The thing is the Constitution does not apply to prisoners of war. A prisoner of war is not entitled to a trial nor does his period of incarceration have any limit. He was not arrested by the FBI or any other US law enforcement entity. Even if he were, he could shoot them with impunity as they would be criminals acting well outside their jurisdiction.

Every Guantanamo detainee should be given a fair trail according to international standards, and be judged in an international court of law, and if proven guilty, then be prosecuted according to the law. All detainees being freed should be sent back to their home countries so that they can be back with their families, and not allowed to stay elsewhere. Their governments should be able to take care of them.
