I believe the "War Powers Act" given to the executive branch to be unconsitutitonal as well. That would have required changing the Constitution by amendment which they didn't do. Just because a law is passed doesn't mean that it is consitutional even if it has been in place for generations.

Basically once an officer reaches Flag level, (0-7 and above), it's more about answering Congressmen and Senators than dealing with the actual troops themselves. I know of a huge community of guys in Special Operations who think this is really just a waste of time and money.
