i love the fact that even though they cant prove he's drunk atm they arrest him for driving drunk?????????? wtf is that about, should at least give a mandatory breathilizer (sp.) first to have some basis
@praetorian2150 Police Oficers don't "prove" drunk driving in the field. That's what court is for dummy! "mandatory" breathalyzer"? People have the right to refuse. You'd make a great lawyer.
That's correct! Your statement said "they can't prove he's drunk and they arrest him for drunk driving?" The arrest is made on the Ofricers observations. It's not "proof" until the court determines the case is proven beyond a reasonable doubt. The officers observations in the field are the only "proof" he needs to make the arrest.
im just saying a portable breathilizer could make the job way easier. the probable cause is in the observation but seems a lil to loose for me evidence wise.
I understand what you mean and yes it would. The problem with this video is we can't hear all the conversation because the narrator talks over it. I can only account for myself when I say the odor of an alcohlic beverage on a persons breath..their speech...their gait when they walk and their eyes all lend to probable cause. And, of course, their driving.
ROFLMAO I live just down the road from where this guy lived. Unfortunately he is now dead, but it was still funny as shit when it happened.

Refusing to submit to roadside sobriety tests is grounds for arrest for further testing. Most departments do not carry portable breathalyzers.

no the court sentences you for drunk driving from the evidence the police hand over to to prove you were drunk.
