If you don't want to dig up the roots of that tree, you can cut it to the ground, and put a bucket over it for a couple years, and the roots will eventually run out of energy. Start in the spring and keep it covered : )

It is suppose to be a wild mulberry but it grows a mile a minute and is not going to stay.

I would just cut the trash tree down. Not good to have the roots so close to your foundation.
