinguish right from wrong. Many of those can and have been used by defenses to successfully avoid criminal punishment for their clients. If Benoit hadn't died and his defense could establish that he had such a condition, they may have been able to avoid jail time all together. It's an alternate possibility.

Placing Bibles next to their bodies indicates he knew what he did was wrong. Also, had Benoit not killed himself and had gone to trial, the burden would have been on his defense team to prove that he was insane at the time of the murders. I just don't see any proof that he didn't know what he was doing. Simply having some brain damage isn't enough evidence. It's easier for me to believe that he was just a chronic wife beater, as Nancy had filed for divorce previously.

How does someone not have control over whether or not to commit murder? Strangling your wife to death isn't an involuntary function like breathing. You have to make the conscious choice to do it, which demonstrates control. Nobody took over his body and made his arms strangle his wife's. Benoit killing his son was clearly a "mercy killing," which shows control.

Legally speaking, that's not necessarily true. Knowing right from wrong isn't the only standard that's used when determining whether a person who's been charged should be tried criminally or treated due to mental disfunction.
As far as justification goes, murdering another person under the circumstances that the crime took place under wouldn't be justifiable even if he was completely insane. Being justified implies that he'd have been able to walk about completely unchecked.

That's very possible, and it's what the prosecution PROBABLY would have aimed for. However, there are many mental "defects" that don't impair a person's ability to distinguish right from wrong. Many of those can and have been used by defenses to successfully avoid criminal punishment for their clients. If Benoit hadn't died and his defense could establish that he had such a condition, they may have been able to avoid jail time all together. It's an alternate possibility.
