I dont like how this show is very inconsistent with its characters. Sheldon claimed that his spot(at home) was his becuz he chose it 1st, and the long list of reasons as to its convenience. Also when Penny told Sheldon to sit down when he was at her apt. he said he needed time to examine her home so he could choose an adequate spot. However in this episode he is claiming that's his spot despite the fact that that guy was there 1st and Sheldon didnt even examine the cell yet.

His summation of Penny is purely his opinion, his driving through the red light was not necessary (although she was in pain, it wasn't a life/death emergency) and therefore not legal, and most states have driving laws that assume your guilt unless you can prove your innocence when you're caught on camera, so his Sixth amendment argument is irrelevant.

The most he could do is claim that it isn't him in the picture, and hope he gets away with it.
