Some of the fault does lie with her though. When she complained her head hurts, she should have understood that this was her limit and removed herself from the competition. She was an adult and should have made an educated choice at that point in time, between continuing for a Wii or taking her health and safety as highest priority.

Though she must have had the impression the discomfort would soon pass, and that the competition was harmless and safe for her physical wellbeing.

As far as the legal side of this is concerned, I support the DJs. They shouldn't be prosecuted for what someone else did to themselves. The contestants signed releases, and one drank herself to death. Thats terrible, but it would be an injustice to put these people away for something so stupid. What he said was morally wrong.
