Anyhow... I know you'd much like to avoid legal issues by using "Mario" so If I could make a suggestion of creating a mario look alike but is wearing a black suit instead of red and has a 'Z' on his hat instead of an 'M'
He said its a clone which mean he isnt copying it exactly... Plus patents actually say " Freeware copies of the above products are subject to usage and can be used without fee's payable by the target audience" So you can create what you want as long as you dont charge a fee and keep it within respected laws...XNA is non profitary for developers except on Xbox live
