it may be against flag code, but it has long been established that enforcing the flag code violates the first amendment, even the confiscation of the flag. Further, the code is ridiculous and violated everywhere including the republican convention; it is againt the law to paint the flag in a mural which has been all ocer in Minneapolis.

Actually, writing an autograph or displaying a flag with an autograph is considered disrespectful to the flag.

That's great, but not illegal. The United States Flag Code does not supersede the Constitution and the First Amendment.

None of this changes the fact that it is still considered disrespectful. Am I saying that he should have been arrested? Of course not. He wasn't arrested to begin with.

Writing on the flag should carry the same weight as burning the flag unceremoniously. Anyone who does it is violating no law, but they ARE violating the flag. Flying a violated flag isn't as bad, but it is no longer able to act as a symbol for the United States.

With that said, the police had no right or reason to take the flag.
