Because if not, that means government would favor one religion over another. Which would go against the first amendment, and the establishment clause. Which is the law.   • This is not a question of separate but equal because no one is claiming that marriage is the same as a domestic partnership. They are two distinct institutions that are covered by two different sections of the CA Code.

    Prop 8 defined marriage in the exact same manner it had been defined by the people of CA since the state's inception.

    Homosexuals are entitled to marriage in the same manner as anyone else. They simply CHOOSE not to abide by the conditions attached to it.

You are free to live your life as you see fit with no interference from the state. What you are not able to do is get the benefits from society because you refuse to comply with the legitimate restrictions and conditions society has attached to those benefits.

  • The whole fallacy of this series is the claim that marriage is a right. It's not. Is there a right to marry a person who refuses? No. Your own siblings, parents, or immediate relatives? No. More than 1 person? No. Marriage requires consent & has restrictions just like driving a car or getting a vocational license(as consent comes from the state and there are restrictions). Are they rights too? No.

  • Marriage has nothing to do with religion? I disagree, many synagogues, churches and temples perform same sex-marriage and it has to do, in part, with religious freedom. Now civil marriage has nothing to do with religion, even if it stems from religious law it is not religious when the State performs them. A good analogy I can think of is citizenship, either you are born into a religion or you convert, but once you're in you're in and that's the origin of State citizenship or nationalization.

  • I fully support gay marriage. Huge opponent of Prop 8.

    However, there is a flaw in the logic of this series. There's a huge difference between State law and Constitutional Law. In fact, the Constitution establishes State's rights in all matters not specifically mentioned (ie. Marriage) Therefore, as it is currently interpreted, it is against the constitution to step in and tell a State it is wrong for holding a legal vote on marriage law. Blame the state, not the fed.

If the U.S. Supreme Court (the ONLY authority on the Constitution) decided the case and found that gay marriage is totally legitimate according to the Constitution then all states would have to abide by that ruling... so yeah, blame the Fed... just look at Roe v. Wade

    Marriage is a privalage, not a right. Gays still enjoy the same rights, such as the freedom of speech. But they can't get married to who ever they want. But just because of that doesn't mean that their "rights" were taken away.

    Perhaps one day all of you will wake up and think, "That's what he meant. That makes sense." But I doubt that day will come because you all seem to shallow minded to think for once.

    However, the discrimination of prohibiting someone from a privilege based on nothing they've actually done runs counter to the principle of equality under the law.

    The family aspect is also a moot point, thanks to adoption. It could be argued that dual-income households run counter to the idea of marriage, lacking a "homemaker".

    And for the record, I'm against marriage. Not just gay marriage, all marriage.

  • Are you really that blind? Before Prop 8 was passed, Prop 22 was deemed "unconstitutional" by the CA Supreme Court. How the hell do you think 18,000 couples got married right before election day? They could marry then but not now. That means their right was taken away.

    Marriage IS a right. In the Declar. of Indep., Thomas J. wrote that each citizen is given 3 INALIENABLE rights: "life, liberty, & the pursuit of happiness." MANY founding fathers believe that marriage constitutes as a right.

  • Why do people who wish to redefine marriage always try to equate it with race? The two situations are completely different. Homosexuals were never brought here against their will, held in bondage, denied their basic right to life and liberty. They have never been denied the right to read or vote. We fought the deadliest war in our history to rectify the mistakes we made in denying these rights on account of race and we amended the Constitution specifically to redress those wrongs.
