After a long fight - BMW eventually agreed to replace both of the balljoints under the warranty after initially quoting £800 to replace just one of them. According to Mad4Mini this failure is very common on 3 series and 5 series which have these balljoints. If BMW just packed them with grease in the first place then they would last much, much longer before failing.
This turned out to be the lower, out ball joints. Where the suspension arm meets the hub. I had this temporarily fixed by Mad4Mini in Leeds. The cause according to them is that the balljoints are "fitted dry" by BMW which results in them prematurely degrading leading to this noise. The temporary fix is to make a small incision in each ball joint (they have rubber seals) and fill with liquid grease or other rubber friendly lubricant.
I have exactly the same problem in my BMW 335i 2007!
